width:78.7pt"> <p> </p> </td> </tr> </tbody> </table> <p><strong>ANTECEDENTES DE HECHO.</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">De acuerdo con el informe de fecha 11 de noviembre de 2015, firmado por el Secretario adjunto se acordó el cambio de adscripción del Registro de Personal e informática, pasando a depender a la Secretaría de la Junta de gobierno.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Como consecuencia del mencionado cambio de adscripción, la gestión de la relación de puestos de trabajo pasó a depender del lugar de Jefe de servicio de selección y provisión, del mismo modo que se asignó al mencionado lugar de trabajo la sección de gestión de personal, anteriormente dependiente del Departamento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Concretamente, y de acuerdo con aquello establecido al acta de la Mesa general de negociación de día 29 de febrero de 2016 se negoció la modificación del lugar de Jefe de servicio de selección y provisión incluyente dentro del mismo, la Sección de gestión para que estuviera dentro de un servicio y añadiendo también la gestión de la relación de puestos de trabajo, que, como se ha dicho anteriormente, estaba dentro de registro de personal hasta el cambio de adscripción del Registro de personal e informática.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Como consecuencia de lo expuesto el Departamento de Personal, hasta ahora, se encontraba organizado en dos Servicios, además del Servicio de prevención de riesgos laborales:</span></p> <ol class="circle"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Jefe/a de servicio de nómines y prestaciones.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Jefe/a de servicio de selección, provisión y gestión (con la gestión de la relación de puestos de trabajo).</span></p> </li> </ol> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La modificación a la que se ha hecho referencia implicó la asunción de nuevas tareas por parte del lugar de Jefe de servicio de selección, provisión y gestión, que quedó de la siguiente manera, además de las funciones genéricas de jefe/a de servicio: ( se subrayan las funciones con que se incrementaron como consecuencia de la reestructuración):</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">- Redactar y llevar a cabo los trámites adecuados por la aprobación de las bases de las convocatorias de acceso a la función pública y de la provisión de puestos de trabajo relativa al personal municipal que no pertenece en el área delegada de Seguridad Ciudadana., ejecutando los acuerdos adoptados en relación con las convocatorias de acceso a la función pública y de provisión de puestos de trabajo.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Apoyar a los órganos de selección y valoración en los procedimientos de acceso a la función pública y de la provisión de puestos de trabajo relativa del personal municipal que no pertenece en el área delegada de Seguridad Ciudadana.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-Dirigir, gestionar y controlar los procedimientos de gestión de todas la bolsas de trabajo del personal municipal que no pertence al Área delegada de Seguridad Ciutadana.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Supervisar la tramitación de las propuestas de nombramiento y cesamiento del personal funcionario, laboral y eventual municipal que no pertenece al Área delegada de Seguridad Ciudadana.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Supervisar la confección y transmisión de las propuestas de modificació de la relación de puestos de trabajo del personal funcionario y laboral municipal que no pertenece al Área delegada de Seguridad Ciudadana, manteniendo actualitzada la relación de puestos de trabajo de acuerdo con las modificaciones aprobadas por la Junta de Gobierno.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Mantener actualizada la relación de puestos de trabajo del personal eventual y de los órganos directivos, así como la estructura orgánica del Ayuntamiento referida al personal municipal que no pertenece al Área delegada de Seguridad Ciudadana.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Llevar un seguimiento de las incidencias generadas por los usuarios de las DMS y DMI de Calidad, así como de las incidencias generadas por los usuarios del Portal que afectin a su Servicio.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Colaborar con la atención al público presencial y por medios telemáticos.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Como se puede observar, la modificación del puesto, incluyendo la gestión de la relación de puestos de trabajo y la sección de gestión incrementó sus funciones en un 50% respecto a las que ya tenía asignadas.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Posteriormente, además, se debe tener en cuenta que desde agosto del año 2019, el Área de Seguridad Ciudadana, que hasta el momento tenía asumidas las competencias en materia de personal, las ha transferido nuevamente al área de Función Pública, asumiendo las competencias en&nbsp;materia&nbsp;de selección y provisión del colectivo de personal policía y del Cuerpo de bomberos.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Desde la aprobación de la modificación a la que se ha hecho referencia, se ha constado que las necesidades organizativas del departamento de Personal han ido cambiante y para prestar el servicio de la manera más eficaz posible, teniendo en cuenta la complejidad que supone la gestión de la relación de puestos de trabajo y la coordinación y control de la negociación sindical y, con el fin de gestionar correctamente el número de procedimientos que se llevan a cabo en la gestión diaria del departamento, hacen necesaria la creación de un nuevo Servicio en el que se incluya la gestión de la relación de puestos de trabajo y la provisión de puestos de trabajo.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Como consecuencia de lo expuesto, se propone la creación del puesto de Jefe/a de servicio de selección y la modificación del puesto de Jefe/a de servicio de selección, provisión y gestión, para adecuarlo a los cambios propuestos.</span></p> <p><strong>Características del puesto de Jefe/a de servicio de planificación y provisión de puestos de trabajo:</strong></p> <table border="1" cellspacing="0" class="Table" style="border-collapse:collapse; font-size:10px"><span style="color:black">-Supervisar la tramitación de las propuestas de nombramiento y cese del personal funcionario, laboral y eventual municipal.</span></span></p> <p style="text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:10px"><span style="color:black">- Llevar un seguimiento de las incidencias generadas por los usuarios de las&nbsp;DMS&nbsp;y&nbsp;DMI&nbsp;de Calidad, así como de las incidencias generadas por los usuarios del Portal que afecten a su Servicio.</span></span></p> <p style="text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por otro lado, la asunción de las competencias de función pública en materia de Seguridad Ciudadana, hacen necesario así mismo, una adaptación de la plantilla para recoger la realidad actual a la relación de puesto de trabajo. En este sentido, ya se aprobó el decreto n.º 18.671 de 27 de septiembre de 2019, mediante el cual se procedió a la modificación de la dependencia orgánica y funcional, de determinados lugares de trabajo como consecuencia del Acuerdo de Junta de Gobierno de fecha 31 de julio de 2019, publicado al&nbsp;BOIB&nbsp;n.º 109, de 8 de agosto de 2019, de delegación de competencias en las concejalías de las áreas y áreas delegadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En dicho decreto, no se reflejó a la relación de puestos de trabajo previa la correspondiente negociación sindical, por lo cual, se tiene que llevar a cabo la misma, para cerrar la reorganización pretensa al presente informo siguiendo con aquello establecido a la normativa aplicable, concretamente aquello establecido en el artículo 91 de la ley 3/2007, de 27 de marzo, de la Función Pública de la comunidad autónoma de las Islas Baleares, que regula los cambios de adscripción de puestos de trabajo concretando que:</span></p> <p><em>&nbsp;“El Consell de Govern, a propuesta de la persona titular de la consellería competente en materia de función pública, por reestructuración de la Administración o por necesidades del servicio o funcionales, y a efectos de asignar de manera eficiente los recursos humanos, puede acordar la adscripción de puestos de trabajo y del personal que provisionalmente o definitivamente los ocupa a unidades, consellerías o entes del sector público instrumental con personificación pública, distintos de aquellos a los cuales estaba adscrito.</em></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black"><em>2. Los cambios de adscripción tienen que respetar en todo caso las retribuciones, las condiciones esenciales de trabajo y la isla de residencia del personal afectado. Si procede, se tiene que modificar la adscripción del lugar proveído provisionalmente o definitivamente por la persona funcionaria afectada.“</em></span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Esta cambio de adscripción afectará a los siguientes puestos de trabajo:</span></p> <ol class="circle"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">F20010032 expansión 2 (TAG seguridad ciudadana), expansión que cambiaría de adscripción pasando a incrementar una expansió del puesto de trabajo F22010012 (TAG del departamento de personal).</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">F22000158 expansión 3 (administrativo/a Mando operativo/administración, unidad protección civil), que cambiaría de adscripción incrementando una expansión del puesto de trabajo F22000009, pasando a ser un total de 6 expansiones.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">F30170021, Jefe/a de departamento del Área de Seguridad Ciudadana que cambiará de adscripción, pasando al departamento de personal.</span></p> </li> </ol> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Para adaptar a la nueva estructura y a las nuevas funciones encomendadas, se tiene que llevar a cabo una adecuación del puesto de Jefe/a de departamento de&nbsp;RRHH&nbsp;del área de Seguridad Ciudadana.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La denominación de este puesto de trabajo pasará a ser Jefe/a de departamento adjunto de Personal, de quien dependerá directamente la Sección de Gestión de Personal (que no tiene asignado ningún Jefe de servicio).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las funciones específicas que&nbsp;tendrá&nbsp;asignadas serán las siguientes:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Sustituir al Jefe/a de departamento de personal en caso de baja, vacaciones y ausencia en general y realizar otras funciones que puntualmente le pueda encomendar o delegar el Jefe/a de departamento de personal.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Asesoramiento jurídico que se le encomiende por parte del Jefe/a de departamento y la Dirección del área.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Formación en materia de función pública, deontología profesional, código ético etc.</span></p> <p style="margin-bottom:0px;
