40951 es CAIB ![CDATA[Adjudicación de la Convocatoria de subvenciones para la investigación en materia de arqueología y/o paleontología en la isla de Mallorca, en el archipiélago de Cabrera y en los islotes adyacentes, plurianual 2020-2022]] 470 CAIB 40947 642118 2020-11-28 text/html CAIB 11802 2020-11-26 es ![CDATA[<p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En la sesión de día 25 de noviembre de 2020, el Consejo Ejecutivo ha acordado lo siguiente:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">“La presente la Convocatoria de subvenciones para el estudio en materia de arqueología y/o paleontología en la isla de Mallorca, en el archipiélago de Cabrera y en los islotes adyacentes, plurianual 2020-2022, se da en el marco de las competencias asumidas por el Consejo Insular de Mallorca, en virtud de la Ley 6/1994, de 13 de diciembre, de atribución de competencias a los consejos insulares en materia patrimonio histórico, promoción sociocultural, animación sociocultural, depósito legal de libros y deportes (BOIB nº 159, de 29/12/1994). Con la aprobación de la Ley Orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares, las competencias en materia de patrimonio histórico se consideran como propias de acuerdo con su artículo 70. Entre estas competencias se encuentra la de velar por la conservación del patrimonio cultural. El art. 73 establece que corresponden a los consejos insulares, en las materias que este Estatuto les atribuye competencia propia, el ejercicio de la actividad de fomento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Ley 12/1998, de 21 de diciembre, del patrimonio histórico de las Islas Baleares en el título IX sobre medidas de fomento y difusión, y más concretamente en el artículo 81 sobre el principio de colaboración, dice que las administraciones públicas colaborarán con los propietarios y titulares de derechos sobre bienes culturales para conservarlos, recuperarlos y difundirlos. El artículo 22.3 establece que los poderes públicos promoverán, por todos los medios a su alcance, la conservación, la consolidación y la mejora de los bienes integrantes del patrimonio histórico de titularidad pública y privada. Entre las medidas de fomento se encuentra la inversión cultural en forma de ayudas en la conservación, la restauración, la mejora y la puesta en valor del patrimonio histórico.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Convocatoria se aprobó por acuerdo del Consejo Ejecutivo en la sesión de día 15 de julio de 2020 y se publicó, por conducto de la BDNS, en el BOIB nº 137 de 06/08/2020. Modificada por acuerdo del Consejo Ejecutivo en la sesión de día 5 de agosto de 2020 (BOIB nº 144, de 20/08/2020). La cuantía global es de 900.000,00 €, repartidos de la siguiente manera: 20 33620 48900 destinada a particulares por importe de 100.000,00 €; 20 33620 46200 destinada a ayuntamientos por importe de 100.000,00 €, y 20 33620 45390 destinada a universidades e institutos de investigación por importe de 100.000,00 €, para cada anualidad, condicionado a la existencia de crédito adecuado y suficiente para los años 2021 y 2022. El importe total asciende a 900.000,00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Conforme al acta de la Comisión Técnica de Evaluación, reunida el día 27 de octubre de 2020 para examinar los expedientes y valorarlos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Conforme al informe de 9 de noviembre de 2020, emitido por el secretario técnico de Cultura, Patrimonio y Política Lingüística en el cual hace constar que los beneficiarios cumplen con todos los requisitos necesarios para acceder a las subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Conforme al informe jurídico de 9 de noviembre de 2020, emitido por la TAG del Servicio Jurídico de Patrimonio Histórico.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Visto el informe de fiscalización de conformidad emitido per la interventora delegada de fecha 17 de noviembre de 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Visto el artículo 18.4 a) OGS y la base 23.4 de ejecución del presupuesto 2020, corresponde al Consejo Ejecutivo, entre otros: atorgar concesiones,&nbsp; aprobar y resolver subvenciones, así como autorizar y disponer gastos de cuantía superior a dos cientos cincuenta mil euros (250.000,00 euros).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per todo lo expuesto, la vicepresidenta primera y consejera ejecutiva de Cultura, Patrimonio y Política Lingüística, eleva al Consell Ejecutivo, la siguiente propuesta de</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ACUERDO</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>I.- Denegar</strong> las siguientes solicitudes por no llegar en mitad de la puntuación:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) del criterio 3, La viabilidad técnica del proyecto de investigación. Plan de Trabajo, la puntuación mínima son 47,5 puntos:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 1 Proyecto de cambio en una sociedad isleña: vida y muerte en la prehistoria de Mallorca. Ha obtenido 35,75 puntos.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) del criterio 2, Idoneidad del investigador/a principal, la puntuación mínima son 25 puntos:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 3 IASCM investigación arqueológica subacuática a las cuevas de Mallorca. font-size:12px">d) En el año 2021, a cargo de la aplicación presupuestaria 20 33620 48900 por importe de 31005,00, <strong>acrecentar</strong> con un total 15224,37€ la línea de universidades, aplicación presupuestaria 20 33620 45390, <strong>acrecentar</strong> con un total de 15.780,63€ la línea de ayuntamientos, aplicación presupuestaria 20 33620 46200, en base al punto 3.1 de la Convocatoria y, en consecuencia, <strong>conceder</strong> subvenciones por importe de 31005,00€.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) En el año 2022, a cargo de la aplicación presupuestaria 20 33620 48900 por importe de 27850,00 € y de la aplicación presupuestaria 20 33620 45390 por importe 1334,20€, <strong>acrecentar </strong>con un total 29.184,20€ la línea de ayuntamientos, aplicación presupuestaria 20 33620 46200, en base al punto 3.1 de la Convocatoria y, en consecuencia, <strong>conceder</strong> subvenciones por importe de 29184,20€.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>IV.- Se aprueba</strong> la firma del convenio regulador establecido en la base 14.1 de la convocatoria (modelo Anexo XIII).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>V.- Comunicar </strong>los gastos<strong> </strong>no son subvencionables, teniendo en cuenta que:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Convocatoria tiene como objetivo principal la investigación y, de conformidad a su contenido, y especialmente el punto 4, no son subvencionables las partidas referidas a:</span></p> <p style="margin-bottom:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- los trabajos de desbroce y limpieza de los yacimientos arqueológicos</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- la promoción sociocultural</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.- la documentación y los gastos resultantes de la investigación o de las intervenciones arqueológicas derivadas de la misma, que son de obligada presentación e intrínseca a la propia investigación y, por lo tanto, se entiende que <em>per se</em> no son objeto de subvención puesto que son la justificación científica de todo el gasto del proyecto</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.- Canon de las universidades</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.- Los billetes de avión o barco al no considerarlos como excepcionales en relación a la naturaleza del proyecto, de conformidad con el punto 4. 6</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.- Los trabajos de marger</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 5 no son subvencionables las partidas: material fungible de restauración y documentación, dibujo, estudios materiales y restauración, gestión y administración (el 5% del canon de la UAB).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 7 no son subvencionables: las partidas de vuelos, la partida de consolidación y estabilización de estructuras del año 2021, la partida de adecuación del Estudio General Luliano que no tiene cabida dentro del objeto de subvención, la redacción de memoria de restauración, el concepto traslado equipo de arqueología construcción dos personas de la anualidad 2022. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 8 se ha llevado a cabo un recálculo de la partida seguros y de la partida gastos derivados de la gestión del proyecto, conforme al punto 4.6 de la convocatoria no puede superar el 5% del presupuesto. Dentro del año 2022 no se subvencionará la partida memorias (material imprenta, papelería y reprografía).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 10 no es subvencionable, dentro del año 2022, la partida “desbroce y limpieza del yacimiento”.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 11 no subvencionable, dentro del año 2020, la partida “panel informativo”; dentro del año 2021 la partida “Informe”; dentro del año 2022 la partida la aplicación “restauración y memoria final”.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 12 no son subvencionables: el desbroce de las tres anualidades.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 14 no es subvencionable, dentro del año 2020, la partida desbroce.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 15 no es subvencionable la partida de ilustraciones-reconstrucción de los ecosistemas y faunas de las tres anualidades.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exp. 16 no es subvencionable la partida restauradora, material fungible para la restauración y marger del año 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>VI.- Ordenar</strong> la publicación de este acuerdo en el Boletín Oficial de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>VII.-. Dar traslado</strong> del presente acuerdo a la Intervención Delegada Centro la Misericordia del Consejo Insular de Mallorca.”</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra este acuerdo, que no pone fin a la vía administrativa, cabe interponer el recurso de alzada en el plazo de un mes, a partir del día siguiente a la recepción de esta notificación. El recurso se puede interponer formalmente ante este Consejo Ejecutivo o ante la Comisión de Gobierno del Consejo Insular de Mallorca, que es el órgano competente para resolverlo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimación expresa del recurso de alzada podrá interponerse el recurso contencioso-administrativo, en el plazo de dos meses, a partir del día siguiente al de la recepción de la notificación de la desestimación del mencionado recurso.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una vez transcurridos tres meses desde la interposición del recurso sin que se haya notificado la resolución, podrá interponerse el recurso contencioso-administrativo, contra la desestimación presunta del recurso de alzada, sin limitación temporal, mientras no haya resolución expresa.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante, se puede ejercitar, si cabe, cualquier otro recurso que se estime pertinente.
