    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En fecha 21 de octubre de 2020, la jefa del Servicio de Entidades Jurídicas ha formulado la propuesta de resolución siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. El 10 de agosto de 2020, se registró de entrada en la Consejería de Presidencia, Cultura e Igualdad la solicitud de inscripción de la constitución de la Fundación Palma Futsal en el Registro Único de Fundaciones de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. El 31 de agosto de 2020, se solicitó un informe preceptivo y vinculante a la Consejería de Asuntos Sociales y Deportes, de acuerdo con el artículo 12.3 del Decreto 61/2007, de 18 de mayo, de regulación del Registro Único de Fundaciones de la comunidad autónoma de las Illes Balears y de organización del ejercicio del protectorado, dado que, de la redacción de los fines fundacionales,&lt;span style="color:#ff0000"&gt; &lt;/span&gt;se desprende que corresponde ejercer el protectorado a dicha consejería.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. El 25 de septiembre de 2020, se registró de entrada en la Consejería de Presidencia, Cultura e Igualdad el informe jurídico favorable sobre la idoneidad de los fines y sobre la suficiencia de la dotación de la Fundación Palma Futsal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. El artículo 34 de la Constitución española de 1978 reconoce el derecho de fundación para fines de interés general de acuerdo con la ley, y el artículo 53.1, reserva a la ley la regulación del ejercicio de los derechos y de las libertades reconocidos en el capítulo II del título I, entre los cuales hay el derecho de fundación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. El artículo 30.33 del Estatuto de autonomía de las Illes Balears, en la redacción de la Ley Orgánica 1/2007, de 28 de febrero, dispone que la Comunidad Autónoma de las Illes Balears tiene competencia exclusiva sobre las fundaciones que desarrollen principalmente sus funciones en el territorio de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. La Ley 50/2002, de 26 de diciembre, de Fundaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. El Real Decreto 1337/2005, de 11 de noviembre, por el que se aprueba el reglamento de fundaciones de competencia estatal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. El Decreto 61/2007, de 18 de mayo, de regulación del Registro Único de Fundaciones de la comunidad autónoma de las Illes Balears y de organización del ejercicio del protectorado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;6. El artículo 2 del Decreto 21/2019, de 2 de agosto, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, que otorga las competencias en materia de fundaciones a la Dirección General de Relaciones Institucionales y con el Parlamento, de la Consejería de Presidencia, Cultura e Igualdad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Propongo al director general de Relaciones Institucionales y con el Parlamento que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. Ordenar la apertura de la hoja registral y la inscripción en el Registro Único de Fundaciones de las Illes Balears de la Fundación Palma Futsal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Los datos que deben figurar en la inscripción son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— Denominación: Fundación Palma Futsal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— Escritura de constitución otorgada el 8 de julio de 2020 ante el notario Víctor Alonso- Cuevillas Sayrol (número 1796 de su protocolo y posterior escritura de enmienda), otorgada el 1 de octubre de 2020 ante el mismo notario (número 3667 de su protocolo).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— Número de identificación fiscal: G01786623.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— Protectorado al que corresponde la Fundación: Consejería de Servicios Sociales y Deportes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— Domicilio: c. de El Pedregar, 6, 2n piso, 07014 Palma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— De acuerdo con el artículo 6 de los Estatutos, las finalidades de la Fundación son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Promover y desarrollar el deporte balear, individual y colectivo, tanto de iniciación, amateur o de alto nivel.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Promocionar la imagen deportiva de los deportistas de las Illes Balears así como de sus clubes deportivos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Poner a disposición de los deportistas que tengan aptitudes para conseguir un alto rendimiento deportivo, todos los medios materiales, humanos, técnicos, científicos y su aplicación, para conseguir altos niveles en las grandes competiciones deportivas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Ser el centro docente de los practicantes de varias modalidades deportivas de las Illes Balears con las competencias para impartir y autorizar la enseñanza y la formación deportiva, sin perjuicio de las competencias que correspondan a la consejería correspondiente en materia de enseñanza reglada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Compartir la responsabilidad y el control de la tecnificación deportiva de varias modalidades deportivas, con la consejería del Gobierno de las Illes Balears competente en materia de deportes; su gestión es conjunta con las federaciones autonómicas implicadas en programas deportivos de tecnificación y alto rendimiento deportivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Supervisar, si procede, conjuntamente con la consejería del Gobierno de las Illes Balears competente en materia de deportes, la aplicación de los planes y programas deportivos, desarrollando segmentos como «deporte y mujer» y « deporte y discapacidad».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Formar el personal técnico deportivo en varias modalidades deportivas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Impulsar la investigación científica y técnica relacionada con la actividad física y el deporte, y también su desarrollo tecnológico, de acuerdo con la evolución europea y mundial en este campo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Promover la investigación y la especialización en el campo de la medicina deportiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Promover y desarrollar el voluntariado deportivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Prestar una formación deportiva integral y especializada destinada a las personas con discapacidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Conseguir recursos para destinarlos a programas de atención, apoyo, investigación e innovación en materia deportiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Tener y mantener un centro que promueva y dé a conocer los éxitos del deporte balear de fútbol sala y otras actividades deportivas, mediante la figura de un museo o centro de interpretación del deporte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Fomentar las actividades culturales relacionadas con el deporte, como por ejemplo: seminarios, congresos, talleres, obras culturales, reuniones, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Cualquier otra relacionada con las anteriores que acuerde el Patronato.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— Dotación inicial: 30.000 euros, de los que inicialmente se aportan 10.000 euros en metálico, a razón de 2.500 euros cada uno de ellos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;— Fundadores:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Los miembros aceptan expresamente el cargo en el acto de constitución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Notificar el contenido de esta Resolución a las personas interesadas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Disponer la publicación de esta resolución en &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; al efecto único de publicidad.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra esta Resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada en el plazo de un mes a contar desde el día siguiente de la notificación ante la consejera de Presidencia, Cultura e Igualdad, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 58 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
