    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para &amp;nbsp;la prevención de los daños en bosques ocasionados por incendios, desastres naturales y catástrofes, correspondientes al año 2015-2018, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 6 de novembre&amp;nbsp;de 2020, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.El 23 de octubre de 2019, el vicepresidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) dictó Resolución de concesión (R9) de ayudas para prevención de los daños en bosques producidos por incendios, desastres naturales y catástrofes, publicada en el Boletín Oficial de las Islas Baleares núm. 149, de 2 de noviembre de 2019, en relación con la ayuda concedida al amparo de la Resolución del Presidente del FOGAIBA de 21 de diciembre de 2018, por la que se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños causados ​​a los bosques por incendios forestales, desastres naturales y catástrofes. Entre otros beneficiarios hay JUAN ESCANDELL MARI, con NIF ***4213**, núm. de expediente PIFO2018_1/086, EULALIA MARI MARI con NIF ***3414**, núm. de expediente PIFO2018_1/091, ANTONIO MARI TORRES con NIF ***0903**, núm. de expediente PIFO2018_1/092 y JUAN CLAPÉS GUASCH con NIF ***1030**, núm. de expediente PIFO2018_1/093, todos ellos con un plazo de ejecución de 12 meses.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.El 29 de octubre de 2020, JUAN ESCANDELL MARI, presentó una solicitud de prórroga del plazo de ejecución (RGE 23406), debido a las circunstancias excepcionales derivadas del Covid-19, la empresa que hacía la limpieza ha tenido el personal en ERTE y no ha podido finalizar las tareas a fecha de hoy.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.El 28 de octubre de 2020, EULALIA MARI&amp;nbsp;MARI&amp;nbsp;presentó una solicitud de prórroga del plazo de ejecución (RGE 23285), que debido al estado de alarma la empresa que hacía la limpieza ha tenido el personal en ERTE y no ha podido finalizar las tareas a fecha de hoy.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.El 29 de octubre de 2020, ANTONIO MARI&amp;nbsp;TORRES presentó una solicitud de prórroga del plazo de ejecución (RGE 23.408), que debido al estado de alarma la empresa que tenía que hacer la limpieza ha tenido su personal en ERTE ya principios de noviembre podrá comenzar el trabajo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.El 29 de octubre de 2020, JUAN CLAPÉS GUASCH presentó una solicitud de prórroga del plazo de ejecución (RGE 23407), que debido al estado de alarma la empresa que tenía que hacer las tareas detuvo la su actividad durante unos meses por las restricciones impuestas por Covid&amp;nbsp;19 y no ha podido realizarlas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.El apartado undécimo, justificación y pago de las ayudas, de la Resolución del Presidente del FOGAIBA de 21 de diciembre de 2018, establece que el plazo notificar y justificar la realización de las actuaciones propuestas es de 12 meses, desde el día siguiente la fecha de notificación de la resolución de concesión de la ayuda. Por razones justificadas tal como bajas laborales e incidencias graves que no sean imputables al solicitante, los beneficiarios podrán solicitar la ampliación del plazo de realización y justificación establecido en la resolución de concesión. Esta solicitud deberá presentarse antes del plazo de ejecución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.La concesión de la ayuda se notificó el 2 de noviembre de 2019, por tanto el plazo máximo para la justificación de la inversión propuesta terminaba el 3 de noviembre de 2020 (12 meses). Los interesados ​presentaron las solicitudes de prórroga los días 29, 28, 29 y 29 de octubre de 2020 respectivamente, por tanto dentro de plazo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.De acuerdo con el apartado 2 del artículo 20 de la Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020, regula que, con carácter excepcional y por razones debidamente justificadas, los beneficiarios de las ayudas podrán solicitar la ampliación o reapertura de los plazos establecidos en la respectiva convocatoria, con excepción del plazo de presentación de solicitudes. Esta solicitud debe presentarse antes del vencimiento del plazo de que se trate.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.El FOGAIBA podrá acordar la ampliación solicitada siempre que con ello no se perjudiquen derechos de terceras personas. El acuerdo de ampliación se notificará individualmente al interesado y no es susceptible de recurso.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10.Considerando el Decreto 64/2005, de 10 de junio, de creación del FOGAIBA; en virtud de la Orden de la Consejera de Agricultura y Pesca de 23 de diciembre de 2005 se dispone que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11.Dado que las solicitudes de la prórroga se han presentado antes del vencimiento del plazo de justificación de la realización de las actuaciones y están debidamente motivada, se concederá la prórroga solicitada por un plazo de 6 meses, de acuerdo con el artículo 32.3 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de conce&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;sión de prórroga&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo lo expuesto anteriormente, se informa favorablemente la concesión de prórroga y propongo al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Por tanto, el plazo máximo para la justificación de la inversión aprobada será de 18 meses, desde el 3 de noviembre de 2019 hasta el 3 de mayo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Conceder la prórroga a EULALIA MARI MARI con NIF***3414**, núm. de expediente PIFO2018_1 / 091. Por tanto, el plazo máximo para la justificación de la inversión aprobada será de 18 meses, desde el 3 de noviembre de 2019 hasta el 3 de mayo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Conceder la prórroga a ANTONIO MARI TORRES con NIF***0903**, núm. de expediente PIFO2018_1 / 092. Por tanto, el plazo máximo para la justificación de la inversión aprobada será de 18 meses, desde el 3 de noviembre de 2019 hasta el 3 de mayo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Conceder la prórroga a JUAN CLAPÉS GUASCH con NIF***1030**, núm. de expediente PIFO2018_1 / 093. Por tanto, el plazo máximo para la justificación de la inversión aprobada será de 18 meses, desde el 3 de noviembre de 2019 hasta el 3 de mayo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Notificar esta resolución al interesado mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
