    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para &amp;nbsp;la prevención de los daños en bosques ocasionados por incendios, desastres naturales y catástrofes, correspondientes al año 2015-2018, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 6 de novembre&amp;nbsp;de 2020, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.El 23 de octubre de 2019, el vicepresidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) dictó Resolución de concesión de ayudas para prevención de los daños en bosques producidos por incendios, desastres naturales y catástrofes, publicada en el Boletín Oficial de las Islas Baleares núm. 149, de 2 de noviembre de 2019, en relación con la ayuda concedida al amparo de la Resolución del Presidente del FOGAIBA de 21 de diciembre de 2018, por la que se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños causados &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&amp;nbsp;los bosques por incendios forestales, desastres naturales y catástrofes. La persona beneficiaria MARIA MARI GUASCH, con NIF ***3983**, núm. de expediente PIFO2018_1/094 y con un plazo de ejecución de 12 meses.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.El 23 de octubre de 2020, MARIA MARI GUASCH, presentó una solicitud de prórroga del plazo de ejecución (RGE 22982) de 4 meses, que debido a que la empresa que tenía que hacer los trabajos paró su actividad durante unos meses por las restricciones impuestas por el Covid-19&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.El apartado undécimo, justificación y pago de las ayudas, de la Resolución del Presidente del FOGAIBA de 21 de diciembre de 2018, establece que el plazo notificar y justificar la realización de las actuaciones propuestas es de 12 meses, desde el día siguiente la fecha de notificación de la resolución de concesión de la ayuda. Por razones justificadas tal como bajas laborales e incidencias graves que no sean imputables al solicitante, los beneficiarios podrán solicitar la ampliación del plazo de realización y justificación establecido en la resolución de concesión. Esta solicitud deberá presentarse antes del plazo de ejecución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.La concesión de la ayuda se notificó el 2 de noviembre de 2019, por tanto el plazo máximo para la justificación de la inversión propuesta terminaba el 3 de noviembre de 2020 (12 meses). La interesada presentó la solicitud de prórroga el día 23 de octubre de 2020, por tanto dentro de plazo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.De acuerdo con el apartado 2 del artículo 20 de la Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020, regula que, con carácter excepcional y por razones debidamente justificadas, los beneficiarios de las ayudas podrán solicitar la ampliación o reapertura de los plazos establecidos en la respectiva convocatoria, con excepción del plazo de presentación de solicitudes. Esta solicitud debe presentarse antes del vencimiento del plazo de que se trate.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.El FOGAIBA podrá acordar la ampliación solicitada siempre que con ello no se perjudiquen derechos de terceras personas. El acuerdo de ampliación se notificará individualmente al interesado y no es susceptible de recurso.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Dado el Decreto 64/2005, de 10 de junio, de creación del FOGAIBA; en virtud de la Orden de la Consejera de Agricultura y Pesca de 23 de diciembre de 2005 se dispone que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.Dado que la solicitud de la prórroga se ha presentado antes del vencimiento del plazo de justificación de la realización de las actuaciones y está debidamente motivada, se concederá la prórroga solicitada por el plazo solicitado de 4 meses, de acuerdo con el artículo 32.3 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de conce&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;sión de prórroga&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo lo expuesto anteriormente, se informa favorablemente la concesión de prórroga y propongo al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Por tanto, el plazo m&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;á&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ximo para la justificaci&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n de la inversi&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ó&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n aprobada ser&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;á&amp;nbsp;de 16 meses, desde el 3 de noviembre de 2019 hasta el 3 de marzo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Notificar esta resolución al interesado mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Esta resolución no es susceptible de recurso.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
