es text/html 9953 35816 2020-10-22 35808 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">La Junta de Gobierno Local, en sesión celebrada el día 1 de octubre de 2020 aprobó la convocatoria de subvenciones para la concesión de ayudas al alquiler de viviendas en el término municipal de Puigpunyent, y se procede a publicar en el Boletín Oficial de la Comunidad Autónoma de les Illes Balears el acuerdo adoptado y la convocatoria de subvenciones, para su difusión y su conocimiento público.</span></span></span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">ACUERDO</span></span></span></strong></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">PRIMERO.</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">APROBAR la Convocatoria de subvenciones para la concesión de ayudas al alquiler de viviendas en el término municipal de Puigpunyent, de acuerdo con el texto que se adjunta y que forma parte integrante de la presente propuesta.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">SEGUNDO.</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">DESTINARLO un total de 15.000 € de la aplicación presupuestaria 23.148.004 para la presente convocatoria de subvenciones, correspondiente a la anualidad 2020.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">TERCER.</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">INSERTAR el presente acuerdo, así como el texto de la convocatoria en el Boletín Oficial de la Comunidad Autónoma, así como en la Base de datos Nacional de Subvenciones a efectos de su difusión y público conocimiento.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">CUARTO.</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>APROBAR </strong>los modelos normalizados de solicitud, declaración responsable, comunicación de perceptores y acreditación de cuenta bancaria que figuran en los anexos.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">A consecuencia de la emergencia de salud pública ocasionada por Covid-19, el Gobierno de España declaro el Estado de Alarma en todo el territorio nacional mediante el Real Decreto 463/2020, de 14 de marzo. El impacto social y económico que tuvo esta situación excepcional obliga a que las administraciones públicas, en el ámbito de sus competencias, adopten con la máxima celeridad aquellas medidas tendentes a paliar los efectos que está sufriendo nuestra sociedad.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Las medidas se deben adoptar para conseguir la máxima eficacia y eficiencia en la asignación de los recursos públicos y respetando, en todo caso, los principios de publicidad, transparencia, concurrencia, objetividad, igualdad y no discriminación.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Esta situación ha provocado una reducción en los ingresos de muchas personas de Puigpunyent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Por los motivos expuestos desde el Ayuntamiento de Puigpunyent se convocan subvenciones para la concesión de ayudas al alquiler de viviendas para personas empadronadas en el municipio y que tienen una vivienda alquilada en el término municipal de Puigpunyent de acuerdo con las siguientes:</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">BASES</span></span></span></strong></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">1. Sin embargo, las cuantías se pueden incrementar, si existe disponibilidad presupuestaria suficiente, mediante acuerdo de la Junta de Gobierno Local, de acuerdo con lo establecido en el artículo 58.2 del Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley General de Subvenciones.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3. Objeto y finalidad</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El Ayuntamiento de Puigpunyent, convoca la concesión de ayudas al alquiler de viviendas a personas arrendatarias de vivienda habitual, situadas en el término de Puigpunyent, que tengan problemas para hacer frente al pago del alquiler y siempre que la persona se encuentre en una de las circunstancias definidas en el apartado 5.1. de la convocatoria.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">4. Órgano competente para la concesión de las ayudas</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El órgano competente para la concesión de las ayudas al alquiler de viviendas es la Comisión Técnica formada por:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- Alcalde, o el Concejal o Concejala en quien delegue,</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- La Secretaria Interventora o funcionario en quien delegue.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- El Trabajador Social del Ayuntamiento de Puigpunyent, que actuará como instructor del procedimiento.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">5. Requisitos de los beneficiarios:</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">5.1. Podrán beneficiarse de las ayudas las personas físicas que, en su condición de arrendatarias de vivienda habitual, acrediten estar en situación de vulnerabilidad económica y social para concurrir una de las siguientes circunstancias:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">a) Estar en el paro.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b) Estar en situación de expediente de regulación temporal de empleo (ERTE).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">c) Estar afectado por una reducción de la jornada laboral por motivos de conciliación familiar, laboral o organizativos, siempre que tengan hijos menores de edad, personas dependientes y / o discapacitados a su cargo.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">d) Ser autónomo y haber sufrido una reducción de ingresos del 50% o que la actividad que realiza se encontrase suspendida durante el Estado de Alarma.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">5.2 Las personas beneficiarias deberán acreditar, además, que reúnen los siguientes requisitos:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">a.-La persona solicitante debe estar empadronada en el término municipal de Puigpunyent con anterioridad al 1 de enero de 2020.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b.- Que la persona solicitante sea titular, en calidad de arrendatario, de un contrato de arrendamiento de vivienda vigente, formalizado en los términos de la Ley 29/1994, de 24 de noviembre, de Arrendamientos Urbanos o con las posteriores actualizaciones de la normativa de la ley de arrendamientos urbanos.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">c.- Que la vivienda objeto del alquiler esté situado dentro del ámbito del territorial del municipio de Puigpunyent.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">d.- La vivienda arrendada debe constituir la residencia habitual y permanente de la persona o unidad de convivencia del solicitante de la ayuda. Se considerará unidad de convivencia la formada por el conjunto de personas que estén empadronadas en el término municipal de Puigpunyent en una misma vivienda, existan o no lazos familiares.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">e.- Que el importe de la renta de la vivienda objeto del contrato de alquiler sea igual o inferior a 1.000 euros mensuales.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">5.3. En todo caso, los beneficiarios no podrán acceder a las ayudas de esta convocatoria cuando:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- Cualquier miembro de la unidad de convivencia es titular de otra vivienda en el término municipal de Puigpunyent (o inmueble) o de su derecho de uso o disfrute (salvo excepciones muy concretas).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- Acrediten unos ingresos brutos anuales superiores a 39.000 euros.</span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">​​​​​​​</span></span></span></strong><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">6. Manera de acreditar los requisitos y documentación</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Junto con la solicitud de ayuda al alquiler, se presentará una declaración responsable relativa al cumplimiento de los requisitos exigidos y declaración responsable de veracidad de datos bancarios,</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">En el momento que el Ayuntamiento lo requiera, las personas solicitantes deberán aportar la siguiente documentación:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">a) En caso de situación legal de desempleo o en situación de expediente de regulación temporal de empleo (ERTE): certificado expedido por la entidad gestora de las prestaciones, en el que figure la cuantía mensual percibida en concepto de prestaciones o subsidios o que es solicitante de esta.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b) En caso de reducción de jornada laboral por motivos de conciliación familiar, laboral o organizativos: certificado de empresa.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">c) En caso de cese de actividad de trabajadores por cuenta propia / autónomo: certificado expedido por la Agencia Estatal de la Administración Tributaria en base a la declaración de cese de actividad declarada por el interesado.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">d) En el caso de reducción de ingresos de los autónomos del 50%: la última declaración trimestral.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">e) Número de personas que habitan en la vivienda habitual: certificado de convivencia.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">f) Contrato de alquiler vigente de la vivienda.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">g) Vida laboral actualizada.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">h) Justificantes y / o recibos del pago de las rentas mensuales del alquiler.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">i) Las personas asalariadas ocupadas, las nóminas percibidas en 2020 hasta la fecha de la solicitud.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">j) Las personas que trabajen por cuenta propia, las declaraciones trimestrales, hasta la fecha de la solicitud.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">La persona solicitante no está obligada a aportar la documentación establecida en las letras a) (si el expediente de regulación temporal de empleo (ERTE) no está autorizado, se encuentra en tramitación o pendiente de resolución deberá presentar carta de la empresa o certificado de la solicitud de ERTE), c) (excepto la presentación de la última declaración trimestral donde quede reflejada la reducción de los ingresos), d) ye).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">La solicitud de la ayuda implicará que la persona que realiza la solicitud autoriza al Ayuntamiento de Puigpunyent obtener la información necesaria para la gestión de las ayudas, salvo que manifieste expresamente su negativa, tal como se establece en el artículo 28.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">7. Ámbito temporal</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Esta ayuda se concede por un período máximo de seis (6) meses, incluyendo como primera mensualidad del alquiler, la correspondiente al mes de marzo hasta diciembre de 2020. La solicitud será revisable por parte de la Comisión Técnica, cada dos meses , para el control del cumplimiento de los requisitos establecidos en la convocatoria.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">También serán admitidas las solicitudes de ayuda por meses sueltos, si así se solicita, sin que sean necesariamente consecutivos, dentro del mismo período de seis meses.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">8. Forma y plazo de presentación de solicitudes</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Las solicitudes pueden presentarse a partir del día siguiente a la publicación de esta convocatoria en el BOIB, y hasta los 20 días naturales posteriores al de la publicación.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">1. De manera telemática a través del Registro Electrónico Común de la Administración General del Estado, en caso de disponer de certificado digital o DNIe.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">2. De manera presencial de lunes a viernes de 9 a 14 horas en el Registro General del Ayuntamiento de Puigpunyent, o en cualquiera de las formas previstas en la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. Tal como establece el artículo 45 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, al tratarse de un procedimiento de concurrencia competitiva los actos administrativos que se generan en la tramitación del mismo serán objeto de publicación, y la misma se llevará a cabo en el tablón de anuncios del Ayuntamiento de Puigpunyent, en la página web municipal y la Base de datos Nacional de Subvenciones.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">9. Cuantía de la ayuda</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Para un alquiler mensual de la vivienda de hasta un máximo de 1.000 €, la cuantía de la ayuda será de hasta un 40% del alquiler mensual.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Únicamente se proporcionará una ayuda para vivienda o por contrato de alquiler.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">En caso de que las solicitudes sean superiores a la cantidad disponible, las cuantías de las subvenciones se repartirán en proporción al número de estas.</span></span></span></p> <p>​​​​​​​<strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">​​​​​​​</span></span></span></strong><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">10. Obligaciones y responsabilidades de los beneficiarios</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Sin perjuicio de las obligaciones generales establecidas en el artículo 14 de la Ley 38/2003, las persona beneficiaria debe cumplir los siguientes requisitos:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">a) Domiciliar el pago de la ayuda a alguna entidad financiera o de crédito.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b) Destinar el importe de la subvención a la financiación de la actuación para la que se ha solicitado.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">c) Someterse a las actuaciones de comprobación y cualquier actuación de verificación y control financiero de los órganos competentes, y aportar toda la información que le sea requerida.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">11. Justificación de la ayuda concedida</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Las personas solicitantes de las ayudas deben aportar el recibo o recibos del alquiler correspondiente al mes o meses en los que se ha concedido la ayuda, acreditativo del pago del alquiler, como medio de justificación de la subvención concedida.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">La documentación justificativa de los pagos podrá presentarse telemáticamente a través del Registro Electrónico Común de la Administración General del Estado o de manera presencial en el Registro del Ayuntamiento de Puigpunyent. Para ello se dispone de un plazo de 2 meses a contar desde la resolución de la concesión de la ayuda.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">12. Compatibilidad de la ayuda con otras subvenciones de alquiler</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Es compatible con la ayuda estatal del Real Decreto Ley 11/2020, de 31 de marzo, por el que se adoptan medidas urgentes complementarias en el ámbito social y económico para hacer frente al Covid-19.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Las ayudas reguladas en estas bases son incompatibles con otras ayudas al alquiler para arrendatarios con recursos económicos escasos que concede el Ayuntamiento de Puigpunyent o cualquier otra administración o entidad pública, para las mismas mensualidades del mismo año. No se consideran afectados por esta incompatibilidad los supuestos excepcionales en que los Servicios Sociales del Ayuntamiento de Puigpunyent aportan un complemento para el pago del alquiler a beneficiarios en situaciones de vulnerabilidad especial.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">13. Control y reintegro</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El Ayuntamiento de Puigpunyent podrá comprobar, por los medios que estime más adecuados, el cumplimiento de las obligaciones inherentes al otorgamiento de las ayudas. El incumplimiento de estas obligaciones o la comprobación de la falsedad de los datos aportados y en particular el supuesto de falsedad de las declaraciones responsables presentadas, dará lugar a la posible calificación de los hechos como infracción administrativa y, en caso de que pueda ser constitutivo de un delito de falsedad pública de actuaciones al orden jurisdiccional, lo que supondrá la inmediata devolución de las ayudas concedidas.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">14. Protección de datos</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">La solicitud de ayuda al alquiler implica que la persona interesada autoriza a la Administración para el tratamiento de los datos de carácter personal para la gestión de las ayudas, de conformidad con lo dispuesto en la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales, y normas de desarrollo. En concreto los datos de carácter personal se incorporan al fichero "Historia Social Integral" del que es responsable la Unidad de Trabajo Social del Ayuntamiento de Puigpunyent.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">15. Plazo de resolución y notificación</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El plazo máximo para resolver y notificar la resolución de concesión es de un (1) mes a contar desde la fecha de presentación de la solicitud de la ayuda. Transcurrido este plazo sin que se haya dictado y notificado resolución expresa, se producirá el silencio administrativo y la solicitud podrá entenderse desestimada.</span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">16.
