&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Asunto: cese Sr. Miquel Lluís Mestre y Sra. Isabel Montero Morán como miembros Junta de Gobierno Local y pérdida de la condición de tenientes de alcalde.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A la Muy Leal Ciudad de Felanitx, el alcalde que suscribe, Sr. Jaume Monserrat Vaquer, vengo a dictar la siguiente resolución en conformidad con los siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Antecedentes de hecho&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Mediante Decreto de alcaldía número 2019-0652, de 20 de junio de 2019, se acordó, entre otros, la composición de la Junta de Gobierno Local, de acuerdo se transcribe a continuación:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«&lt;strong&gt;Primero.&lt;/strong&gt; La Junta de Gobierno Local estará formada por mí mismo como presidente, y por los regidores siguientes, que no superan el tercio del número legal de los miembros que componen la corporación:&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Sr. Miquel Lluís Mestre Mestre&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Sr. Francisco Duarte Barceló&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Sra. Maria Gracia González López&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Sra. Isabel Montero Morán&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Sr. Juan Aznar Hernández&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Mediante la resolución anterior, también se acordó, entre otros, el nombramiento de los tenientes de alcalde, de acuerdo se transcribe a continuación:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«...&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Para la sustitución de la Alcaldía en los casos de vacante, ausencia o enfermedad, nombro como tenientes de alcalde a los siguientes regidores y por el siguiente orden:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Primer teniente de alcalde: Sr. Miquel Lluís Mestre Mestre&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Segundo teniente de alcalde:Sr. Francisco Duarte Barceló&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tercer teniente de alcalde:Sra. Maria Gracia González López&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuarta teniente de alcalde:Sra. Isabel Montero Morán&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Quinto teniente de alcalde:Sr. Juan Aznar Hernández&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Mediante la resolución de referencia, también se acordó, entre otros, delegar competencias de alcaldía a favor de regidores, tal como se transcribe a continuación:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«...&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarto&lt;/strong&gt;. Delegar a favor de los regidores que a continuación se detallan, las&amp;nbsp; siguientes competencias:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Sr. Francisco Duarte Barceló: cultura, patrimonio, ferias y mercados, mercado municipal, comunicación y transparencia, actividades.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Sra. Maria Gracia González López : urbanismo, salud y bienestar.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Sr. Juan Aznar Hernández: deportes, infraestructuras y mantenimiento (brigada municipal, espacios públicos, edificios municipales, parque municipal y cementerio), formación y ocupación (programas SOIB y Felanitx Emplean).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Sra. Damiana Massutí Gómez: fiestas y juventud.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Isabel Montero Morán: asuntos sociales (infancia, adolescencia, gente mayor), educación.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Miquel Lluís Mestre Mestre: medio ambiente (limpieza y residuos, agua, alcantarillado, alumbrado, bienestar animal, sostenibilidad y ecología).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Maria Mesquida Artigues : archivos, bibliotecas, política lingüística, participación ciudadana, igualdad (área de la mujer, mediación cultural, género y orientación sexual).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Melania Mesquida Tran : promoción económica (turismo, comercio e industria), seguridad ciudadana (policía, protección civil, movilidad y circulación), representando del alcalde a Portocolom.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;...»&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt; &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt; &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Mediante Decreto de alcaldía n.º 2020-0776 se acordó, entre otros:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;« &lt;strong&gt;Primero.&lt;/strong&gt; Cesar los regidores Sr. Francisco Duarte Barceló y Sra. Maria Gracia González López como miembros de la Junta de Gobierno Local, que fueron nombrados como tal mediante decreto de alcaldía n.º 2019-0652, de 20 de junio de 2019. De acuerdo con el artículo 46.3 del ROF, el Sr. Francisco Duarte Barceló y la Sra. Maria Gracia González López pierden la condición de Teniente de Alcalde.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Revocar la delegación de competencias efectuada por decreto de alcaldía n.º 2019-0652, de 20 de junio de 2019 a los regidores Sr. Francisco Duarte Barceló, Sra. Maria Gracia González López y Sra. Damiana Massutí Gómez.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;...»&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt; &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt; &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El Sr. Miquel Lluís Mestre ha presentado escrito (NRGE E-RC-3810, fecha 29/09/2020) donde manifiesta que renuncia a las delegaciones de alcaldía que le fueron asignadas, toda vez que se necesita conformar un nuevo Equipo de Gobierno en el Ayuntamiento de Felanitx.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La Sra. Isabel Montero Morán ha presentado un escrito (NRGE E-RC-3812, fecha 29/09/2020) donde manifiesta que renuncia a las delegaciones de alcaldía así como a la dedicación y las retribuciones que le fueron asignadas, toda vez que se necesita conformar un nuevo Equipo de Gobierno en el Ayuntamiento de Felanitx.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. La Sra. Maria Mesquida Artigues ha presentado un escrito (NRGE E-RC-3813, fecha 29/09/2020) donde manifiesta que renuncia a las delegaciones de alcaldía así como la dedicación y las retribuciones que le fueron asignadas, toda vez que se necesita conformar un nuevo Equipo de Gobierno en el Ayuntamiento de Felanitx.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I. En cuanto a la composición de la Junta de Gobierno Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Junta de Gobierno Local estará integrada por el alcalde y, en el caso de Felanitx, un máximo de 5 regidores, de acuerdo con el art. 52.2 del Real Decreto 2568/1986, de 28 de noviembre, que aprueba el Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales (en adelante, ROF), nombrados libremente por el alcalde.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En atención en el artículo 52.3 del ROF, el alcalde puede cesar libremente, en todo momento, a cualquier miembro de la Junta de Gobierno Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los nombramientos y ceses se harán mediante resolución del alcalde de la que se dará cuenta al Pleno en la primera sesión que celebre, y se notificará, y se publicará en el Boletín Oficial de la Comunidad Autónoma (BOIB), sin perjuicio de su efectividad desde el día siguiente de la firma de la resolución por el alcalde, si en esta no se dispone otro cosa, de acuerdo con el artículo 52.4 y 46.1 del ROF.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;II. En cuanto a los Tenientes de Alcalde.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los tenientes de alcalde son de existencia obligatoria en todos los municipios, en atención al art. 20.1 a) Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local (en adelante, LBRL), y el art. 22 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares (en adelante, LMRLIB). Corresponde a los tenientes de alcalde, por su condición, sustituir en la totalidad de sus funciones y por la orden de su nombramiento el alcalde, en los casos de ausencia, enfermedad o impedimento, tal como dispone el arte. 47.1 del ROF.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son libremente nombrados y cesados por el alcalde de entre los miembros de la Junta de Gobierno Local, cuando esta exista. Y los nombramientos y ceses se harán mediante resolución del alcalde, de la que se dará cuenta al Pleno en la primera sesión que se celebre, se notificará , y se publicará en el BOIB, sin perjuicio de su efectividad desde el día siguiente de la firma de la resolución por el alcalde, de acuerdo con el arte. 46.1 del ROF.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La condición de Teniente de Alcalde se pierde: por el cese, por renuncia exprés manifestada por escrito, y por pérdida de la condición de miembro de la Junta de Gobierno Local, en atención en el artículo 46.3 del ROF.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;III. En cuanto a las delegaciones a los regidores.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con el artículo 120.2.b) del ROF, se pierde la condición de Regidor-Delegado, entre otros, por renuncia expresa, por revocación de la delegación adoptada por la alcaldía, y por pérdida de la condición de miembro de la Junta de Gobierno Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con lo expuesto, RESUELVO:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; Cesar los regidores Sr. Miquel Lluís Mestre y Sra. Isabel Montero Morán, como miembros de la Junta de Gobierno Local, que fueron nombrados como tal mediante decreto de alcaldía n.º 2019-0652, de 20 de junio de 2019. De acuerdo con el artículo 46.3 del ROF, el Sr. Miquel Lluís Mestre, y la Sra. Isabel Montero Morán pierden la condición de Teniente de Alcalde.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Nombrar la Sra. Melania Mesquida Tran miembro de la Junta de Gobierno Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Así, la Junta de Gobierno Local estará formada por mí mismo como presidente, y por los regidores siguientes, que no superan el tercio del número legal de los miembros que componen la corporación:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Sr. Juan Aznar Hernández&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Sra. Melania Mesquida Tran&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; Nombrar la Sra. Melania Mesquida Tran teniente de alcalde.&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt; &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt; &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Así, para la sustitución de la alcaldía en los casos de vacante, ausencia o enfermedad, nombro tenientes de alcalde los siguientes regidores y por el siguiente orden:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Primer teniente de alcalde: Sr. Juan Aznar Hernández&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Segon teniente de alcalde: Sra. Melania Mesquida Tran&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarto.&lt;/strong&gt; Se mantiene en vigor el Decreto n.º 2019-0652, de 20 de junio de 2019, y el Decreto n.º 2020-0776, de 25 de septiembre de 2020, así como también los Decretos n.º 2019-0686 de 1 de julio de 2019 y n.º 2019-1115 de 24 de octubre de 2019,en todo el que no se contradigan con la presente resolución.&lt;/span&gt;&lt;/p&gt;
