Objetivos.</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Los objetivos del presente reglamento son:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">1. Definir los aspectos generales relacionados con el uso de la desechería y fomentar su utilización y buen funcionamiento.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">2. Fomentar la reducción, reutilización y el reciclaje del máximo porcentaje de los residuos domésticos.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">3. Alcanzar los máximos niveles de calidad en las fracciones depositadas, reduciendo al mínimo la presencia de materiales impropios.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">4. Prevenir los vertidos incontrolados en zonas rurales.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">5. Mejorar la gestión de los residuos urbanos, en cumplimiento y en adaptación a lo establecido en la Ley 8/2019, de 19 de febrero, de residuos y suelos contaminados de las Islas Baleares.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 3. Definiciones.</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">A los efectos de este reglamento, se entiende por:</span></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Residuos domésticos: los residuos generados en el hogar como consecuencia de las actividades domésticas. Se consideran también residuos domésticos los similares a los anteriores generados en servicios e industrias.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Residuo: cualquier sustancia u objeto que su poseedor rechace o tenga la intención o la obligación de rechazar.</span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Se incluyen también en esta categoría los residuos que se generan en los hogares provenientes de aparatos eléctricos y electrónicos, ropa, pilas, acumuladores, muebles y enseres, así como los residuos y los escombros procedentes de obras menores de la construcción y la reparación domiciliaria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Tienen la consideración de residuos domésticos los residuos procedentes de la limpieza de la vía pública, zonas verdes, áreas recreativas y playas, los animales domésticos muertos y los vehículos abandonados.</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Residuos comerciales: los residuos generados por la actividad propia de los comercios, al por mayor y al por menor, los servicios de hostelería, restauración, catering, bares y cafeterías (HORECA), de oficinas y mercados, así como del resto del sector de los servicios.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Residuos industriales: los residuos resultantes de procesos de fabricación, de transformación, de utilización, de consumo, de limpieza o de mantenimiento generados por la actividad industrial, excluidas las emisiones a la atmósfera reguladas por la normativa específica.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Residuos peligrosos: los residuos que presentan una o varias de las características de peligrosidad incluidas en el anexo III de la Ley 22/2011, de 28 de julio, de residuos y suelos contaminados, así como los que pueda incluir el Gobierno del Estado, de conformidad con lo establecido en la normativa europea o en convenios internacionales de los que España sea parte, así como los recipientes y los envases que los hayan contenido.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Residuos impropios: los residuos que, como consecuencia de una separación incorrecta, no corresponden a la fracción de residuos en la que han sido incorporados.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Generador singular: los productores o poseedores de residuos de origen comercial o industrial, pero equiparables a los domésticos, y que cumplen los criterios fijados en las ordenanzas municipales a los efectos de su gestión.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Poseedor de residuos: el productor de residuos u otra persona física o jurídica que esté en posesión de residuos.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Área de aportación: área de recogida de diferentes fracciones de residuos domésticos no peligrosos, de competencia y bajo vigilancia municipal, más amplia que los contenedores en acera, con superficie protegida y cierre perimetral, pero sin consideración de instalación de almacenamiento y preclasificación, como las desecherías. Tendrá una superficie máxima de 50 metros cuadrados, en ningún caso sustituirá la obligación de disponer de un centro de recogida municipal como prevé esta ley y no permitirá la recogida de residuos de aparatos eléctricos y electrónicos.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Desechería: instalación de recepción, almacenamiento selectivo y preclasificación de productos usados ​​destinados a la reutilización, así como de residuos municipales en espera de tratamientos posteriores, como la preparación para la reutilización, la valorización y la eliminación.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Productor de residuos: cualquier persona física o jurídica cuya actividad produzca residuos (productor inicial de residuos) o cualquier persona que efectúe operaciones de tratamiento previo, de mezcla o de otro tipo, que ocasionen un cambio de naturaleza o de composición de estos residuos.</span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Para el resto de definiciones, se estará a lo dispuesto en la legislación básica estatal en materia de residuos y, en su caso, la legislación comunitaria.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 4. Competencias municipales</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">De acuerdo con lo establecido en el artículo 11 de la Ley 8/2019, de residuos y suelos contaminados y de acuerdo con el principio de quien contamina paga, los costes relativos a la gestión de los residuos deben de ir a cargo del productor inicial de residuos, del poseedor actual o del poseedor anterior de residuos, de acuerdo con lo establecido en los artículos 42 y 45.2. 2. 1. de la Ley 8/2019, de 19 de febrero, de residuos y suelos contaminados de las Islas Baleares. Las normas que regulen la responsabilidad ampliada del productor para flujos de residuos determinados establecerán los supuestos en los que los costes relativos a su gestión deben ser sufragados, parcial o totalmente, por el productor del producto del que proceden los residuos y cuando los distribuidores del producto pueden compartir los costes mencionados.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Se entiende como servicio obligatorio, la recogida, el transporte y el tratamiento de los residuos domésticos generados en las casas, los comercios y los servicios de la manera en que establezcan las ordenanzas respectivas en el marco jurídico de lo que establece la Ley, de las que, en su caso, dicten las comunidades autónomas y de la normativa sectorial en materia de responsabilidad ampliada del productor. La prestación de este servicio corresponde a los municipios que la pueden llevar a cabo de forma independiente o asociada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Corresponde al Ayuntamiento gestionar los residuos comerciales no peligrosos y los residuos domésticos generados en las industrias en los términos que establezcan las ordenanzas respectivas, sin perjuicio de que los productores de estos residuos los puedan gestionar por sí mismos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">La entidad local establece su propio sistema de gestión, y por tanto puede imponer, de manera motivada y basándose en criterios de mayor eficiencia y eficacia en la gestión de los residuos, la incorporación obligatoria de los productores de residuos a este sistema en determinados supuestos.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 5. Competencias específicas</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">1. Responsabilizarse de la adecuación de la instalación y de la gestión de los residuos que se depositen, aportando los recursos materiales y humanos necesarios al efecto.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">2. Cumplir y hacer cumplir las condiciones mínimas de funcionamiento, de seguridad y prevención en el centro de recogida.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">3. Realizar la gestión de los residuos conforme a la normativa específica aplicable, atendiendo a los sistemas y tratamientos previstos en los correspondientes a las normativas vigentes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">4. Los residuos recogidos son propiedad del Ayuntamiento. Los objetos de valor que se puedan encontrar deben ser depositados en el Ayuntamiento.</span></span></p> <p> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">TÍTULO II</span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">USO Y GESTIÓN</span></span></strong></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 6. Usuarios</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">La desechería municipal de sa Pobla es una instalación diseñada especialmente para la recogida de residuos domésticos, aunque en determinadas condiciones se aceptarán residuos provenientes de actividades económicas. En este sentido se considerarán las siguientes tipologías de usuarios:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Los servicios municipales</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Usuarios particulares: Las personas residentes en el municipio que dispongan de tarjeta identificativa.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Usuarios profesionales o generador singular: usuarios generadores de residuos procedentes de actividades económicas, industriales o comerciales: comercios, oficinas, talleres, industrias, actividades agrícolas y otras empresas de servicios.</span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Los usuarios profesionales podrán aportar los residuos en función de las especificaciones del Ayuntamiento. En líneas generales serán aquellos que no suponen un gasto para el Ayuntamiento en cualquiera de los conceptos de almacenamiento, transporte o tratamiento; como por ejemplo RAEE, chatarra, vidrio, papel, envases, etc.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">En cambio los usuarios profesionales no podrán dejar residuos que supongan un gasto superior a los ingresos previstos por la tasa. En estos casos los productores de residuos los deberán llevar directamente a las plantas de tratamiento o bien contratar un gestor de residuos autorizado.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 7. Residuos admitidos</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">El listado de residuos aceptados puede sufrir variaciones en función de las posibilidades de gestión del Ayuntamiento. Si se han almacenado residuos durante un tiempo o bien se quiere aportar una gran cantidad de material para renovación de mobiliario o mudanza, es obligatorio contratar los servicios de un gestor de residuos.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 10. Limitaciones de acceso (tarjeta, peso máximo, horarios)</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Para entrar en el centro de recogida se debe disponer de la tarjeta de usuario, identificador o código de usuario, que se puede obtener en las oficinas municipales. Es obligatorio mostrarlo al operario para realizar la comprobación y registro antes de realizar ningún tipo de depósito. La tarjeta o código es propio de cada usuario abonado a la tasa de residuos, no se puede ceder a personas de una referencia diferente.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Se deberán respetar los límites permitidos en cada momento una vez hecha la comprobación.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">El acceso al centro de recogida estará limitado a los vehículos, turismos y furgonetas con un máximo de peso autorizado de 3.500 Kg. De esta limitación quedan excluidos los camiones de transporte de los contenedores y otros vehículos autorizados por el Ayuntamiento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Los horarios de la de recogida serán variables en función de la evolución de la afluencia de visitantes. font-size:12px"><span style="line-height:1">Estas cuantías podrán verse modificadas en función de la disponibilidad de espacio dentro de los contenedores y las cajas. Así en caso de que el operario lo considere puede prohibir la entrada de cualquier residuo por este motivo.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 12. Extracción y manipulación de materiales para la reutilización</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Los usuarios particulares podrán extraer materiales del centro de recogida para uso propio. Los usuarios tendrán la obligación de devolverlos a la instalación una vez se les haya acabado su vida útil.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">En ningún caso se pueden sacar residuos peligrosos ni residuos de aparatos eléctricos y electrónicos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">En ningún caso se puede sacar ningún tipo de residuo de los compactadores.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Los usuarios no podrán extraer residuos del vertedero sin previa autorización del Ayuntamiento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">No está permitido manipular, desguazar o transformar residuos de recogida.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 13. Otras consideraciones hacia los usuarios</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Las visitas al centro de recogida se harán con cuidado y bajo la responsabilidad de los usuarios, quedando totalmente liberado del Ayuntamiento de sa Pobla de cualquier responsabilidad que pudiera derivarse de una manipulación indebida de los residuos al ser trasladados y vertidos por los usuarios, de una maniobra indebida del conductor del vehículo, etc.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">En todo caso, los usuarios deben respetar en todo momento las normas e indicaciones de circulación dentro de la desechería, la limitación de la velocidad, sentido de rotación de los vehículos, lugar de parada, etc., y respetar y obedecer en todo momento las indicaciones que les hagan los operarios del Ayuntamiento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">En caso de encontrar o dejar los contenedores llenos se debe avisar a los operarios.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">No se permite abrir o cerrar contenedores o accionar los sistemas de compactación de los compactadores.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Está totalmente prohibido fumar dentro del recinto.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 14. Sistema de vigilancia y acompañamiento</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">El centro de recogida cuenta con varios sistemas de control de los usuarios.</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Cámaras de videovigilancia: Tanto el centro de recogida como su perímetro estará vigilado con cámaras para detectar los posibles infractores de las normas que recoge este reglamento.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Operario. Las tareas a realizar por parte del personal del centro de recogida son las siguientes:</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Apertura y cierre de las instalaciones.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Gestión y control de las actividades que se llevan a cabo en el interior.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Desarrollo de las tareas administrativas asociadas a la instalación.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Registro de entradas y salidas de las instalaciones.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Control y coordinación en las tareas de retirada de los residuos por los gestores.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Atender a los ciudadanos y resolver sus dudas en cuanto a la separación de los residuos en base a las directivas técnicas del Ayuntamiento.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Acompañar a los ciudadanos en el depósito de los residuos según las tipologías de contenedores u otras separaciones establecidas en el recinto.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Anotar las incidencias y dudas sin resolver y comentarlas con el personal técnico del Ayuntamiento.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Velar para que la recogida esté ordenada y limpia.</span></span></p> </li> </ul> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Artículo 15. Operaciones de transporte de los residuos.</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">El transporte de los residuos será realizado por gestores autorizados.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">El personal del centro de recogida deberá planificar y coordinar los plazos para el vaciado de contenedores y operaciones de retirada de los residuos recogidos, a fin de mantener las instalaciones y equipamientos en todas las condiciones aptas para su buen funcionamiento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Las empresas gestoras deberán responder con presteza y en base a las cláusulas que marquen sus contratos para no mantener los contenedores saturados.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">Las empresas transportistas deberán entregar los albaranes en el operario del centro de recogida y entregar mensualmente por correo electrónico en el Ayuntamiento y en formato compatible y modificable un informe con los transportes hechos donde constará:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">1. Matrícula del camión</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1">2.
