Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 12 de abril de 2019 (BOIB núm. 48/2019, de 13 de abril) se convocó un concurso-oposición para cubrir plazas vacantes de la categoría de facultativo/facultativa especialista de área de cirugía pediátrica, entre otras especialidades. Esta resolución fue modificada por otras dos: la de fecha de 2 de julio de 2020 (BOIB núm. 119/2020, de 7 de julio) y la de fecha de 22 de julio de 2020 (BOIB núm. 132/2020, de 28 de julio).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. La base 4.1 de la convocatoria establece que una vez finalizado el plazo para presentar solicitudes, el director general del Servicio de Salud de las Islas Baleares dictará una resolución para aprobar las listas provisionales de personas aspirantes admitidas y excluidas del proceso selectivo, que se publicará en el Boletín Oficial de las Islas Baleares y en el portal web </span>www.ibsalut.es<span style="font-family:&quot;Times New Roman&quot;,Times,serif">.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. Asimismo, la base 5.2 de la convocatoria establece que las personas que integran el Tribunal calificador han de ser designadas por el director general del Servicio de Salud de las Islas Baleares a través de una resolución que se ha de publicar en el Boletín Oficial de las Islas Baleares con una antelación de, por lo menos, un mes antes de la fecha del examen.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4.- Por su parte, la base 7.2 señala que, siempre que sea posible, en la resolución en la cual se publiquen las listas provisionales de personas admitidas y excluidas se fijarán la fecha, la hora y el lugar en el cual se realizará la prueba.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><strong>Resolución</strong></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Aprobar las listas provisionales de personas aspirantes admitidas y excluidas en el concurso oposición para cubrir plazas vacantes de la categoría de facultativo/facultativa especialista de área de cirugía pediátrica dependientes del Servicio de Salud, convocado mediante las resoluciones del director general del Servicio de Salud de las Islas Baleares que se señalan en el punto 1 del apartado “Hechos” y que figuran en el Anexo 1 de esta resolución. En la lista provisional de personas admitidas figuran el nombre, los apellidos y el documento de identidad. En la lista provisional de personas excluidas figura también la causa de exclusión.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Establecer que, con la finalidad de evitar errores y, si se producen, posibilitar que se corrijan en el plazo y en la forma procedente, las personas aspirantes deben comprobar no sólo que no figuran en la lista de personas excluidas sino que, además, han de confirmar que figuran en la de personas admitidas. </span></p> </li> </ol> <ol start="3"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Disponer que, tal y como figura en las bases de la convocatoria, las personas aspirantes disponen de un plazo de diez días hábiles a contar desde el día siguiente de la publicación de esta resolución para presentar reclamaciones,&nbsp; que no tendrán carácter de recurso, o para subsanar el defecto que haya motivado la exclusión. Las reclamaciones que se presenten deben entenderse rechazadas cuando las personas que las hayan presentado no aparezcan como admitidas en la resolución en la que se publiquen las listas definitivas. Las personas que no subsanen los defectos en el plazo establecido serán excluidas del proceso selectivo. Asimismo, las que hayan detectado errores en la consignación de sus datos personales pueden manifestarlo en este mismo plazo.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Determinar que la persona que figure en la lista provisional de personas excluidas para el turno de promoción interna —independientemente de su derecho a subsanar defectos o a presentar reclamaciones contra la exclusión— puede pagar la tasa del turno de acceso libre dentro del plazo de diez días hábiles a contar desde la publicación de esta resolución. Si finalmente es incluida en las listas definitivas de personas candidatas admitidas en el turno de promoción interna, tendrá derecho a solicitar la devolución de la tasa del turno de acceso libre, de acuerdo con lo que dispone la base 4.7 de la convocatoria. Si ha sido excluida de la lista definitiva del turno de promoción interna, será incluida de oficio en la lista definitiva de personas admitidas por el turno de acceso libre y podrá solicitar la devolución de la tasa del turno de promoción interna.</span></p> </li> </ol> <ol start="5"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resolver que las personas que figuran como excluidas de la reserva para personas con discapacidad, independientemente de su derecho a subsanar defectos o a presentar reclamaciones contra la exclusión, pueden pagar la tasa del turno correspondiente dentro del plazo de diez días hábiles a contar desde la fecha de la publicación de esta resolución. Si finalmente son incluidas en las listas definitivas de personas candidatas admitidas en la reserva para personas con discapacidad, tendrán derecho a solicitar que se les devuelva la tasa abonada, de acuerdo con lo que dispone la base 4.7 de la convocatoria.
