    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para Inversiones en las explotaciones agrarias, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 25 de setiembre&amp;nbsp;de 2020, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“INFORME / PROPUESTA/RESOLUCIÓN&amp;nbsp;DE PRÓRROGA DEL PLAZO PARA LA JUSTIFICACIÓN DE LA INVERSIÓN SUBVENCIONABLE&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.El 12 de agosto de 2019, el vicepresidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) dictó Resolución de concesión (R28) de ayudas para inversiones en las explotaciones agrarias, publicada en el Boletín Oficial de las Islas Baleares núm. 115, de 22 de agosto de 2019, en relación con la ayuda concedida al amparo de la Resolución del Presidente del FOGAIBA de 10 de julio de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resolución de 17 de diciembre de 2015, 22 de junio de 2016 y 26 de junio de 2018. Entre otros beneficiarios hay AGRÍCOLA DALMAU SLU, con CIF B07892706, y núm. de expediente INEA2016_2 / 060, con un plazo de ejecución de 12 meses.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. El 28 de noviembre de 2019, RAFEL DALMAU MAIMÓ, con NIF *** 9135 **, en representación de AGRÍCOLA DALMAU SLU, presentó una solicitud de prórroga del plazo de ejecución (RGE L95E23955) en la Delegación Comarcal de Felanitx, alegando que tenía solicitado el proyecto de aguas subterráneas y estaba pendiente de obtener los permisos correspondientes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Se le concedieron 6 meses más, con plazo al 22 de febrero de 2021, que con los días adicionales para el estado de alarma por la Covidien-19 es el 15 de marzo de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;El 30 de julio de 2020, presenta una nueva solicitud de prórroga del plazo de ejecución (RGE L95E18146) en la Delegación comarcal de Felanitx, alegando que el sondeo del pozo, así como, las inversiones de la instalación de bombeo y electrificación se verán retrasadas por motivos de permisos de la administración, debido al hecho de que hasta el 5 de febrero de 2020 no recibió la autorización correspondiente del sondeo del pozo y posteriormente solicitar la licencia al ayuntamiento para la electrificación de la parcela.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. El apartado duodécimo, justificación y pago de las ayudas, de la Resolución del Presidente del FOGAIBA de 10 de julio de 2015, establece que el plazo máximo para la notificación y la justificación de la realización de la inversión propuesta es de 12 meses para las inversiones inmuebles y de 6 meses para las inversiones muebles, a contar desde el día siguiente a la fecha de notificación de la resolución de concesión de la ayuda. Por razones justificadas de demora en la concesión de licencias por parte de los ayuntamientos, bajas laborales e incidencias graves que no sean imputables al solicitante, los beneficiarios podrán solicitar la ampliación del plazo de realización y justificación establecido en la resolución de concesión . Esta solicitud de ampliación se presentará durante el plazo de ejecución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. La concesión de la ayuda se notificó el 22 de agosto de 2019, por tanto el plazo máximo para la justificación de la inversión propuesta acababa el 22 de agosto de 2020 (12 meses). Se concedió una prórroga de 6 meses con plazo hasta el 22 de febrero de 2.021 más los días adicionales para el estado de alarma por la Covidien-19, el plazo es hasta el 15 de marzo de 2021. El interesado AGRÍCOLA DALMAU SLU mediante su representante rafel dalmau Maimó, presentó la solicitud de prórroga el día 30 de julio de 2020, y por tanto dentro de plazo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. De acuerdo con el apartado 2 del artículo 20 de la Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020, regula que, con carácter excepcional y por razones debidamente justificadas, los beneficiarios de las ayudas podrán solicitar la ampliación o reapertura de los plazos establecidos en la respectiva convocatoria, con excepción del plazo de presentación de solicitudes. Esta solicitud debe presentarse antes del vencimiento del plazo de que se trate.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;El FOGAIBA podrá acordar la ampliación solicitada siempre que con ello no se perjudiquen derechos de terceras personas. El acuerdo de ampliación se notificará individualmente al interesado y no es susceptible de recurso.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Dado el Decreto 64/2005, de 10 de junio, de creación del FOGAIBA; en virtud de la Orden de la Consejera de Agricultura y Pesca de 23 de diciembre de 2005 se dispone que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Dado&amp;nbsp;que la solicitud de la prórroga se ha presentado antes del vencimiento del plazo de justificación de la realización de la inversión y está debidamente motivada, se concederá la prórroga solicitada por un plazo de 6 meses más los días adicionales para el estado de alarma por la Covid-19, de acuerdo con el artículo 32.3 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;concesión de prórroga&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo lo expuesto anteriormente, se informa favorablemente la concesión de prórroga y propongo al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1. Conceder la prórroga por 6 meses a “AGRÍCOLA DALMAU S.L.U.”&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;B07892706&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, expediente número INEA2016_1/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;060&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;. Por tanto, el plazo máximo para la justificación de la inversión aprobada será de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;24&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;meses,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;desde el &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;22&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;agosto&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 201&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;hasta el &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;15&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;setiembre&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Notificar esta resolución a&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a persona &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;interesad&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Este&amp;nbsp;resolución&amp;nbsp;no es susceptible de recurso.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
