text/html 2020-09-24 es 32388 639205 es 2020-09-26 2020-09-26 CAIB ![CDATA[Resolución de 2 de septiembre de 2020 del presidente del Instituto Mallorquín de Asuntos Sociales (IMAS) de rectificación de error material de la resolución de la Presidencia del Instituto Mallorquín de Asuntos Sociales (IMAS) de 27 de diciembre de 2019, relativa a la aprobación del otorgamiento y denegación de las ayudas económicas individuales a personas con discapacidad del Instituto para el año 2018.]] 32387 CAIB 8887 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#ff0000"><span style="color:#000000"><strong>Antecedentes</strong></span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. <span style="color:#000000">En fecha 27 de diciembre de 2019 el presidente del Instituto Mallorquín de Asuntos Sociales (IMAS) aprobó el otorgamiento y denegación de las ayudas económicas individuales a personas con discapacidades del IMAS para el año 2019, (BOIB nº 26, de 29 de febrero de 2020).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. Sin embargo, se ha advertido en la resolución mencionada por parte del equipo técnico de la sección de Recursos Sociolaborales un error material, dado que en los anexos que se refieren a otorgados y denegados no coincide con el informe propuesta emitido por el órgano instructor de esta convocatoria de 17 de diciembre de 2019, basado en el informe técnico y acta de la Comisión evaluadora de 3 de diciembre de 2019.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. Por este motivo, el 8 de abril de 2020 entró en el Servicio Jurídico del IMAS, un informe propuesta de la Dirección insular de personas con discapacidades, solicitando la revisión de oficio para la rectificación del error material del usuario IZAN PEREZ VILLANUEVA con DNI núm. 49866227L (exp-451D / 2018).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">4. La rectificación de errores materiales se regula en el art. 109.2 de la Ley 39/2015, de 1 de octubre, de régimen jurídico del procedimiento administrativo común de las administraciones públicas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. El órgano competente para resolver es la Presidencia del IMAS en virtud del artículo 7.2. apartado 7 de los Estatutos del IMAS (BOIB núm. 67 de 18 de mayo de 2019), y dado el Decreto de la Presidencia del Consell Insular de Mallorca por el que se nombra al consejero ejecutivo de Derechos Sociales (BOIB núm. 92 de 9 de julio de 2019), el cual de acuerdo con el artículo 7.1 de los Estatutos del IMAS, ejercerá también el cargo de presidente del IMAS.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por acuerdo del Pleno del Conse</span><span style="color:#000000">ll</span><span style="color:#000000"> de Mallorca de día 11 de abril de 2019 (BOIB núm . 67 de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Conse</span><span style="color:#000000">ll</span><span style="color:#000000"> Insular de Mallorca, en el plazo de un mes, contado a partir del día siguiente al de la notificación de la presente resolución.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación del mencionado recurso.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
