BDNS: 499065</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El consejero ejecutivo del Departamento de Promoción Económica y Desarrollo Local, en fecha de 11 de septiembre de 2020, ha dictado la siguiente:</span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">«Resolución de rectificación de error material de la resolución de concesión de subvenciones de la convocatoria de subvenciones para llevar a cabo actividades o proyectos de participación ciudadana y apoyo a la acción voluntaria para el año 2020</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 26 de agosto de 2020, el consejero ejecutivo del Departamento de Promoción Económica y Desarrollo Local dictó resolución de concesión de la convocatoria de subvenciones para llevar a cabo actividades o proyectos de participación ciudadana y apoyo a la acción voluntaria para el año 2020.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;En el apartado primero de la parte dispositiva de la resolución, “aprobar y conceder la subvención”, se detallaban las cuantías concedidas a cada entidad beneficiaria, según las líneas de subvención diferenciadas por objeto y por destinatario que establecía la convocatoria.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En la línea 1, destinada a proyectos de participación de entidades de administración local, por un error material, a las entidades locales de Santa Eugènia, Algaida y Palmanyola, que habían solicitado una cuantía menor a la cuantía máxima a que tenían derecho, se transcribió la cuantía máxima establecida a la convocatoria y no la cuantía realmente concedida.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante, teniendo en cuenta que la cuantía global solicitada es menor en la prevista inicialmente para esta línea de subvención, el error no afecta a las otras entidades locales beneficiarias.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con el informe de la técnica jurídica de 9 de septiembre de 2020.</span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos<span style="display:none">&lt;A[Fundamentos|Cimientos]&gt;</span> de derecho</strong></span></p> <ol style="list-style-type:upper-roman"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. (BOE nº. 236, de 02/10/2015)&nbsp;Art. 109.2 «Las administraciones públicas podrán, asimismo, rectificar en cualquier momento, de oficio o a instancias de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos»</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Ordenanza general de subvenciones del Consejo de Mallorca, aprobada por el Pleno del Consejo en sesión de día 23 de diciembre de 2016 (BOIB nº. 21, de 18 de febrero de 2017), en la cual se establece la regulación de las subvenciones que otorgue la corporación.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Convocatoria de subvenciones para llevar a cabo actividades o proyectos de participación ciudadana y apoyo a la acción voluntaria para el año 2020, aprobada por resolución del consejero de Promoción Económica y Desarrollo Local, de fecha 3 de marzo de 2020 (BOIB nº. 34, de 14 de marzo de 2020) y modificada por resolución de 1 de junio de 2020 (BOIB nº. 103 de 6 de junio de 2020).</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El consejero ejecutivo es el órgano competente para dictar la resolución de enmienda de error material de conformidad con el Decreto de la presidenta del Consejo de Mallorca, de día 9 de diciembre de 2019, por el cual se determina la organización del Consejo Insular, modificado por el decreto de día 6 de marzo de 2020, por el decreto de día 22 de mayo de 2020 y por el decreto de día 9 de julio de 2020. Artículo 1 Atribuciones genéricas de los consejeros ejecutivos y de las consejeras, apartado k) «Las facultades que emanan de la Ley de régimen jurídico de las administraciones públicas y del procedimiento administrativo común sobre inicio y ordenación del procedimiento, facultades que, en particular, se concretan en las siguientes: ampliar plazos para resolver, aplicar la tramitación de urgencia, hacer requerimientos de enmienda y mejora de la solicitud de iniciación y señalar trámites que se tienen que llevar a cabo.
