    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;En fecha 31 de agosto de 2020, la jefa del Servicio de Entidades Jurídicas ha formulado la siguiente propuesta de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. El 23 de enero de 2020, tuvo entrada en el Registro de la Consejería de Presidencia, Cultura e Igualdad la solicitud de inscripción de la constitución de la entidad Fundación TJ Amadiv en el Registro Único de Fundaciones de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. El 17 de marzo de 2020, la parte interesada aportó la documentación requerida para enmendar las deficiencias advertidas en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. El 29 de julio de 2020, tuvo entrada en el Registro de la Consejería de Presidencia, Cultura e Igualdad el informe jurídico favorable del protectorado de la fundación (la Consejería de Medio Ambiente y Territorio) sobre la idoneidad de los fines y la suficiencia de la dotación de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. El artículo 34 de la &lt;span style="color:#000000"&gt;Constitución &lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;spañola&lt;/span&gt; de 1978 reconoce el derecho de fundación para fines de interés general de acuerdo con la ley, y el artículo 53.1 reserva a la ley la regulación del ejercicio de los derechos y de las libertades reconocidos en el capítulo II del título I, entre los que se cuenta el derecho de fundación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. El artículo 30.33 del Estatuto de Autonomía de las Illes Balears, en la redacción dada por la Ley Orgánica 1/2007, de 28 de febrero, dispone que la Comunidad Autónoma de las Illes Balears tiene competencia exclusiva sobre las fundaciones que desarrollen principalmente sus funciones en el territorio de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. La Ley 50/2002, de 26 de diciembre, de Fundaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. El Real Decreto 1337/2005, de 11 de noviembre, por el que se aprueba el Reglamento de fundaciones de competencia estatal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. El Decreto 61/2007, de 18 de mayo, de regulación del Registro único de fundaciones de la comunidad autónoma de las Illes Balears y de organización del ejercicio del protectorado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Propuesta de resolución &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Propongo al director general de Relaciones I&lt;span style="color:#000000"&gt;nstitucional&lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt; y con el Parlamento que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. Ordenar la apertura de la hoja registral y la inscripción en el Registro Único de Fundaciones de las Illes Balears de la entidad Fundación TJ Amadiv. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Los datos que deben figurar en la inscripción son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Denominación: Fundación TJ Amadiv.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Escritura de constitución otorgada el 17 de diciembre de 2019 ante&lt;span style="color:#000000"&gt; l&lt;/span&gt;&lt;span style="color:#000000"&gt;a not&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt;ria Maria&lt;span style="color:#000000"&gt; &lt;/span&gt;Josep Cànaves Bertos con el número 2265 de su protocolo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Número de identificación fiscal: G16660052.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Protectorado al que corresponde la fundación: Consejería de Medio Ambiente y Territorio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Domicilio: avenida de Es Parc, 54, entresuelo, Manacor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- De acuerdo con el artículo 6 de sus estatutos, la finalidad de la fundación es la defensa del medio ambiente, la flora y la fauna.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Dotación inicial: 30.000,00 €, totalmente desembolsados e ingresados en una cuenta bancaria a nombre de la fundación. La realidad de la aportación dineraria se acredita mediante la exhibición y entrega a la nota&lt;span style="color:#000000"&gt;ri&lt;/span&gt;&lt;span style="color:#000000"&gt;a de&lt;/span&gt; la certificación bancaria, de la que se protocoliza una copia exacta en la escritura de constitución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Fundadores: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;José Francisco Company Company. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;- Patronato: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Los miembros aceptan expresamente el cargo de patrono en el acto de constitución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Notificar el contenido de esta resolución a las personas interesadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. Disponer la publicación de esta resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears &lt;/em&gt;al efecto único de publicidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Por todo ello, dicto la siguiente &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en sus mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra esta resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada en el plazo de un mes a contar desde el día siguiente al de su notificación ante la consejera de Presidencia,&lt;span style="color:#000000"&gt; Cultura&lt;/span&gt;&lt;span style="color:#000000"&gt; e Igualdad,&lt;/span&gt; de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 58 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;El director general de Relaciones Institucionales y con el Parlamento&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
