    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de setiembre de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para la Creación de empresas de Jóvenes agricultores, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 9&amp;nbsp;de setiembre&amp;nbsp;de 2020, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;"&lt;/em&gt;&lt;/strong&gt;&amp;nbsp;&lt;strong&gt;&lt;em&gt;RESOLUCIÓN DE DENEGACIÓN&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes terminó el di a 30/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;06/201&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados en el Anexo I adjunto no cumplen con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el citado anexo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Con fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;6 y 9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;agosto de 2020 el Servicio de Ayudas al Desarrollo Rural ha emitido informe desfavorable y propuesta provisioanl de denegación de la ayuda a los interesados relacionados en el Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Con fecha 6 y 10&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;agost&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o de 2020 se notifica, mediante publicación en la página web &lt;/em&gt;&lt;/em&gt;&lt;a href="http://www.caib.es/"&gt;&lt;em&gt;&lt;u&gt;&lt;span style="color:#000080"&gt;&lt;u&gt;&lt;em&gt;http://www.caib.es&lt;/em&gt;&lt;/u&gt;&lt;/span&gt;&lt;/u&gt;&lt;/em&gt;&lt;/a&gt;&lt;em&gt;&lt;em&gt;, la citada propuesta provisional a los interesados, concediendoles un plazo de 10 días para presentar las alegaciones oportunas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. A día de hoy y una vez finalizado el plazo, los interesados &amp;nbsp;relacionados en el Anexo I no han presentado alegaciones.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;la ayuda &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;solicit&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;por los interesados que figuran en el Anezo I, que son un total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expedientes que empieza por &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ANDREA SERRANO ROYO&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;IBAI MARTINEZ ECEOLAZA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, relativa a la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;línea de ayuda&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;"Creación de empresas de jóvenes agricultores", por no cumplir con alguno de los requisitos que se sestablecen en la convocatoria y que se especifican en el citado anexo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Declar&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ar &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;concluido el&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;procedimiento y &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;proceder al &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;archiv&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;o&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expediente&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s relacionados en el Anexo I.&amp;nbsp;.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;resolución a cada uno de los interesados del Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y los artículos 114&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;15&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de la Ley 3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;92&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;26&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;noviem&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;bre, de régimen jurídico de las administraciones públicas&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y del procedimiento administrativo común, modificada por la Ley 4/99, de 13 de enero.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
