&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha de 16 de julio de 2015, se publicó en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias. La Resolución mencionada se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016, (BOIB núm. 81) y 26 de junio de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 7 de mayo de 2019, se resuelve favorablemente la concesión de la ayuda a favor de Francina los Ángeles Mate&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;u&amp;nbsp;Juan (R24). Publicado en el BOIB núm. 72, de 30 de mayo de 2019. Con una inversión aprobada de 104.116,50 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Dentro del plazo legalmente establecido, el interesado presenta la solicitud de pago, informando de una inversión por valor de 77.032,50 € (49.507,50 € en cierres, solera de hormigón y muro; 27.525,00 € en barreras metálicas).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. El 6 de septiembre de 2019, se emite el Informe/Propuesta provisional de resolución de exclusión y de revocación total, en base al Informe de moderación de costes emitido por el técnico gestor de la línea en la que propone como precios de mercado: 25.556,65 € por las partidas de cierres, solera de hormigón y muro; y 13.047,50 € para las partidas de barreras metálicas, que se adjunta como anexo de este Informe/Propuesta provisional de resolución de exclusión y de revocación total.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.El Informe/propuesta provisional de resolución mencionado dicta la revocación total de la ayuda y la exclusión de la medida 4.1, Inversiones en las explotaciones agrarias por incumplimiento de compromisos básicos evaluables, de acuerdo con lo previsto en el apartado 2.3 del anexo VIII de la convocatoria antes mencionada. La diferencia entre los precios justificados y los de mercado denota incumplimiento grave, falsedad, y demuestra intencionalidad y negligencia en el cumplimiento de los compromisos básicos, además, teniendo en cuenta los precios de mercado de las inversiones justificadas, no se demuestra la realización del 50% del importe de inversión aprobado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 24 de septiembre de 2019, Francina los Ángeles Mateo Juan presenta alegaciones al Informe/Propuesta provisional de resolución de exclusión y de revocación total de 6 de septiembre de 2019, en la que manifiesta que en el presupuesto s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;olicitado se&amp;nbsp;incluyen los conceptos de transporte y colocación de las barreras, ahora bien, una vez revisado el presupuesto presentado se comprueba que no se solicitaron estos conceptos de manera específica. Por tanto, no se concedió ninguna ayuda para el transporte y la colocación de las barreras, únicamente para la compra de estas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Con fecha 30 de septiembre de 2019, se publica en la web del FOGAIBA el Informe / propuesta provisional de resolución de exclusión y revocación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.Con fecha de 25 de octubre de 2019, presenta alegaciones, justificando los sobrecoste de la ejecución de las obras.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9.Con fecha de 22 de junio de 2020, se realizó una visita ocular y se comprobó que efectivamente existe una orografía que dificulta y encarece los trabajos de cierre y de colocación de barreras ejecutados.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10. Por este motivo, se reformula la moderación de coste, incorporando estos nuevos criterios a tener en cuenta, resultando una minoración de la ayuda a la que establecían las primeras moderaciones, y por tanto no siendo necesaria ninguna exclusión ya que es justifica casi todo el ejecutado.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;11. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;12. El 20 de julio de 2020, se notifica a la beneficiaria, mediante la publicación en la web del FOGAIBA el Informe / propuesta provisional de revocación parcial de día 13 de julio de 2020, por la que se revocan 26.392,20 €, dado el Informe de moderación de costes de día 13 de julio de 2020 que fija en una minoración de 16.903,00 € la valoración de la inversión realizada, el valor de mercado del producto es inferior al importe que se ha justificado. Además, no se llevó a cabo la inversión de recolectora de frutos secos (27.084,00), a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Una vez transcurridos los 10 días hábiles, el interesado no ha presentado ninguna alegación.&lt;/em&gt;&lt;/em&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;13. Se ha considerado el Infome / propuesta provisional de resolución de 13 de julio de 2020, de revocación parcial de la ayuda concedida a Francina los Ángeles Mateo Juan, con NIF ***1905**.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Revocar parcialmente la Resolución de ayuda concedida a&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;beneficiari&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;por el importe y con los datos detallados en el anexo de esta resolución, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a nombre de Francina del Àngels Mateu Juan, con NIF ***1905**,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;que suma un importe total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;26.392,20&amp;nbsp;€ euros, relativa a la línea de ayuda "Inversiones en las explotaciones agrarias".&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
