&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El consejero ejecutivo de Turismo y Deportes, en fecha 20 de agosto julio de 2020, ha dictado la siguiente Resolución:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;"&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Esta convocatoria está prevista en el marco del Plan estratégico de subvenciones del Consell de Mallorca para el ejercicio 2020 (aprobado por Acuerdo del Consejo Ejecutivo de 27 de enero 2020 (BOIB núm.14 de 1 de febrero de 2020) y dentro las competencias que tiene atribuidas el Departamento de Turismo y Deportes, relativas a información turística y promoción turística y apoyo a oficinas locales de información turística, de acuerdo con lo dispuesto en el artículo 10 apartado a del Decreto de la Presidenta del Consejo insular de Mallorca de día 9 de diciembre de 2019, por el que se determina la organización del Consejo insular de Mallorca, modificado por el Decreto de día 6 de marzo de 2020 y por el Decreto de 22 de mayo de 2020 (BOIB núm. 167, de 12 de diciembre de 2019; BOIB 29, de 7 de marzo de 2020; BOIB núm. 95, de 28 de mayo de 2020).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La convocatoria de subvenciones para la realización de mejoras en accesibilidad e inversiones en las oficinas de información turística para el año 2020, fue aprobada por resolución del consejero ejecutivo de Turismo y Deportes, de 19 de febrero 2020, de acuerdo con el Plan estratégico de subvenciones de 2020&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. En el presupuesto de gastos del Consejo de Mallorca de 2020 se ha previsto el crédito adecuado y suficiente para hacer frente al gasto derivado de la presente convocatoria, por un importe total de 150.000,00 €, con cargo a las siguientes aplicaciones presupuestarias 30.43210.76200, 30.43210.76300 denominada "Convocatoria de subvenciones para la realización de mejoras en accesibilidad e inversiones en las oficinas de información turística para el año 2020".&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El día 10 de agosto de 2020, el órgano instructor de la convocatoria, ha emitido un informe indicando que los beneficiarios propuestos, cumplen con los requisitos establecidos en la convocatoria para poder acceder a las subvenciones que nos ocupan.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Vista el acta de la sesión de día 15 de julio de 2020 de la Comisión Evaluadora de la Dirección Insular de Turismo, para la convocatoria de subvenciones para la realización de mejoras en accesibilidad e inversiones en las oficinas de información turística para el año 2020&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El día 10 de agosto de 2020 la técnica jurídica ha emitido un informe jurídico favorable sobre la propuesta de aprobación de la concesión de las subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:normal"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Decreto de la Presidencia del Consejo de Mallorca de día 8 de julio de 2019, por el que se crean los departamentos que han de estructurar el gobierno (BOIB núm. 92, de 9 de julio de 2019) a través cual se crean las direcciones insulares y las secretarías técnicas en que se han de estructurar los departamentos, en consecuencia, la Dirección Insular de Turismo está integrada dentro del Departamento de Turismo y Deportes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Departamento de Turismo y Deportes tiene atribuidas las competencias relativas a información y promoción turística y apoyo a oficinas locales de información turística, de acuerdo con lo dispuesto en el artículo 10 del Decreto de Organización del Consejo Insular de Mallorca modificado por el Decreto de día 6 de marzo de 2020 y por el decreto de 22 de mayo de 2020. (BOIB núm, 167, de 12 de diciembre de 2019, BOIB núm. 29, de 87 de marzo de 2020; BOIB núm, 95, de 28 de mayo de 2020).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Reglamento orgánico del Consejo de Mallorca (BOIB núm. 89, de 19 de julio de 2018) en el artículo 39.2.h), junto con la base 23.5 de las Bases de ejecución del presupuesto de gastos vigente del Consejo de Mallorca, disponen que entre las atribuciones de la consejero / a ejecutivo / a están entre otros Aprobar y resolver subvenciones, así como autorizar y disponer gastos de cuantía igual o inferior a doscientos cincuenta mil euros (250.000,00 €) . De los preceptos mencionados se determina que el consejero ejecutivo del Departamento de Turismo y Deportes, es la competente para aprobar la concesión de estas subvenciones y para disponer el correspondiente gasto que se deriva.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El artículo 18.2.c) yd) de la Ordenanza general de subvenciones del Consejo Insular de Mallorca, el órgano instructor del procedimiento es el secretario técnico del Departamento de Turismo y Deportes, el cual tiene que llevar a cabo las actuaciones y actos de trámite necesarios para velar por el cumplimiento de los requisitos de la convocatoria, y específicamente, emitirá un informe en el que conste que, de la información en su poder, se desprende que las personas beneficiarias cumplen todos los requisitos necesarios para acceder hay.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Ordenanza general de subvenciones del Consejo de Mallorca (BOIB núm. 21, de 18 de febrero de 2017) establece las bases reguladoras.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La convocatoria se adecua a la base 34 de las Bases de ejecución del presupuesto de gastos del Consejo de Mallorca para el año 2020, relativas a los principios generales de la gestión y concesión de subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El punto 12 de la convocatoria fija como obligación de los beneficiarios acreditar, antes de dictar la propuesta de acuerdo de concesión de la subvención, que está al corriente de obligaciones tributarias con el Estado y con el Consejo Insular de Mallorca y los organismos autónomos dependientes, y de las obligaciones con la Seguridad Social.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. El punto 4 de la convocatoria determina que el procedimiento de selección de las entidades beneficiarias se llevó a cabo mediante concurrencia no competitiva, en virtud del cual se exceptúa el requisito de fijar un orden de prelación en caso de que las solicitudes presentadas reúnan los requisitos establecidos y el crédito sea suficiente. En caso contrario, la prelación de la concesión viene dada por el orden de número de entrada en el Registro General que se adquiere en el momento de la presentación de la solicitud, una vez completado el expediente de forma correcta y acompañado de los documentos preceptivos, hasta agotar el total del crédito presupuestario establecido en la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. El punto 9 de la convocatoria establece que dentro de los actos de trámite, se constituye una comisión evaluadora para velar por el cumplimiento de los requisitos establecidos en la convocatoria. Los miembros de la cual, proponen por unanimidad elevar al órgano instructor el informe propuesta que servirá de base a la propuesta de resolución de concesión del órgano instructor, que contiene las solicitudes admitidas (detallando el presupuesto subvencionable y la subvención concedida), las reducidas y las excluidas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. La propuesta de acuerdo de concesión del órgano instructor ajusta el previsto en el punto 9 de la convocatoria, dado que incluye las solicitudes admitidas con el detalle del presupuesto subvencionable y la subvención concedida (Anexo I).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo lo expuesto y de acuerdo con lo dispuesto en el punto 9º de la convocatoria &lt;strong&gt;DICTO&lt;/strong&gt; la siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. CONCEDER, las subvenciones económicas de la convocatoria para apoyar a los servicios municipales de información turística para el año 2020, dirigida a los ayuntamientos de Mallorca con población inferior a 60.000 habitantes y las mancomunidades de Mallorca, por un importe total de de 51.431,56 € a favor de los beneficiarios que se relacionan en el anexo I que se adjunta, por las cantidades que constan.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. DISPONER un gasto total de 51.431,56 € (CINCUENTA Y UN MIL CUATROCIENTOS TREINTA Y UN EUROS CON CINCUENTA Y SEIS CÉNTIMOS) a favor de los beneficiarios, que se relacionan en el Anexo I que se adjunta, por las cuantías que figuran con cargo a la aplicación presupuestaria 30.43210.76200.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. EXCLUIR las solicitudes que figuran en el Anexo I. Motivo: incumplimiento del punto 5.2 de la bases de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Barra LA DIFERENCIA entre el importe autorizado por esta convocatoria los ayuntamientos del importe de 130.000 € (CIENTO TREINTA MIL EUROS) y el importe dispuesto 51.431,56 € (CINCUENTA Y UN MIL CUATROCIENTOS TREINTA Y UN EUROS CON CINCUENTA Y SEIS CÉNTIMOS) liberando el crédito sobrante de 78.568,44 € (SETENTA OCHO MIL QUINIENTOS SESENTA Y OCHO EUROS CON cuarzo Y CUATRO CÉNTIMOS) a la aplicación presupuestaria 30 43210 76200.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Barra el IMPORTE autorizado de 20.000 € (VEINTE MIL EUROS) destinados a las mancomunidades ya que no se ha dispuesto nada por falta de solicitudes liberando el crédito sobrante de 20.000 € (VEINTE MIL EUROS) de la aplicación presupuestaria 30 43210 76300.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;6. ORDENAR, la publicación de esta resolución de concesión de las subvenciones para la realización de mejoras en accesibilidad e inversiones a las OIT para el año 2020, en el Boletín Oficial de las Islas Baleares y trasladar la información sobre estas concesiones en la Base de Datos Nacional de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. INFORMAR, a los interesados ​​de lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que no pone fin a la vía administrativa, podrá interponer el recurso de alzada en el plazo de un mes, contado a partir del día siguiente de esta notificación. El recurso se puede interponer formalmente ante este consejero ejecutivo / consejera ejecutiva o ante la presidencia del Consejo Insular de Mallorca, que es el órgano competente para resolverlo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la desestimación expresa de este recurso de alzada, puede interponer el recurso contencioso administrativo ante (el Juzgado Contencioso Administrativo de Palma que corresponda o la Sala Contencioso Administrativo del Tribunal Superior de Justicia de las Islas Baleares), en el plazo de dos meses, contados a partir del día siguiente de recibir la notificación de la desestimación del mencionado recurso de alzada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no habéis recibido la notificación de resolución expresa, se entenderá desestimada por silencio e interponer el recurso contencioso administrativo ante (el Juzgado Contencioso Administrativo de Palma que corresponda o la Sala Contencioso Administrativo del Tribunal Superior de Justicia de las Islas Baleares), en el plazo de seis meses, a partir del día siguiente de la desestimación presunta.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstante lo anterior, se puede interponer, en su caso, cualquier otro recurso que considere oportuno. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso administrativa y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. "&lt;/span&gt;&lt;/p&gt;
