    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El artículo 24 del Convenio Colectivo del personal laboral de la comunidad autónoma de las Islas Baleares dispone que la provisión de puestos de trabajo de personal laboral puede realizarse mediante el sistema de concurso de méritos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El concurso de méritos constituye el sistema normal de provisión de plazas vacantes y hay que tener en cuenta únicamente los méritos exigidos en la convocatoria correspondiente, que deben determinarse de acuerdo con los baremos correspondientes de cada convocatoria, acordados con el comité de empresa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Constituye el objeto de esta Resolución la aprobación del procedimiento de provisión por concurso de méritos del puesto de trabajo Puesto&lt;/span&gt; base (FGB040102 L0254000E) &lt;span style="color:black"&gt;adscrito al Servicio de Informática&lt;strong&gt; &lt;/strong&gt;del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo lo anterior, de acuerdo con la competencia que prevé el artículo 13.s) del Decreto 64/2005, de 10 de junio, de Creación del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Primero. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Aprobar la convocatoria pública para la provisión mediante un concurso de méritos de la plaza vacante Puesto&lt;/span&gt; base (FGB040102 L0254000E) &lt;span style="color:black"&gt;adscrito al Servicio de Informática&lt;strong&gt; &lt;/strong&gt;del FOGAIBA.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Segundo. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Aprobar las bases y el baremo de méritos que deben regir esta convocatoria, que se adjuntan como anexo I de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="color:black"&gt;Tercero. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Nombrar a los miembros de la Comisión Técnica de Valoración de esta convocatoria, que figuran en el anexo III de esta Resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Cuarto. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Ordenar la publicación de esta Resolución en el Boletín Oficial de las Islas Baleares (BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Quinto. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Contra esta resolución, que no agota la vía administrativa, puede interponerse recurso de alzada ante la consejera de Agricultura, Pesca y Alimentación en el plazo de un mes a contar desde el día siguiente de su notificación, de acuerdo con lo que establecen el artículo 58.4 de la Ley 3/2003 de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares y los artículos 121 y 122 de la Ley 39/2015 de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, todo ello sin perjuicio de interponer cualquier otra que se estime pertinente en defensa de los intereses propios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt; Vigilancia de la operatividad y del rendimiento de los sistemas de información del FOGAIBA tanto los ubicados en los servidores propios del FOGAIBA como los ubicados en servidores externos (DGIDT) y toma de medidas en caso de problemas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Resolución de las incidencias de segundo nivel relativas a los sistemas de información en colaboración con los proveedores de los sistemas de información y con la DGIDT como hostajadores de las aplicaciones y de las bases de datos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Elaboración de instrucciones técnicas a cumplir por parte de los proveedores de sistemas de información para que éstos se ajusten a las funcionalidades y el rendimiento necesario para el FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Realización de análisis y estudios técnicos a solicitud del jefe del servicio en materia de sistemas de información y de las telecomunicaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Seguimiento de las solicitudes de cambio a los sistemas de información por parte de los usuarios utilizando la herramienta de gestión de incidencias y participando en el flujo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Seguimiento y control del procedimiento de instalaciones de los sistemas de información del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Coordinación con los técnicos de la DGIDT para la resolución de incidencias que afecten a los sistemas de información del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Participación en tareas de análisis y de diseño de soluciones informáticas tanto desde el punto de vista de redacción de informes técnicos como de participación en proyectos internos del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Implantación de nuevos sistemas de información del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;•&lt;/span&gt; &lt;span style="color:black"&gt;Gestión de la implantación de medidas de seguridad derivadas del sistema de gestión de la seguridad de la información (SGSI) según la norma ISO / IEC 27002: 2005 sobre los sistemas de información del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;1.2. Retribuciones &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;1.2.1 Retribuciones básicas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="color:black"&gt;2. Forma de provisión y requisitos de las personas aspirantes&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La provisión del lugar de trabajo objeto de esta convocatoria se realizará mediante concurso de méritos entre el personal laboral fijo del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;3. Requisitos y condiciones de participación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3.1 Puede participar todo el personal laboral fijo, tanto en situación de activo como de excedencia, que tenga la misma categoría profesional que la vacante objeto del concurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3.2 Para optar al puesto de trabajo deben cumplirse los requisitos de la plaza, que figuran en la ficha de la relación de puestos de trabajo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Pertenecer al grupo A o B.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Tener la siguiente titulación&lt;strong&gt;: &lt;/strong&gt;Ingeniería en &lt;/span&gt;Informática o &lt;span style="color:black"&gt;Telecomunicación o Grado en el ámbito de la Ingeniería Informática o Grado en el ámbito de la Ingeniería de Telecomunicación o Ingeniería Técnica en Informática o Ingeniería Técnica en Telecomunicación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Nivel B2 de catalán.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;4. Presentación de solicitudes y documentación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4.1. Las solicitudes deben formularse usando el modelo del anexo II. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4.2. La persona interesada debe presentar la solicitud cumplimentada, junto con toda la documentación compulsada que corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4.3. El plazo para presentar las solicitudes es de diez días hábiles a partir del día siguiente de la publicación de esta convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4.4. Las solicitudes y toda la documentación deben presentarse, dentro del plazo previsto, en el Registro del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4.5. No se valorará ningún mérito que no se haya justificado debidamente (originales o copias cotejadas) dentro del plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4.6. Con el vencimiento del plazo de presentación de solicitudes caduca el plazo para renunciar a participar en el concurso o desistir de él.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="color:black"&gt;5. Listas de personas admitidas y excluidas&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5.1 Una vez haya finalizado el plazo para presentar las solicitudes, se hará pública la lista provisional de personas admitidas y excluidas, en la que se expresará la causa de exclusión para cada persona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5.2 Estas listas se publicarán en la página web del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5.3 Las personas excluidas dispondrán de un plazo de cinco días hábiles, a partir del día siguiente de la publicación, para enmendar las deficiencias detectadas y aportar los documentos preceptivos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5.4 Una vez haya finalizado el plazo indicado, se publicará en la página web del FOGAIBA la lista definitiva de personas admitidas y excluidas del concurso, en la que se expresarán las causas de exclusión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;6. Baremo de méritos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La propuesta de nombramiento se hará a favor de la persona aspirante que tenga más puntuación, según el siguiente baremo de méritos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;VALORACIÓN DE LOS CANDIDATOS&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se valorará la antigüedad reconocida por el FOGAIBA hasta la fecha de publicación en el BOIB. (P = 0,10 x mes trabajado). Puntuación máxima: 6 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La antigüedad se valorará de la misma forma para los grupos A y B y se empieza a contar desde el día de la publicación de esta resolución hacia atrás.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se valorarán todos los días acreditados de antigüedad de forma proporcional (de fecha a fecha).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Conocimientos de catalán&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Puntuación máxima: 1 punto &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Certificado C1 (nivel de suficiencia, antes, certificado C): 0,50 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Certificado C2 (nivel superior; antes, certificado D): 0,75 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Conocimientos de informática&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se valorarán los certificados acreditativos de conocimientos del área informática expedidos por escuelas oficiales o escuelas de la Administración pública. Puntuación máxima: 4 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Los cursos de informática deben valorarse de acuerdo con la siguiente puntuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Cursos con una duración de entre 10 y 19 horas: 0,0975 puntos; cursos con una duración de entre 20 y 29 horas: 0,195 puntos, y cursos de 30 horas o más: 0,39 puntos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Para una misma aplicación informática solo se valorará el certificado de nivel superior o el certificado que acredite un número superior de horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todos los cursos correspondientes al presente epígrafe realizados o con el certificado emitido antes del 1 de enero del año 2.000 tendrán el 50% de la puntuación establecida.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Formación complementaria relacionada con el puesto de trabajo&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se valorarán los certificados acreditativos expedidos por centros oficiales o escuelas de la Administración Pública en las materias relacionadas a continuación (P = 0,025 x hora). Puntuación máxima: 3 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Únicamente se valorarán los cursos en las materias siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Programación en Java.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Software de control de versiones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Sistemas de información geográfica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Normativa en materia de subvenciones de agricultura y pesca y en fondos europeos FEAGA, FEADER, FEMP.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;Solución en caso de empate&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En caso de que la valoración final de los méritos resulte en un empate, para dirimir esta situación se tendrán en cuenta los criterios por este orden:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1º. En caso de empate en la valoración de los candidatos, y en el caso de que haya infrarrepresentación de hombres o mujeres en una categoría, se seleccionará a la persona que pertenezca al colectivo menos representado (estableciendo un equilibrio comprendido entre los porcentajes 60% - 40%), siempre y cuando no concurran en el otro candidato, circunstancias que justifiquen que no se aplique la medida (por ejemplo la pertenencia a otro colectivo con dificultades especiales).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2º. Más antigüedad. Se valorará la antigüedad reconocida total de la persona presentada a la Administración pública o el sector público instrumental de fecha a fecha desde el día de la publicación de esta resolución hacia atrás.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;7 Comisión Técnica de Valoración&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7.1 La Comisión Técnica de Valoración estará constituida por cuatro personas como miembros titulares y por sus suplentes (anexo III). Dos personas estarán designadas por el director gerente, una de las cuales ejercerá las funciones de presidente y la otra de secretario, y una tercera persona será vocal y una cuarta estará designada por el Comité de Empresa entre sus componentes. Para cada persona que sea miembro titular también debe designarse un suplente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7.2 Las personas que son miembros de la Comisión Técnica de Valoración pueden cesar en estas funciones aunque ya hayan empezado a ejercerlas y ser sustituidas por el órgano que las nombró.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7.3 Para la constitución válida de la Comisión Técnica de Valoración a efectos de realizar sesiones, deliberaciones, valoraciones y tomar acuerdos se requerirá siempre la presencia de todas las personas que son miembros de esta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7.4 Las funciones básicas de la Comisión Técnica de Valoración son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Elaborar las listas provisionales y definitivas de personas admitidas y excluidas en el procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Valorar los méritos alegados por las personas concursantes al lugar de provisión de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Elaborar una lista en la que, por orden de puntuación, deben figurar todas las personas aspirantes presentadas y las puntuaciones obtenidas por cada una de ellas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d) Realizar la propuesta correspondiente de la persona candidata que haya obtenido la puntuación más alta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7.5 Se levantará acta de todas las reuniones que la Comisión Técnica de Valoración celebre, que deberán firmar todas las personas que son miembros de esta y que hayan asistido a la reunión al terminar la sesión o antes de empezar la siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;8. Resolución de la convocatoria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8.1. El plazo para la publicación de la lista provisional de admitidos y excluídos será de 10 días hábiles, a contar desde el día siguiente que finalice el plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8.2. Una vez se haya publicado la lista provisional de admitidos y excluídos, las personas excluídas podrán formular observaciones o reclamaciones en el plazo de 5 días hábiles a partir del día siguiente de la publicación de ésta en la página web del FOGAIBA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8.3. Una vez se hayan examinado las observaciones y las reclamaciones presentadas dentro del plazo, y una vez se haya escuchado a las posibles personas afectadas, si se considera conveniente, la Comisión Técnica de Valoración dirigirá al gerente la propuesta definitiva de adjudicación de la plaza, que podrá incluir, si procede, los cambios que sean consecuencia de las observaciones y de las reclamaciones mencionadas, además de la enmienda de oficio de los errores detectados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8.4. El plazo para la resolución definitiva del concurso será de 10 días hábiles, a contar desde el día siguiente al de finalización del plazo de presentación de reclamaciones a la lista provisional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8.5. Una vez haya visto la propuesta definitiva, el director gerente del FOGAIBA debe dictar la resolución correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8.6. Los destinos adjudicados por el sistema de concurso de méritos serán irrenunciables y los traslados voluntarios no darán lugar a ninguna indemnización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Toma de posesión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;9.1 El plazo de toma de posesión del nuevo destino obtenido será de quince días si la resolución conlleva el reingreso en el servicio activo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
