font-size:12px"><span style="line-height:normal"><strong>Antecedentes</strong></span></span></p> <ol> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">El día 18 de junio de 2020 se publicó en el BOIB número 110 la Resolución del director general del Servicio de Salud de las Islas Baleares de 15 de junio por la cual se aprueban las listas definitivas de personas candidatas y de personas excluidas en el concurso de traslados voluntario para proveer plazas básicas vacantes de la categoría de facultativo/facultativa especialista de área de medicina intensiva.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Se han apreciado errores en la mencionada resolución que se han de corregir.</span></span></li> </ol> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Fundamentos de derecho</strong></span></span></p> <ol> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">El artículo 109.2 de la Ley 39/2015, de1 de octubre, del procedimiento administrativo común establece que las administraciones públicas pueden rectificar, así mismo, en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">El artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares dispone que la revocación de los actos de gravamen o desfavorables y la rectificación de los errores materiales, aritméticos y de hecho en actas y disposiciones administrativas corresponde alórgano que ha dictado el acto o la disposición</span></span></li> </ol> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Por todo ello dicto la siguiente</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Resolución</strong></span></span></p> <ol> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Rectificar los errores de la Resolución del director general del Servicio de Salud de las Islas Baleares de 15 de junio por la cual se aprueban las listas definitivas de personas candidatas y de personas excluidas en el concurso de traslados voluntario para proveer plazas básicas vacantes de la categoría de facultativo/facultativa especialista de área de medicina intensiva. </span></span></li> </ol> <ol start="2"> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Publicar esta resolución en el <em>Boletín Oficial de las Islas Baleares</em> y en el portal web <em>www.ibsalut.es</em></span></span></li> </ol> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><strong>Interposición de recursos</strong></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Contra esta resolución, que agota la vía administrativa, puede interponerse un recurso de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente a la fecha de publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en relación con el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">También puede presentarse directamente un recurso contencioso-administrativo ante cualquiera de los juzgados de lo contencioso-administrativo de Palma en el plazo de dos meses a contar desde el día siguiente a la fecha de publicación, de acuerdo con los artículos 8.2 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.</span></span></p> <p style="margin-bottom:10pt;
