Por medio de las Resoluciones del director general del Servicio de Salud de las Islas Baleares de 1 de agosto de 2018 (BOIB núm. 96/2018, de 4 de agosto) y de 5 de septiembre de 2018 (BOIB núm. 114/2018, de 15 de septiembre) se convocó un concurso de traslados voluntario para proveer plazas básicas vacantes de diversas categorías de personal estatutario, entre las que está la de técnico/técnica especialista de radiodiagnóstico dependiente del Servicio de Salud.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En el BOIB núm. 19, de 13 de febrero de 2020, se publicó la Resolución del director general del Servicio de Salud de las Islas Baleares de 7 de febrero de 2020 por la cual se resuelve con carácter provisionalel concurso de traslados mencionado. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Una vez finalizado el plazo para presentar alegaciones, de acuerdo con la base 6.5 de la convocatoria, dicto la siguiente</span></p> <p style="text-align:center"> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>RESOLUCIÓN</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Resolver con carácter definitivo el concurso de traslados voluntario para proveer plazas básicas vacantes de la categoría de técnico/técnica especialista de radiodiagnóstico dependiente del Servicio de Salud de las Islas Baleares, convocado a través de las resoluciones a las que se refiere el punto 1 del apartado “Hechos”.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Establecer que con la presente resolución se adjudican definitivamente las plazas ofertadas a las personas concursantes basándose en las plazas solicitadas y el orden determinado por la puntuación obtenida, según figura en las listas del anexo de esta resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Recordar que, de conformidad con la base 6.8 de la convocatoria, las plazas adjudicadas son irrenunciables, salvo que la renuncia esté motivada por la obtención de una plaza en virtud de la resolución de un procedimiento de movilidad voluntaria convocado por otra administración pública, en base al artículo 37.4 de la Ley 55/2003, de 16 de diciembre, del Estatuto Marco del personal estatutario de los servicios de salud.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Disponer que, de conformidad con la base 7.1 de la convocatoria, las personas concursantes que hayan obtenido una plaza cesen en la plaza que estén ocupando en el plazo de los 3 días hábiles siguientes a la fecha de publicación de esta resolución en el Boletín Oficial de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Determinar que, de acuerdo con la base 7.2 de la convocatoria, la toma de posesión de las nuevas plazas tienen que efectuarse en los plazos siguientes: En los 3 días hábiles siguientes a la fecha del cese si las plazas están ubicadas en el mismo municipio; en 15 días hábiles si están situadas en municipios diferentes pero en la misma área de salud; y en un mes si están localizadas en un municipio y en una área de salud diferentes o cuando implique un cambio de servicio de salud. Según la base 7.4 de la convocatoria, si la adjudicación de la plaza implica reingresar en el servicio activo, el plazo para tomar posesión es de un mes a contar desde la fecha de publicación de la resolución definitiva del concurso.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Publicar esta resolución en el Boletín Oficial de las Islas Baleares y en la página web www.ibsalut.es.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución –que agota la vía administrativa- puede interponerse un recurso de reposición ante el mismo órgano que la dicta en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2007, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">También se puede presentar directamente un recurso contencioso-administrativo ante los Juzgados de lo Contencioso Administrativo de Palma en el plazo de dos meses a contar desde el día siguiente de la publicación de esta resolución, de acuerdo con los artículos 8.2 y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso Administrativa. </span></p> <p> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif;
