    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El apartado 8.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de setiembre de 2015, por la cual se convocan ayudas destinadas a la Creación de empresas de jóvenes agricultores para los años 2015-2019, convocatoria 2017, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el Boletín Oficial de las Islas Baleares, y se hará de acuerdo a los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#212121"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 1 de junio de 2020, firmó la siguiente resolución: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Hechos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;1. El 15 de septiembre de 2015, se publicó en el Boletín Oficial de las Islas Baleares (BOIB) núm. 136 la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. De conformidad con el apartado sexto de la Resolución mencionada, el plazo para presentar las solicitudes de ayuda finalizó el 31 de diciembre de 2016.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de Laia Amengual Oliver (exp. Núm. CEJA2017_1 / 088), entre otros, que constan en el anexo de la Resolución de concesión R3 de 9 de octubre de 2018 (BOIB núm. 133, 25 de octubre de 2018) con los datos y los importes correspondientes, con un importe concedido de 27.500,00 €.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El punto 1 del apartado décimo de la Resolución antes mencionada establece que son obligaciones de los beneficiarios, entre otros, poner en marcha el plan empresarial como máximo durante los nueve meses siguientes a la fecha de concesión de la ayuda . Por otra parte, el punto 1 del apartado undécimo establece que se entenderá acreditado el inicio del plan empresarial con la aportación de los documentos que se detallan en el punto 3.a), esto es, entre otros, justificando de solicitud de inscripción en el correspondiente registro insular de explotaciones agrarias.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Por todo ello, el plazo de 9 meses para poner en marcha el plan empresarial finalizó el 25 de julio de 2019, ya que la notificación de concesión del expediente es de día 25 de octubre de 2018 y una vez transcurrido este plazo se ha comprobado que la beneficiaria antes mencionada no está inscrita en el Registro Insular de Explotaciones Agrarias, y por tanto no cumple con la obligación de poner en marcha el plan empresarial en los 9 meses siguientes a la fecha de concesión de la ayuda.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ».&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El 9 de marzo de 2020 se notifica a la persona interesada, mediante la publicación en la web, el Informe/propuesta provisional de resolución de revocación total de 3 de marzo de 2020 por el incumplimiento de la obligación de poner en marcha el plan empresarial en los 9 meses siguientes a la fecha de concesión de la ayuda, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Una vez transcurridos los 10 días hábiles, el interesado no ha presentado ninguna alegación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;8. Se ha considerado el Informe / propuesta provisional de resolución de 3 de marzo de 2020 de revocación total de la ayuda concedida a Laia Amengual Oliver, con NIF *** 7913 **.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;1. Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;2. Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014 a 2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Por todo ello, dicto la siguiente&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Resolución&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;1. Revocar totalmente la ayuda concedida a la beneficiaria Laia Amengual Oliver, con NIF***7913** (exp. CEJA2017_1 / 088), por un importe de 27.500,00, incluida en la Resolución de concesión R3 de día 9 de octubre de 2018, y con los datos detallados en el anexo de esta resolución, ya que incumple totalmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;2. Finalizar el procedimiento y archivar el expediente CEJA2017_1 / 088.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;3. Notificar esta resolución a la beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, &amp;nbsp;en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las illes Balears, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
