TRANSPARENCIA</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">ANEXO: objetivos específicos, programas y líneas de ayuda.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">1.- INTRODUCCIÓN.</span></span></strong></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">1.1- CONSIDERACIONES PREVIAS.</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El Ayuntamiento de Sant Josep de la Talaia ha considerado oportuno aprobar un Plan estratégico de subvenciones para el periodo 2020-2022 incrementando en un año la estrategia prevista en el anterior, pasando de una previsión para dos años a un Plan estratégico con una Previsión de tres años, tal como viene establecido en el artículo 11 de RD 887/2006, de 21 de julio, por el cual se aprueba el Reglamento de la Ley general de subvenciones (en adelante RLGS). Este cambio permitirá un desarrollo más dinámico y eficiente de las subvenciones que la integran.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El régimen de seguimiento y evaluación continuo permitirá, con el uso de los indicadores, conocer el estado de la situación y de los progresos logrados en el cumplimiento de los objetivos respectivos. En este sentido, el Plan debe permitir que aquellas líneas de subvenciones que no alcancen el nivel de consecución de objetivos deseado puedan ser modificadas o sustituidas por otras más eficaces o eficientes o, en su caso, eliminarlas</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">La legislación vigente en materia de subvenciones: Ley 38/2003, de 17 de noviembre, General de Subvenciones (en adelante, LGS); y Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la citada Ley (en adelante, RLGS) tiene como objetivo que la actividad pública, tradicionalmente conocida como de fomento y promoción, se desarrolle dentro de los parámetros que la propia ley impone, estableciendo los mecanismos de control previo y posterior evaluación y sometiendo esta actividad a los principios de:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">- Publicidad, transparencia, concurrencia, objetividad, igualdad y no discriminación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">- Eficacia en el cumplimiento de los objetivos fijados por la Administración otorgante.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">- Control de la discrecionalidad administrativa.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">- Eficiencia en la asignación y utilización de los recursos públicos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Para ello, la ley introduce la necesidad de elaborar en cada administración un Plan Estratégico de Subvenciones, que permita relacionar los objetivos a alcanzar y efectos que se pretenden conseguir, con los costes previstos y su financiación, con el objeto de adecuar con carácter previo a la concesión, las necesidades públicas que se pretende cubrir mediante las subvenciones con los recursos disponibles. Una mayor información sobre las subvenciones facilita la complementariedad y coherencia de las actuaciones de las diferentes administraciones públicas, evitando cualquier tipo de solapamiento.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">En virtud de la potestad de programación o planificación atribuida a las entidades locales para el art. 4.c) de la Ley 7/1985 RBRL, se ha elaborado el presente plan estratégico, con la participación de todas las Áreas, Centros de Gestión y Unidades Administrativas responsables de la gestión de subvenciones del Ayuntamiento de Sant Josep de sa Talaia</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">1.2- NATURALEZA JURÍDICA</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El Plan estratégico de subvenciones se configura como un instrumento de gestión de carácter programático, de planificación, que no tiene carácter normativo y su contenido no crea derechos ni obligaciones, no supone una incidencia directa en la esfera de los particulares, ni genera derechos ni obligaciones para la administración.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El Plan estratégico no supone la generación de derechos a favor de los potenciales beneficiarios, que no podrán exigir indemnización o compensación en caso de que el Plan no se lleve a la práctica. El Plan se presenta como una guía que, dentro del marco normativo preestablecido, marca la pauta a seguir en la línea de fomento de actividades de interés general.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El establecimiento de subvenciones queda supeditado al cumplimiento de los objetivos de estabilidad presupuestaria, por lo que consignaciones presupuestarias que se aprueben y las bases reguladoras de su concesión se acomodarán en cada momento a estos objetivos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">La efectividad del plan queda supeditada a la aprobación de las bases reguladoras y las convocatorias, tanto para el caso de subvenciones en concurrencia competitiva y no competitiva como para el caso de subvenciones directas concedidas a través de acuerdo, decreto, resolución o convenio, y por supuesto a las disponibilidades presupuestarias en cada ejercicio de ejecución</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">1.3- COMPETENCIA</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El órgano competente para la aprobación del Plan Estratégico de Subvenciones, es el Pleno Municipal, dado que se trata de un instrumento de planificación estratégica de la actividad subvencional o de fomento y de gestión económica, de acuerdo con lo previsto en el artículo 22.2.e) de la Ley de bases de régimen local.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sin embargo, los órganos competentes para conceder las subvenciones serán la Junta de Gobierno Local, el Alcalde y en su caso, las Concejalías delegadas.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">1.4- ÁMBITO SUBJETIVO</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El presente Plan Estratégico de Subvenciones incluye todas las subvenciones concedidas directamente por este Ayuntamiento.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">1.5 VIGENCIA</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El ámbito temporal del presente Plan Estratégico de Subvenciones será trianual, ya que se incluyen las subvenciones previstas para los años 2020, 2021 y 2022 y quedará prorrogado hasta la aprobación del siguiente Plan.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">2.- ASPECTOS ESTRATÉGICOS DEL PLAN</span></span></strong></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">2.1.- PRINCIPIOS</span></span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">a) Publicidad y libre concurrencia mediante convocatoria previa en la que se garantice la concurrencia e igualdad en la distribución de fondos públicos, sin perjuicio de la posible concesión directa que, de conformidad con lo establecido en la norma aplicable, deberá contar con las debidas disponibilidades presupuestarias, con carácter previo.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">b) Objetividad en el proceso de asignación de fondos públicos. La subvención se concederá de acuerdo con criterios objetivos previamente establecidos en la convocatoria para garantizar el conocimiento previo de los mismos por los potenciales beneficiarios.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">c) Igualdad y no discriminación entre la ciudadanía, entre los diferentes sectores y entre los colectivos.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">d) Transparencia en el proceso de asignación de recursos públicos. Tanto en el proceso de concesión, como en la publicación de los resultados.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">e) Eficacia en el cumplimiento de los objetivos, con el establecimiento de un procedimiento de seguimiento y control de las subvenciones concedidas.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">f) Eficiencia en la asignación y utilización de los recursos públicos, con la valoración de las subvenciones y la asignación a los proyectos más eficientes.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">2.2.- OBJETIVOS</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Son objetivos generales del presente Plan estratégico los siguientes:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">a) Dar cumplimiento al mandato legal recogido en el art. 8.1 de la Ley 38/2003 de 17 de noviembre, que obliga a los ayuntamientos a aprobar su correspondiente Plan Estratégico, previamente a la concesión de subvenciones.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">b) Establecer y normalizar los principios y bases de ejecución comunes a todas las subvenciones, incrementando los niveles de eficacia y eficiencia en la gestión del gasto público subvencional.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">c) Optimizar el acceso de los ciudadanos al hecho subvencional con garantías de transparencia, uniformidad de criterio municipal y de libre concurrencia, facilitando a los ciudadanos todos los datos, cuantías, objetivos, criterios y procedimientos para poder ser beneficiario de subvenciones.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">d) Racionalizar la gestión municipal de las subvenciones con la valoración de los aspectos de transversalidad, eficacia y eficiencia en la gestión de las diferentes líneas de ayudas.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">e) Impulsar la simplificación administrativa y la transparencia</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">3.- CONTENIDO DEL PLAN</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">En el Anexo se desglosa la actividad del Ayuntamiento de Sant Josep de sa Talaia, estableciendo las diferentes líneas de subvenciones, su importe máximo, las partidas presupuestarias asignadas, los objetivos y efectos, el plazo para la consecución de estos y sus destinatarios.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">4.- BENEFICIARIOS</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Las subvenciones se concederán en los términos y con la amplitud que establece el art. 11 LGS para los beneficiarios, mediante convocatoria pública o mediante concesión directa, y / o por la firma de convenios de colaboración, a favor de personas físicas o jurídicas, públicas o privadas, comunidades de bienes o cualquier otro tipo de unidad económica o patrimonio separado que, aún careciendo de personalidad jurídica, pueda llevar a cabo los proyectos, actividades o comportamientos que se encuentren en la situación que motiva la subvención.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">5.- GESTIÓN Y EFICACIA</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Para la consecución de los objetivos es necesario que cada Área, Centro de Gestión, Unidad Administrativa u Organismo dependiente sea quien gestione en su ámbito la concesión de las subvenciones en los términos que se señalan en la LGS, correspondiendo a Intervención Municipal la fiscalización de las mismas, lo que conlleva la necesidad de coordinar las acciones.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">6.- COSTES PREVISIBLES Y FINANCIACIÓN</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Previa a la concesión de cualquier tipo de subvención se procederá a la tramitación de la autorización del gasto correspondiente. No podrán otorgarse subvenciones por cuantía superior a la que se determine presupuestariamente.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Los créditos presupuestarios tienen carácter limitativo y vinculante por lo que no se podrán adquirir compromisos de gastos superiores a su importe.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">​​​​​​​</span></span></strong><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">7.-CONTROL Y SEGUIMIENTO DEL PLAN ESTRATÉGICO.</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El control y seguimiento del presente Plan Estratégico se realizará de forma anual, en dos aspectos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">a) Control económico-financiero de las subvenciones concedidas. Está encomendado a la Intervención General del Ayuntamiento de Sant Josep de sa Talaia, y se realizará en las condiciones recogidas en la legislación vigente.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">b) Control y seguimiento del Plan, se encomienda a la Junta de Gobierno Local, para ello, cada una de las Áreas, Centro de Gestión, Unidad Administrativa u Organismo dependiente que gestionan las subvenciones, remitirá en el primer cuatrimestre de cada ejercicio, memoria justificativa con las siguientes especificaciones:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Objeto, entidad beneficiaria e importe subvencionado.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Subvenciones concedidas, justificadas, renunciadas y reintegradas (o en procedimiento de reintegro).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El grado de cumplimiento de sus objetivos específicos, de su plazo de consecución, concretando el número de ciudadanos a los que ha alcanzado la acción subvencionada.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Los costes efectivos en relación a los previsibles.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Conclusiones o valoración global en la que conste la valoración en cuanto a los objetivos perseguidos y la procedencia del mantenimiento o supresión del programa.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Sugerencias para la elaboración del siguiente Plan Estratégico de Subvenciones.</span></span></p> </li> </ul> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">8.-COMISIÓN DE SEGUIMIENTO</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Para el seguimiento y evaluación del Plan Estratégico de Subvenciones se designa a la Junta de Gobierno Local.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">9.-TRANSPARENCIA</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Todas las subvenciones concedidas por el Ayuntamiento serán publicadas en la web municipal, indicando la entidad receptora, cuantía de la misma, y ​​proyecto o acción a la que va destinada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
