    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El apartado 9.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13 de noviembre de 2015 por la que se convocan, subvenciones para las Inversiones no productivas vinculadas a la realización de los compromisos agroambientales y clima, correspondientes a los años 2015-2019, &amp;nbsp;especifica que la resolución expresa se notificará a los interesados mediante su publicación en el &lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt; Islas Baleares &lt;/em&gt;de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 4 de junio de 2020, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;"INFORME PROPUESTA DE RESOLUCIÓN / RESOLUCIÓN DE CAMBIO DE TITULARIDAD&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;En las fechas señaladas en el Anexo I adjunto se publicaron en los BOIB correspondientes las Resoluciones de concesión de la ayuda de Inversiones no productivas R5, en las que se concedía una ayuda al beneficiario señalado en dicho anexo. El plazo máximo para la justificación de la inversión propuesta es de seis meses a partir del día siguiente a la publicación, por lo tanto los plazos acababan los días 04/01/2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Con fecha &lt;/em&gt;&lt;em&gt;24/07&lt;/em&gt;&lt;em&gt;/2019 &amp;nbsp;JUAN OLIVER GORNALS, como representante de AGROMAIA SAT detallado en el anexo I, presentó un escrito en el que solicita subrogar a su favor, los derechos y deberes de la solicitud de ayuda antes mencionada, debido a&lt;/em&gt;&lt;em&gt; &lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;a disolución de la explotación.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Los gestores del Servicio de Ayudas al Desarrollo Rural han comprobado que los solicitantes cumplen todos los requisitos exigidos en el apartado tercero de la Resolución de convocatoria para poder ser beneficiarios de la ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;1. La ayuda se ha solicitado al amparo de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 13 de noviembre de 2015 por la que se convocan, para los años 2015 2019, subvenciones para inversiones no productivas vinculadas a la realización de compromisos de agroambiente y clima. Esta Resolución, en su apartado tercero punto 1, dispone que podrán ser beneficiarios de las ayudas todas aquellas personas físicas o jurídicas o agrupaciones sin personalidad jurídica, que lleven a cabo las actuaciones mencionadas en el apartado cuarto de esta Resolución y, que en el momento de la propuesta de resolución, cumplan uno de los siguientes requisitos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;a) Que sean propietarios de la parcela donde se quieren llevar a cabo las inversiones.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;b) Que sean titulares de una explotación agraria en la que se ubiquen las parcelas donde se quieren llevar a cabo las inversiones.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Las parcelas deberán formar parte de una explotación agraria inscrita en el Registro Interinsular Agrario (RIA), antes de dictarse la propuesta de resolución.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;2. El apartado undécimo de la Resolución de convocatoria, de "cesión y traspaso de la explotación", permite la cesión de una explotación en los términos y condiciones detallados en el citado apartado.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;3. La posibilidad de subrogación o sustitución del interesado en el procedimiento administrativo está prevista en el artículo 4.3 de la ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas: "cuando la condición de Interesado derivase de alguna relación jurídica transmisible, el derecho-habiente sucederá en tal condición cualquiera que sea el estado del procedimiento". Por este motivo, a excepción de los casos de relaciones jurídicas de carácter personal, en derecho administrativo admite la sucesión tan por transmisión "inter vivos" como "mortis causa" siempre que se trate de una situación jurídica transmisible.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;4. El Decreto 64/2005, de 10 de junio, de creación del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA). Vista la Orden de la Consejera de Agricultura y Pesca de 23 de diciembre de 2005, por la que se dispone que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero a partir del 1 de enero de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;5. Ley 39/2015, de 1 de octubre del procedimiento administró común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;6. Resolución de la presidenta de la Agencia de Estrategia Turística de las Islas Baleares, por la que se aprueba una transferencia a Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) para el proyecto ITS2017-24- Paisaje agrario financiado con Fondos para favorecer el turismo sostenible correspondiente al Plan Anual 2017, de 20 de julio de 2018.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Informe - Propuesta de Resolución &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;De acuerdo con la normativa reguladora y la documentación aportada por los solicitantes, se ha comprobado que cumplen con los requisitos exigidos para poder ser beneficiarios de esta ayuda y que se pueden aceptar las subrogaciones en todos los derechos y obligaciones.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Por todo ello, se informa FAVORABLEMENTE del cambio de titular, y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;1. Aprobar el cambio de titular del expediente de la línea de ayudas de Inversiones no productivas siguientes a favor de:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;IMIT 2017_1/130 &amp;nbsp;JUAN OLIVER GORNALS con &amp;nbsp;DNI ***1768**,&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;que asumen formalmente los compromisos adquiridos por los anteriores beneficiarios de la ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;2. Notificar la resolución al interesado.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;3.Contra esta Resolución se podrá interponer recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con lo establece en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y en los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, de régimen jurídico de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
