En fecha 17 de marzo de 2020 el alcalde firma la propuesta provisional de concesión de la subvención. Debido a la aplicación del Real Decreto 463/2020, de 14 de marzo, por el que se declara el estado de alarma para la gestión de la situación de crisis sanitaria ocasionada por el COVID-19, se restringe la libre circulación y el acceso al consistorio. Asimismo, el plazo para presentar alegaciones se suspende mientras se mantenga vigente el citado Real Decreto. Siguiendo las recomendaciones del informe de intervención de día 17 de marzo de 2020, se comunicó la propuesta provisional vía correo electrónico a los solicitantes. Asimismo, y para poder seguir adelante con la tramitación de la subvención se pidió que todos los solicitantes comunicaran su respuesta a la propuesta provisional, manifestando su conformidad o presentación de alegaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Se entiende así que se ha dado cumplimiento al primer párrafo del punto 10 de la convocatoria y ha permitido a todos los solicitantes que formulen alegaciones si así lo consideraban.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. La continuación de este trámite se hace una vez se ha obtenido el visto bueno con la propuesta de concesión remitida a todas las entidades y, de esta forma, se considera que se promoverá la actividad de las entidades una vez pasado el estado de alarma, decretado por el RD 463/2020. Además, la puesta en disposición de parte de las ayudas podrá facilitar la recuperación económica, mediante la adquisición de los bienes y servicios previstos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Informe de la Comisión técnica de evaluación, de 14 de mayo de 2020, sobre las alegaciones presentadas por los solicitantes y nueva propuesta de puntuación y concesión definitiva.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.- FUNDAMENTOS DE DERECHO</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Artículos 6 y 9 del Reglamento de subvenciones del Ayuntamiento de Alaró a las asociaciones deportivas inscritas en el registro municipal, aprobado por el Pleno en fecha 25 de abril de 2019 (BOIB núm. 59, de 02.05.2019).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Ley 38/2003, de 17 de noviembre, general de subvenciones, que regula la concesión de subvenciones en régimen de concurrencia competitiva.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Aplicación 341-48901 del Presupuesto general para el año 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.- ACUERDO</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Vista la propuesta del concejal delegado de deportes y fiestas Gabriel Rosselló Cirer, de 1 de junio de 2020, en ejercicio de la atribución conferida por el artículo 9 del reglamento se acuerda por unanimidad:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1º- Desestimar las alegaciones presentadas por Futbol Sala Alaró y Alaró Vòlei Club Esportiu; estimar las alegaciones presentadas por Club Bàsquet Alaró y estimar parcialmente las alegaciones presentadas por Unió Esportiva Atlètic Alaró de acuerdo con el informe de la comisión técnica de evaluación, adjuntando la transcripción que se asume en su totalidad:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<em>Alegaciones presentadas por Futbol Sala Alaró.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>La Comisión propone DESESTIMAR las alegaciones, por los siguientes motivos:</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Respecto a la documentación a presentar para valorar los criterios de puntuación, el punto 7 del reglamento dice:</em></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">• <em>Proyecto detallado de la actividad o programa para la que se solicita la subvención, donde conste: justificación, objetivos, población a la que va dirigida, número de beneficiarios, metodología, actividades a realizar, medios técnicos, personales y materiales necesarios, calendario de realización, evaluación y presupuesto desglosado (ingresos previstos y gastos). Relación contractual en el caso de subvenciones de mejora de bienes inmuebles.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>De acuerdo con este punto el requisito que se exige a las entidades es la presentación del proyecto, con la información necesaria para realizar la valoración de los criterios. Si además las entidades aportan documentación adicional que permita una valoración más precisa como por ejemplo las fichas federativas de los jugadores y se da el caso de que la información del proyecto y de la documentación adjunta no coinciden se tendrá en cuenta lo que ofrezca información más precisa.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Debemos recordar que el reglamento actual no obliga a las entidades presentar esta documentación adicional, y que todas las entidades han presentado una declaración responsable, que se incluye también sobre el proyecto presentado."</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>"Alegaciones presentadas por Club Bàsquet Alaró</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>La Comisión propone ESTIMAR las alegaciones, por los siguientes motivos:</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Criterio J: Por error de la Comisión no se valoró la organización de dos torneos que sí aparecen en el proyecto presentado. Así pues, recomendamos estimar esta alegación y que la nueva puntuación por este criterio sea de 20 puntos.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>La comisión técnica de evaluación recomienda <strong>otorgar 20 puntos</strong> más a Club Bàsquet Alaró, lo que resultaría una <strong>puntuación total de 43,4 puntos</strong>. "</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>"Alegaciones presentadas por Alaró Vòlei Club Esportiu</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Esta Comisión propone DESESTIMAR las alegaciones, por los siguientes motivos:</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Criterio C: Cada equipo federado presentado en el proyecto sólo puede recibir una puntuación entre los criterios B, C o G y evitar una doble puntuación. Interpretamos que estos criterios son exclusivos y que al otorgar 10 puntos por equipo federado femenino o mixto no se puede además otorgar 2 o 3 puntos adicionales más teniendo en cuenta si es un equipo federado de base o no base ya que resultaría desproporcionado. Por lo tanto, la comisión ha valorado incorporar dentro del criterio G todos aquellos equipos federados femeninos o mixtos y valoró incorporar dentro del criterio B o C, según el caso, a aquellos equipos federados que no lo son.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Por eso no han puntuado en este criterio al considerar que no se puede otorgar una doble puntuación por un mismo equipo. Por lo tanto, recomendamos desestimar esta alegación."</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>"Alegaciones presentadas por Unió Esportiva Atlètic Alaró</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Esta Comisión propone ESTIMAR PARCIALMENTE las alegaciones, por los siguientes motivos:</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Criterios C y G: Por un lado, la Comisión admite un error en la valoración de los equipos ya que no se valoró correctamente uno de los equipos mixtos, que se contó como equipo base. Así pues la Comisión recomienda restar 3 puntos al criterio C y sumar 10 puntos al criterio G.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Criterios D y E: Con respecto a la valoración de los miembros la comisión ha tenido en cuenta la categoría del equipo en que estaban asignados, entendiendo que lo más relevante es la categoría donde el miembro juega o practica el deporte.
