    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez resueltas las reclamaciones y aprobada definitivamente la ordenanza reguladora del precio público por reproducción y comunicación pública de documentos del fondo fotográfico Bestard/Cerdà, en sesión plenaria de fecha 28 de mayo de 2020, se publica el texto íntegro de la Ordenanza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;39.- ORDENANZA REGULADORA DEL PRECIO PÚBLICO POR REPRODUCCIÓN Y COMUNICACIÓN PÚBLICA DE DOCUMENTOS DEL FONDO FOTOGRÁFICO BESTARD /CERDÀ.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 1.- Establecimiento&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento de Pollença, haciendo uso de las facultades que a tal efecto le confiere el RDL 2/2004 que aprueba el Texto refundido de la Ley reguladora de las haciendas locales (TRLRHL), y en conformidad con el que estipula el art. 41 y 47 y 127 del TRLRHL, establece un precio público por la reproducción y comunicación pública de documentos, sin carácter de expediente administrativo, del fondo fotográfico Bestard /Cerdà.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 2 – Hecho Imponible&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El hecho imponible de este precio público está constituido por los servicios de reproducción y comunicación pública de documentos del fondo fotográfico Bestard /Cerdà según su uso final.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 3&lt;/strong&gt;.- &lt;strong&gt;Obligación de pago&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Están obligados al pago de este precio público regulado en esta Ordenanza las personas físicas y/o jurídicas que se benefician de los derechos de reproducción o/y comunicación pública de documentos del fondo fotográfico Bestard /Cerdà.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 4.- Responsables&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Responderán de la deuda tributaria los deudores principales juntamente a otras personas o Entidades. A estos efectos se consideran deudores principales los obligados tributarios del apartado 2 del artículo 35 de la Ley 58/2003, de 17 de diciembre, General Tributaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a las cuales se refieren los artículos 42 LGT.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Serán responsables subsidiarios los administradores de las sociedades y los síndicos, interventores o liquidadores de quiebras, concursos, sociedades y entidades en general en el supuestos y con el alcance que señala el artículo 43 LGT.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 5.-&lt;/strong&gt; &lt;strong&gt;Tarifas&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El precio público que regula esta ordenanza se accionará de conformidad con las tarifas siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Reproducciones y comunicaciones públicas de documentos de cualquier tipo y que el Archivo Municipal del Ayuntamiento de Pollença&amp;nbsp; tiene los derechos de explotación derivados de la propiedad intelectual:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;*Estos importes están exentos de IVA, de acuerdo en el punto 14 a) del artículo 20 de la Ley 37/1992, de 28 de diciembre, del Impuesto sobre el Valor Añadido.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todas las tarifas detalladas anteriormente son por el uso concreto solicitado.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 6. Devengo&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La obligación de pago del precio público nace desde el momento en que se adquiere el material, se transmite la reproducción o se realiza la comunicación del documento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 7. Normas de Gestión.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pago se realizará en el momento de la adquisición, la transmisión y previo a la comunicación y se exigirán en régimen de autoliquidación. Será gestionado por la Biblioteca Municipal, y de forma excepcional por las oficinas de turismo. El ayuntamiento podrá exigir el depósito previo del importe total o parcial mediante ingreso bancario al número de cuenta que se facilite, tanto en la Biblioteca como las Oficinas Municipales de Turismo, tarjeta de crédito o a través de la web del Ayuntamiento, en el momento que esté operativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el caso del material informático, el pago se hará en el momento de la adquisición.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 8. Modificación.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En conformidad con el que prevé el artículo 47.1 del Texto Refundido del TRLRHL, en relación con el artículo 23.2b) de la Ley Reguladora de las Bases de Régimen Local, se delega en la Junta de Gobierno la fijación o modificación de la cuantía de los precios públicos por usuario.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 9. Infracciones y Sanciones.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En todo el que refiere a la calificación de infracciones tributarias, así como a las sanciones que correspondan en cada caso, se estará al que disponga en los artículos 181 y siguientes de la Ley 58/2003, de 17 de diciembre, General Tributaria, así como las disposiciones que lo desarrollen, según el que dispone el artículo 11 del Texto Refundido de la Ley Reguladora de Haciendas Locales, aprobado por el Real decreto Legislativo 2/2004, de 5 de marzo (TRLRHL, en adelante).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A la vegada, podrán exigirse por procedimiento administrativo la vía de constreñimiento por las deudas de este servicio, en conformidad con los artículo 46.3 del TRLRHL y la normativa de recaudación que sea de aplicación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición final. Aprobación y vigencia&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta ordenanza entrará en vigor una vez publicado su texto íntegro al BOIB, en la forma y plazos previstos a los artículos 103 y 113 de la Ley 20/2006, de 15 de diciembre, Municipal y del Régimen Local de las Islas Baleares, en conformidad con el establecido al artículo 70.2 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el presente acuerdo definitivo las personas interesadas podrán interponer recurso contencioso administrativo en el plazo de dos meses contados a partir del día siguiente al de su publicación en el BOIB.&lt;/span&gt;&lt;/p&gt;
