font-size:12px"><strong>"PRIMERO.</strong> La modificación de la ordenanza siguiente:</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>"ORDENANZA Nº 29&nbsp;<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></strong></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>REGULADORA DEL PRECIO PÚBLICO POR LA PRESTACIÓN DE SERVICIOS SOCIOEDUCATIVOS</strong></span></p> <p><strong>Artículo 1 - Naturaleza, objeto y fundamento</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Haciendo uso de las facultades concedidas por el artículo 117 del RDL 2/2004, de 5 de marzo, regulador de las Haciendas Locales, y por el artículo 105 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, este Ayuntamiento establece el precio público por la prestación de servicios municipales, que se regirán por la presente Ordenanza las normas de las cuales atienden lo previsto en los artículos 41 a 48 del RDL 2/2004.</span></p> <p><strong>Artículo 2 - Objeto</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Constituye el objeto del precio público la prestación, por parte del Ayuntamiento, de servicios socioeducativos.</span></p> <p><strong>Artículo 3 - Obligados al pago</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Son sujetos obligados al pago las personas o entidades solicitantes de las prestaciones del servicio o, si no es así, los padres o tutores de los menores beneficiados.</span></p> <p><strong>Artículo 4 - Obligación de pago</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La obligación de pagar los precios públicos regulados en esta Ordenanza, nace:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">a) En las actividades de taller, formativas o de enseñanza, que no tengan la consideración de actividades sociales básicas en el comienzo del curso.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Los derechos de inscripción en las actividades infantiles se devengarán con la formalización de la matrícula.</span></p> <p><strong>Artículo 5 - Base de gravamen</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Se adopta como base del presente precio público el número de personas que se beneficien de la prestación de los servicios.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Ayuntamiento podrá eximir del pago de los precios públicos regulados en esta Ordenanza a los beneficiarios de la prestación de los servicios, en aquellos casos en que los usuarios cumplan objetivos de prevención específica o de reinserción social, previo informe técnico previo que los justifique.</span></p> <p><strong>Artículo 8 - Bonificaciones</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Se establece una bonificación del 10% en las cuotas de la escuela de verano, siempre que se matriculen dos miembros de la misma familia; y de un 30% si son tres los miembros matriculados.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Ayuntamiento de Son Servera, de manera excepcional, ante situaciones derivadas de fuerza mayor, podrá bonificar por un período de tiempo determinado, hasta un 50% las cuotas, siempre que el Pleno de la Corporación, a propuesta de la Alcaldía, lo apruebe por voto favorable de la mayoría simple de sus miembros. *</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">* Esta bonificación se practicará (o no) simultáneamente con otras previstas en esta Ordenanza.</span></p> <p><strong>NORMAS DE GESTIÓN</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 9 - Cobro de cuotas </strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Las cuotas, una vez ingresadas y una vez comenzado el taller o actividad correspondiente, no serán devueltas, a menos que la actividad no se pueda desarrollar por causa imputable al centro.</span></p> <p><strong>Artículo 10 - Devengo</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Las deudas por estos precios públicos se exigirán desde el mismo momento en que se inicie la prestación de servicio o actividad que lo justifican.</span></p> <p><strong>Artículo 11 - Anticipos</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El Ayuntamiento podrá exigir, igualmente, la anticipación o depósito previo del importe total o parcial del precio público.</span></p> <p><strong>Artículo 12 - Lugar de pago</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El pago del precio público se debe realizar por los beneficiarios de los servicios o actividades a través de las entidades bancarias designadas por el Ayuntamiento. </span></p> <p><strong>DISPOSICIÓN FINAL</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La presente Ordenanza, la redacción definitiva de la cual ha sido aprobada por el Pleno de la Corporación en sesión celebrada el día 19 de julio de 2012, entrará en vigor una vez efectuada su publicación definitiva en el Boletín Oficial de las Islas Baleares (BOIB nº 152 de 18 de octubre de 2012), y permanecerá en vigor hasta la su modificación o derogación expresas.
