De acuerdo con lo establecido en el artículo 17 del Real Decreto Legislativo 2/2004 por el que se aprueba el Texto refundido de la Ley Reguladora de las Haciendas Locales, el acuerdo se entiende definitivamente adoptado y se publica su texto íntegro.</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ORDENANZA REGULADORA DEL PRECIO PÚBLICO POR LAS DIFERENTES PRESTACIONES SOCIALES: ESTANCIAS EN EL CENTRO DE DÍA, SERVICIO DE AYUDA DOMICILIARIA, SERVICIO DE COMIDA A DOMICILIO Y SERVICIOS DE TELEASISTENCIA</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Concepto</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 1</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.1. Conforme a lo previsto en el artículo 127 y el artículo 41, ambos del R.D. 2/2004 de 5 de marzo, texto refundido de la Ley Reguladora de las Haciendas Locales, el Ayuntamiento establece el precio público por el servicio de diferentes prestaciones sociales: Servicio de Centros de Día, Servicio de Ayuda Domiciliaria, Servicio de comida a domicilio y Teleasistencia.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Obligados al pago</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 2</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.1. Están obligados al pago del precio público regulado en la presente ordenanza los beneficiarios de las prestaciones de los servicios, o aquellas que ostenten su tutoría legal.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Cuantía</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 3</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.1. La cuantía del precio público regulado en esta ordenanza es establecido en las tarifas recogidas en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.2. Los gastos derivados de alquiler o hipoteca de la vivienda habitual se podrán descontar de los ingresos, siempre y cuando el núcleo familiar no tenga ninguna otra vivienda en propiedad.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.4. La persona beneficiaria o la que solicite un servicio aportará la documentación necesaria para poder determinar la cuota definitiva.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><strong>Normas de gestión</strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ARTÍCULO 4</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.1. El equipo técnico del Departamento de Bienestar Social, una vez comprobada la documentación, asignará la plaza por orden de antigüedad. Para casos excepcionales, se elevará propuesta a Junta de Gobierno Local con el informe técnico que lo justifique.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4.2. El precio público se considerará devengado simultáneamente a la prestación del servicio y la Tesorería del Ayuntamiento confeccionará y cobrará por mensualidades vencidas los recibos.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4.3. El pago del recibo mensual se realizará por el sistema de domiciliación en entidades de crédito y ahorro que el Ayuntamiento designe como colaboradoras, de acuerdo con las siguientes condiciones:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Las personas obligadas al pago de cualquier servicio presentarán al profesional técnico de referencia el documento de domiciliación según modelo oficial, donde especificarán sus datos de identificación personal, número de cuenta y entidad bancaria y concepto que se desea domiciliar.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Las domiciliaciones de pago tendrán validez por tiempo indefinido. Se abonarán a partir de la fecha de alta del servicio, hasta que se presente la instancia solicitando la baja. Tanto la solicitud de alta como de baja deben presentarse en los registros de entrada del Departamento de Bienestar Social o mediante la Sede Electrónica del Ayuntamiento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.4. Un retraso en el pago de más de dos mensualidades, sin motivo que lo justifique, significará la baja del servicio. El Ayuntamiento comunicará con 15 días de antelación la baja por escrito.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.5.
