&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. En fecha 9 de marzo de 2020, el director general de Atención a la Dependencia emitió un informe justificativo relativo a la convocatoria del concierto del servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave, para los años 2020-2021&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. En fecha 9 de marzo de 2020&lt;/span&gt;&lt;span style="color:#000000"&gt;, la consejera de Asuntos Sociales y Deportes resolvió iniciar el expediente de concertación del &lt;/span&gt;&lt;span style="color:#000000"&gt;servicio &lt;/span&gt;&lt;span style="color:#000000"&gt;de apoyo en el domicilio para personas con diagnóstico de salud mental grave, para los años 2020-2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. La Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. El Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. El Decreto 66/2016, de 18 de noviembre, por el que se aprueba la Cartera básica de servicios sociales de las Illes Balears 2017-2020 y se establecen principios generales para las carteras insulares y locales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5. El Decreto 86/2010, de 25 de junio, por el que se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6. El Decreto 9/2019, de 2 de julio, de la presidenta de las Illes Balears, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. El Decreto 21/2019, de 2 de agosto, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8. El Acuerdo del Consejo de Gobierno de 21 de febrero de 2020 por el que se aprueba la previsión de las prestaciones y los servicios que se tienen que concertar durante el año 2020 y se declaran los servicios de interés económico general (BOIB núm. 23, de 22 de febrero), rectificado por el Acuerdo del Consejo de Gobierno de 28 de febrero de 2020 (BOIB núm. 26, de 29 de febrero).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Convocar la acción concertada y establecer el procedimiento de la convocatoria para el &lt;/span&gt;&lt;span style="color:#000000"&gt;servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave, para los años 2020-2021,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de acuerdo con el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Aprobar el &lt;/span&gt;&lt;span style="color:#000000"&gt;Pliego general de condiciones técnicas para la conciertación, entre la Consejería de Asuntos Sociales y Deportes y entidades del tercer sector, del servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave, para los años 2020-2021, &lt;/span&gt;&lt;span style="color:#000000"&gt;que se puede consultar en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Publicar esta Resolución en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante la consejera de Asuntos Sociales y Deportes en el plazo de un mes contador desde el día siguiente de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;También se puede interponer un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contadores desde el día siguiente de la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. Objeto y ámbito de aplicación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.1. Se establece el procedimiento de convocatoria &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;el&lt;/span&gt;&lt;span style="color:#000000"&gt; concierto del &lt;/span&gt;&lt;span style="color:#000000"&gt;servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave, para los años 2020-2021,&lt;/span&gt;&lt;span style="color:#000000"&gt; y se dicta al amparo de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears, y del Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.2. Se sujetan a este procedimiento los conciertos de plazas del servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave en las Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;span style="color:#000000"&gt;Este servicio está recogido en el punto 2.6.4 del anexo del Decreto 66/2016, de 18 de noviembre, por el que se aprueba la Cartera básica de servicios sociales de las Illes Balears 2017-2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Órgano instructor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El órgano instructor del procedimiento es la Dirección General de Atención a la Dependencia&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. Lugar y plazo de presentación de solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3.1. El plazo para presentar las solicitudes es d&lt;/span&gt;&lt;span style="color:#000000"&gt;e siete días há&lt;/span&gt;&lt;span style="color:#000000"&gt;biles contadores desde el día siguiente que se haya publicado esta convocatoria en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3.2. De acuerdo con lo que establece el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, los documentos se pueden dirigir a los órganos de la Administración autonómica mediante los canales siguientes (entre otros):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) De manera telemática, por medio del Registro electrónico común (REC) de la Administración General del Estado (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;https://rec.redsara.es&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) (obligatoriamente para los sujetos obligados a relacionarse electrónicamente con las administraciones de acuerdo con el artículo 14.2 y 14. 3 de la Ley 39/2015, y opcionalmente para las personas físicas).Para poder llevar a cabo un registro mediante el REC, hay que disponer de un certificado electrónico o de DNI electrónico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) De manera presencial, en la sede del Servicio de Atención a la Discapacidad, ubicado en la calle &lt;/span&gt;&lt;span style="color:#000000"&gt;de Joan Crespí, 11, de Palma, o en cualquiera de los lugares que establecen el artículo 37.1 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y el artículo 16.4 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Por correo postal. En este caso, se han de presentar los documentos dentro de un sobre abierto, a fin de que el personal de la oficina de correos pueda indicar, mediante el sello oficial, el lugar, la fecha y la hora exacta en que se ha efectuado el registro. Estos datos también quedarán anotados en el resguardo justificativo de la presentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Si la solicitud se presenta en un lugar diferente de la sede del Servicio de Atención a la Discapacidad, se tiene que enviar la hoja de la solicitud, con el sello de registro de entrada, al Servicio de Atención a la Discapacidad, &lt;/span&gt;&lt;span style="color:#000000"&gt;por &lt;/span&gt;&lt;span style="color:#000000"&gt;correo electrónico (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;atenciodiscapacitat@dgad.caib.es&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;), en el plazo máximo de las 24 horas siguientes al final del plazo hábil de presentación. Del mismo modo, si se envía por correo certificado, se tiene que envi&lt;/span&gt;&lt;span style="color:#000000"&gt;ar por correo electró&lt;/span&gt;&lt;span style="color:#000000"&gt;nico la hoja de la solicitud, fechada y sellada por la oficina de correos, en que conste que se ha remitido dentro del plazo hábil de presentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Requisitos de las entidades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4.1. Los requisitos que tienen que cumplir las entidades que se presenten a la convocatoria de este concierto social son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Tener el servicio &lt;/span&gt;&lt;span style="color:#000000"&gt;acreditado en conformidad con&lt;/span&gt;&lt;span style="color:#000000"&gt; el Decreto 86/2010, de 25 de junio, por el que se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población, y la normativa&lt;/span&gt;&lt;span style="color:#000000"&gt; complementaria insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) Tener una experiencia mínima de un año en materia de servicios &lt;/span&gt;&lt;span style="color:#000000"&gt;de apoyo en el domicilio para personas con diagnóstico de salud mental en el ámbito de los servicios sociales de las Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Tener el &lt;/span&gt;&lt;span style="color:#000000"&gt;carácter de entidad del tercer sector social, en conformidad con lo que establece el artículo 5.1 de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4.2. Así mismo, las entidades han de cumplir los requisitos mínimos que se establecen en despliegue del título VII de la Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears, así como los requisitos que fijan el artículo 5 de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears, y el artículo 4.2 del Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Documentación que se tiene que presentar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.1. Las entidades interesadas que cumplan los requisitos que establece el punto 4 de esta convocatoria tienen que formular una solicitud, que tiene que firmar la persona representante legal de la entidad. El modelo de solicitud se encuentra disponible &lt;/span&gt;&lt;span style="color:#0000ff"&gt;&lt;span style="color:#000000"&gt;en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.2. Las entidades tienen que presentar una solici&lt;/span&gt;&lt;span style="color:#000000"&gt;tud para el servicio &lt;/span&gt;&lt;span style="color:#000000"&gt;de apoyo en el domicilio&lt;/span&gt;&lt;span style="color:#000000"&gt; que gestionen y tienen que indicar&lt;/span&gt;&lt;span style="color:#000000"&gt; el número de plazas que ofrezcan para concertar con la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.3. A la solicitud se tiene que adjuntar la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Certificado de acreditación del servicio a concertar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) Acreditación de la experiencia mínima &lt;/span&gt;&lt;span style="color:#000000"&gt;de un año en materia de se&lt;/span&gt;&lt;span style="color:#000000"&gt;rvicios de apoyo en el domicilio para personas con diagnóstico de salud mental en el ámbito de los servicios sociales de las Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt;, mediante la resolución de autorización del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Declaración responsable de que la entidad no está sometida a las prohibiciones de contratar con la Administración, de acuerdo con el artículo &lt;/span&gt;&lt;span style="color:#000000"&gt;71 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, &lt;/span&gt;&lt;span style="color:#000000"&gt;ni a ninguno de los supuestos de prohibición para ser beneficiaria de subvenciones, establecidos en los apartados 1 y 2 del artículo 10 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;d) Declaración responsable de no incurrir en ninguna de las prohibiciones que establece el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, y de no haber sido sancionada por resolución firme en los últimos cuatro años por la comisión de infracciones graves o muy graves en materia de relaciones laborales, ocupación, empresas usuarias de empresas de trabajo temporal, seguridad social, emigración, movimientos migratorios y trabajo de extranjeros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;e) Acreditación de solvencia financiera, según el documento disponible en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;f) Acreditación de solvencia técnica, según el documento disponible en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;g) Certificado de estar al corriente en las obligaciones tributarias y de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;h) Declaración del número&lt;/span&gt;&lt;span style="color:#000000"&gt; total&lt;/span&gt;&lt;span style="color:#000000"&gt; de plazas &lt;/span&gt;&lt;span style="color:#000000"&gt;acreditadas&lt;/span&gt;&lt;span style="color:#000000"&gt;, firmad&lt;/span&gt;&lt;span style="color:#000000"&gt;a por la dirección del servicio, &lt;/span&gt;&lt;span style="color:#000000"&gt;con la diferenciación entre&lt;/span&gt;&lt;span style="color:#000000"&gt; disponibles y no disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;i) Acreditación del carácter de entidad del tercer sector social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;j) Declaración, firmada por el responsable de la entidad, de que el servicio cumple la normativa general o específica aplicable, tanto por la naturaleza jurídica de la &lt;/span&gt;&lt;span style="color:#000000"&gt;entidad como por el tipo de servicio objeto de concertación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;k) Acreditación de la disposición de los medios y los recursos suficientes para garantizar el cumplimiento de las condiciones previstas en el acuerdo de acción concertada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;l) Comunicación, a efectos de la acreditación preceptiva, de los cambios de accionariado o de titularidad, para preservar la identidad institucional que haya justificado el acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.4. La presentación de la solicitud supone que la entidad autoriza a los técnicos de la Dirección General de Atención a la Dependencia para que puedan pedir a otras administraciones cualquier documentación, los datos y los informes que consideren necesarios para tramitar el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tramitación de los conciertos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.1. Los servicios técnicos de la Dirección General de Atención a la Dependencia tienen que examinar las solicitudes y la documentación adjunta para determinar si cumplen los requisitos que establecidos en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.2. &lt;/span&gt;&lt;span style="color:#000000"&gt;En el supuesto de que las solicitudes no cumplan los requisitos legales o los que exige esta convocatoria o no incorporen la documentación mencionada en el apartado anterior, se requerirá la entidad interesada para que, en el plazo de diez días hábiles, enmiende el defecto o aporte la documentación que falta, con la indicación de que, si no lo hace, se considerará que desiste de su petición, con la resolución previa que se tiene que dictar en los términos que dispone el artículo 21 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.3. Se tiene que resolver e&lt;/span&gt;&lt;span style="color:#000000"&gt;l procedimiento de concertación de acuerdo con los criterios siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Si el cómputo total de plazas que ofrecen las entidades según cada nivel de intensidad no supera el número total máximo de plazas previstas en el servicio y, por lo tanto, hay disponibilidad presupuestaria suficiente para atender toda la oferta, las plazas se adjudicarán directamente a las entidades solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Si el cómputo total de plazas que ofrecen las entidades según cada nivel de intensidad supera la disponibilidad presupuestaria, se actuará según los criterios de preferencia que prevé la Ley 12/2018 en el artículo 6.3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) En caso de que se produzca una renuncia por parte de alguna entidad, las plazas que haya ofrecido se distribuirán de la misma manera entre el resto de entidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Formali&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;zación de los conciertos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7.1. Los conciertos que se establecen al amparo de esta convocatoria se han de formalizar mediante un documento administrativo denominado &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;acuerdo de acción concertada&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;en el cual se haga constar el contenido mínimo previsto en el artículo 8 de la Ley 12/2018, así como las características concretas del servicio y otras circunstancias derivadas de la Ley 4/2009, de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Ley 12/2018, de la normativa&lt;/span&gt;&lt;span style="color:#000000"&gt; de despliegue y del Pliego general de condiciones técnicas del concierto. Los acuerdos de acción concertada se tienen que publicar en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; en conformidad con lo que establece la letra &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; del artículo 3 de la Ley 12/2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7.2. En el momento de formalizar el concierto, se tiene que presentar una declaración responsable de que se continúan cumpliendo los requisitos para poder concertar el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Plazas del servicio y distribución territorial&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8.1. La previsión del número total máximo de plazas para concertar es de 149 (80 de baja intensidad y 69 de alta intensidad) en la isla de Mallorca para un periodo de un año&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8.2. Vigencia del concierto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El régimen del concierto se iniciará el 1 de julio de 2020 y finalizará el 30 de junio de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. Presupuesto y precio máximo del servicio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10.1. El importe máximo estimado por asignar es de 2.453.589,60 €&lt;/span&gt;&lt;span style="color:#000000"&gt; (exen&lt;/span&gt;&lt;span style="color:#000000"&gt;to de IVA)&lt;/span&gt;&lt;span style="color:#000000"&gt;, que se distribuirá entre las anualidades de 2020 y 2021. En todo caso, este valor estimado tiene carácter orientativo y no vinculante. El gasto real quedará limitado por el número total de plazas que ofrezca la entidad y por los servicios que requiera efectivamente la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10.2. Este importe se indica únicamente a efectos de publicidad y no supone ningún compromiso de gasto. Por eso, no consta ninguna consignación presupuestaria, que se tiene que acreditar en el momento en que se materialice el servicio de concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10.3. El coste estipulado es de 1.013,50 €/mes por plaza de baja intensidad y de 1.788,20 €/mes por plaza de alta intensidad, de acuerdo con la Resolución de la consejera de Asuntos Sociales y Deportes de 3 de septiembre de 2019 por la que se actualizan los precios de los servicios concertados, derivada de los incrementos salariales en los convenios colectivos por los cuales se calculan los precios de estos servicios (BOIB núm. 122, de 5 de septiembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. Condiciones técnicas de ejecución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;11.1. &lt;/span&gt;&lt;span style="color:#000000"&gt;Las condiciones técnicas de ejecución se tienen que ajustar al Decreto 86/2010, de 25 de junio, por el que se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población, al Decreto 66/2016, de 18 de noviembre, por el que se aprueba la Cartera básica de servicios sociales de las Illes Balears 2017-2020 y se establecen principios generales para las carteras insulares y locales, y a la normativa insular complementaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;11.2. &lt;/span&gt;&lt;span style="color:#000000"&gt;El Pliego general de condiciones técnicas detalla el objeto, los derechos y las obligaciones de ambas partes, los servicios que se tienen que prestar, los criterios de intervención con los usuarios, los medios que tiene que aportar la entidad concertada y el sistema de coordinación con la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;11.3. Las aplicaciones informáticas del Servicio de Atención a la Discapacidad son las únicas válidas para gestionar las plazas del servicio y para cualquier uso aplicable que se derive de la ejecución de este concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. Seguimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;12.&lt;/span&gt;&lt;span style="color:#000000"&gt;1. &lt;/span&gt;&lt;span style="color:#000000"&gt;Los técnicos del servicio &lt;/span&gt;&lt;span style="color:#000000"&gt;de apoyo en el domicilio para personas con diagnóstico de salud mental grave&lt;/span&gt;&lt;span style="color:#000000"&gt; son los responsables del seguimiento de los casos atendidos y se tienen que coordinar con &lt;/span&gt;&lt;span style="color:#000000"&gt;el Servicio de Atención a la Discapacidad&lt;/span&gt;&lt;span style="color:#000000"&gt; y los servicios sociales comunitarios básicos, de salud, educativos o otros que se requieran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;12.2. Los técnicos del&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Servicio de Atención a la Discapacidad&lt;/span&gt;&lt;span style="color:#000000"&gt; pue&lt;/span&gt;&lt;span style="color:#000000"&gt;den hacer visitas de comprobación del funcionamiento del servicio y requerir documentación cuando lo consideren necesario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;12.3. La entidad concertada tiene que facilitar las actuaciones de seguimiento y comprobación que lleve a cabo la Dirección General de Atención a la Dependencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;12.4. Así mismo, la entidad concertada tiene que facilitar toda la información que le requieran el órgano instructor, la Intervención General de la Comunidad Autónoma de las Illes Balears, la Sindicatura de Cuentas u otros órganos de control externo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. Obligaciones de las entidades concertadas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Mediante el concierto social, las entidades que presten el servicio se obligan a cumplir el Pliego general de condiciones técnicas, que establece las obligaciones de las entidades concertadas, y las normas establecidas en el título VII de la Ley 4/2009, en el capítulo I de la Ley 12/2018 y en los decretos de despliegue y de aplicación correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14. Penalidades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El incumplimiento de las condiciones previstas para la prestación del servicio puede dar lugar a la imposición de penalizaciones, de acuerdo con el Pliego general de condiciones técnicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15. Criterios de acceso de los usuarios y lista de espera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;15.1. Los criterios de acceso de los usuarios y la lista de espera del servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave se rigen de acuerdo con los capítulos II y III del Decreto 7/2016, de 12 de febrero, por el que se regulan el acceso al servicio ocupacional para personas con discapacidad por trastorno mental grave y la gestión de la lista de espera de las plazas de este servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;15.2. Las personas que hayan solicitado el acceso al servicio de apoyo en el domicilio y que forman parte de la lista de espera para iniciar el nuevo servicio serán valoradas por los profesionales del Servicio de Atención a la Discapacidad y derivadas a la entidad prestamista del servicio, con respeto al principio de libre elección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16. Publicidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;16.1. Las entidades de iniciativa privada acogidas al concierto social, junto con su denominación, tienen que hacer constar en la documentación, en todas las comunicaciones (informes, hojas, documentos, trípticos de difusión, mensajes electrónicos, webs, inserciones en prensa, artículos en diarios y en revistas especializadas) y en la publicidad la adscripción funcional del servicio a la red pública de servicios sociales, &lt;/span&gt;&lt;span style="color:#000000"&gt;según las indicaciones del &lt;em&gt;Manual de identidad corporativa&lt;/em&gt; que les facilitará la Administración, siempre con el visto bueno de la Consejería de Asuntos Sociales y Deportes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;16.2. Las entidades de iniciativa privada acogidas al régimen de concierto social tienen que &lt;/span&gt;&lt;span style="color:#000000"&gt;colocar en un lugar visible de sus instalaciones la indicación &lt;/span&gt;&lt;span style="color:#000000"&gt;«Servicio de apoyo en el domicilio concertado con el Gobierno de las Illes Balears» con el logoti&lt;/span&gt;&lt;span style="color:#000000"&gt;po correspondiente, que les proporcionará la Consejería de Asuntos Sociales y Deportes. Así mismo, se tiene que hacer referencia a esta circunstancia en las comunicaciones y en las relaciones que establezcan por escrito con las personas usuarias del servicio concertado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;17. Prerrogativas de la Administración&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;17.1. El órgano instructor del procedimiento de concertación tiene la prerrogativa de interpretarlo y resolver las dudas que surjan durante el cumplimiento. Por otro lado, el órgano competente para resolver el procedimiento tiene, además, la prerrogativa de modificarlo por razones de interés público, acordar la resolución y determinar sus efectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;17.2. Los acuerdos que adopte el órgano resolutorio a partir de las prerrogativas mencionadas ponen fin a la vía administrativa y son inmediatamente ejecutivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;18. Causas de extinción&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Son causas de extinción del acuerdo de acción concertada las que establece el artículo 9 de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19. Jurisdicción competente&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La jurisdicción contenciosa administrativa es la competente para resolver las cuestiones litigiosas relativas a la formalización de esta acción concertada y también las surgidas entre las partes sobre la interpretación, la modificación, el cumplimiento, los efectos y la extinción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
