Que el Consejo de Mallorca gestiona de manera directa el servicio de Inspección Técnica de Vehículos en la isla de Mallorca, y tiene la voluntad de simplificar el cumplimiento de las obligaciones formales y materiales que se derivan y los procedimientos de liquidación de la tasa para la prestación de este servicio. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Que el artículo 27.2 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de&nbsp;las&nbsp;Haciendas Locales establece que las entidades locales pueden establecer convenios de colaboración&nbsp;con entidades, instituciones y organizaciones representativas de los sujetos pasivos de las tasas, con el fin de simplificar el cumplimiento de las obligaciones formales y materiales que se derivan o los procedimientos de liquidación o recaudación.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Que el artículo 7 de la Ordenanza fiscal reguladora de la tasa para la prestación del servicio de ITV aprobada provisionalmente por el Pleno del Consejo de Mallorca de fecha 13 de febrero de 2020 (BOIB&nbsp;n.º 21 de 18 de febrero de 2020) prevé la posibilidad que las administraciones territoriales y administraciones institucionales dependientes, así como las personas físicas y jurídicas que dispongan a su nombre, en el permiso de circulación de un número de vehículos sujetos a la prestación del servicio igual o superior a veinte, puedan acogerse al régimen de liquidación, mediante la suscripción del presente convenio.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">4. margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Ámbito de aplicación</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El presente convenio se circunscribe a la tasa para prestar el servicio de la ITV a cualquier de las estaciones de Mallorca.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Tercera </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Condiciones de acceso al sistema de liquidaciones</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El acceso al sistema de liquidación implica que el contribuyente asume el sistema de notificación electrónica de las resoluciones de aprobación de las liquidaciones y de los documentos de ingreso necesarios para hacer el pago.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Cuarta </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Obligaciones generales y específicas del Consejo Insular de Mallorca</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Corresponde al Consejo de Mallorca la prestación del Servicio i la liquidación al contribuyente con la periodicidad siguiente:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Si el contribuyente es una administración territorial o una administración institucional dependiente de las anteriores, la liquidación y notificación del tributo se efectuará trimestralmente.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Si el contribuyente es una persona física o jurídica titular de veinte vehículos o más, la liquidación y notificación del tributo se efectuará mensualmente.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Las notificaciones al contribuyente derivadas de la gestión de la liquidación se efectuarán, en todo caso, de forma telemática. </span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Quinta </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Obligaciones del contribuyente</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">La administración, entes dependientes i/o empresa privada, asume las siguientes obligaciones:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Cumplir con los pagos, previa emisión y notificación telemática de la liquidación respectiva. Las liquidaciones deberán ingresarse en los términos señalados en el art. 6.2 de Ley 58/2003 General Tributaria, i el ingreso se realizará en las entidades financieras colaboradoras con el Consejo de Mallorca. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">-&nbsp; Proporcionar, potestativamente, una dirección de correo electrónico para que se les avise que tienen a su disposición una notificación electrónica.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Comunicar la flota de vehículos sujetos a la prestación del servicio de que disponen y mantener actualizada esta información, así como los datos fiscales completos y cualquier otra información que el prestador del servicio tenga que conocer.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Colaborar con el Consejo de Mallorca en la detección, diagnóstico y resolución de las incidencias relacionadas con las liquidaciones emitidas, incluyendo si procede, las actuaciones que aseguren la reducción del tiempo de resolución de las incidencias.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Adoptar y cumplir las medidas de seguridad necesarias para proteger debidamente la información y los sistemas asociados a las soluciones tecnológicas incluidas en el mencionado convenio, y aceptar la política de seguridad común que se establezca.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Sexta</span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Medidas de seguimiento</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El seguimiento del presente convenio se llevará a cabo por la Dirección insular de Inspección Técnica de Vehículos y Actividades Clasificadas del Consejo de Mallorca, con domicilio en la calle del General Riera, 113, y teléfonos 971 173 905 / 971 173 558, </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">liquidacions_flotes@conselldemallorca.net // liquidacions_aapp@conselldemallorca.net</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Séptima </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Régimen económico</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Este convenio de colaboración&nbsp;no comporta para las partes firmantes obligaciones económicas al margen de las respectivas liquidaciones.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Octava</span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Procedimiento de adhesión</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El Consejo de Mallorca, a través de su Dirección Insular de ITV, permitirá la adhesión a este Convenio a todas las administraciones territoriales y administraciones institucionales dependientes, así como a las personas físicas y jurídicas que dispongan a su nombre, en el permiso de circulación, de un número de vehículos sujetos a la prestación del servicio igual o superior a veinte.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El sistema para adherirse a este Convenio se hará mediante notificación telemática, a la cual se adjuntará copia de este convenio tipo, y solicitud de adhesión al mismo. Estos documentos estarán publicados en la sede electrónica del Consejo de Mallorca.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Una vez que la Dirección Insular de ITV reciba la solicitud de adhesión al convenio, el Consejero Ejecutivo dictará resolución estimando procedente o no, la petición de adhesión solicitada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4.La resolución estimando procedente la adhesión al convenio, implicará acogerse automáticamente al régimen de liquidación de la tasa para la prestación del servicio de ITV y al sistema de notificación telemática en relación a los trámites derivados de la gestión del tributo.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Novena</span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Vigencia </span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Este convenio se firma por 4 años, a contar desde la fecha en que el Consejo de Mallorca lo apruebe, que pueden prorrogarse por 4 años más por mutuo acuerdo de las partes.</span></span></span></p> <p style="margin-bottom:0px;
