&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;1. Mediante una resolución del consejero de Educación y Cultura de 21 de mayo de 2010 (BOIB núm. 86, de 8 de junio) se autorizó la apertura y el funcionamiento del centro de educación infantil privado de primer ciclo Baberitos, de Es Coll d'en Rabassa (Palma), con el código de centro 07014648 y tres unidades en funcionamiento. La titularidad del centro era de Antònia Palmer Tomás.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;2. Mediante una resolución del consejero de Educación y Universidad de 4 de diciembre de 2015 (BOIB núm. 184, de 19 de diciembre) se autorizó la apertura y el funcionamiento del centro de educación infantil privado de primer ciclo Baberitos Tenis, de Palma, con el código de centro 07015501 y tres unidades en funcionamiento. La titularidad del centro era de Antònia Palmer Tomás.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;3. El 25 de febrero de 2020, la señora Antònia Palmer Tomás, como titular del centro, presentó una solicitud de cambio de titularidad de los centros de educación infantil privados de primer ciclo Baberitos y Baberitos Tenis, de Palma, a la que adjuntó la documentación siguiente: la escritura de constitución de la sociedad de responsabilidad limitada Baberitos Kids, SL, los estatutos de la sociedad y la tarjeta acreditativa del número de identificación fiscal B16641508.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;4. El 13 de marzo de 2020, la jefa del Departamento de Planificación y Centros emitió un informe favorable sobre la autorización del cambio de titularidad de los centros de educación infantil privados de primer ciclo Baberitos y Baberitos Tenis, de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;En el informe se especifica que tal y como dispone la disposición transitoria primera del Decreto 60/2008, los centros docentes ya autorizados para impartir educación infantil de primer ciclo antes de la &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;entrada en vigor d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;e este Decreto&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;,&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;s&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;e &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;han d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;e &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;adaptar a lo que prevé sobre el nombre máximo de plazas escolares, relación profesor-unidad y titulación y acreditación de los profesionales docentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Este es el caso del CEI Baberitos, por lo que es necesario adaptar las ratios de este centro a la normativa vigente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;5. El 16 de marzo de 2020, el director general de Planificación, Ordenación y Centros formuló una propuesta de resolución sobre la autorización del cambio de titularidad de los centros de educación infantil privados de primer ciclo Baberitos y Baberitos Tenis, de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;1. La Ley Orgánica 8/1985, de 3 de julio, reguladora del Derecho a la Educación (BOE núm. 159, de 4 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;2. La Ley Orgánica 2/2006, de 3 de mayo, de Educación (BOE núm. 106, de 4 de mayo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;3. La Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 44, de 3 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;4. El Decreto 60/2008, de 2 de mayo (BOIB núm. 63, de 8 de mayo), por el que se establecen los requisitos mínimos de los centros de primer ciclo de educación infantil, modificado por el Decreto 78/2008, de 11 de julio (BOIB núm. 100, de 19 de julio), y por el Decreto 58/2019, de 26 de julio (BOIB núm. 103, de 27 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;5.&lt;span style="line-height:100%"&gt; El Estatuto de Autonomía de las Illes Balears, aprobado por la Ley Orgánica 1/2007, de 28 de febrero (BOE núm. 52, de 16 de marzo), el cual establece en el artículo 36.2 que, en materia de enseñanza, corresponde a la Comunidad Autónoma de las Illes Balears la competencia de desarrollo legislativo y de ejecución de la enseñanza en toda su extensión, niveles y grados, modalidades y especialidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;6. El Decreto 21/2019, de 2 de agosto, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;Por todo ello, y de acuerdo con la propuesta formulada por la Dirección General de Planificación, Ordenación y Centros el 16 de marzo de 2020, dicto la siguiente &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:center"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;1. Autorizar, con efectos desde el 1 de noviembre de 2109, el cambio de titularidad de los centros de educación infantil privados de primer ciclo Baberitos y Baberitos Tenis, de Palma, que era de Antònia Palmer Tomás y pasa a ser de Baberitos Kids, SL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;2. Determinar que, como consecuencia de esta modificación, los centros quedan configurados de la manera siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;3. Inscribir esta autorización en el Registro de centros docentes (RCD) de la Dirección General de Planificación, Ordenación y Centros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;4. Recordar al centro mencionado que está obligado a cumplir la legislación vigente y a solicitar la revisión oportuna de su configuración cuando se deba modificar cualquiera de los datos que figuran en esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;5. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación, Universidad e Investigación en el plazo de un mes a contar desde el día siguiente de su publicación en el BOIB, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de su publicación en el BOIB, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
