&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. En fecha 13 de marzo de 2020 la presidenta del Consejo de Mallorca aprobó el Decreto de organización de los servicios y funciones del Consejo de Mallorca y de sus organismos autónomos para hacer frente a las medidas de contención por la situación creada por el coronavirus Covid-19.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El artículo 2 de este Decreto establece que se consideran esenciales, en el marco de las actuaciones del Coronavirus Covid-19, respecto a la prestación de servicios y en las medidas que afectan al personal, los servicios siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- los servicios asistenciales que prestan el Instituto Mallorquín de Asuntos Sociales y la Dirección Insular de Igualdad y Diversidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- el servicio de Bomberos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- el servicio de las brigadas de incidencias y emergencias de Carreteras&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Posteriormente, mediante Decreto de 16 de marzo de 2020, por el que se establecen medidas que amplían, intensifican y concretan las establecidas en los decretos de la presidenta, de 13 de marzo de 2020, en el marco de lo establecido en el Real Decreto 463/2020, de 14 de marzo, por el que se declara el estado de alarma para la gestión de la situación de crisis sanitaria ocasionada por Covid-19, se modificó el punto 2 del Decreto mencionado en el punto anterior, de por lo que la relación de los servicios que se consideran esenciales quedaba así:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Los servicios asistenciales que prestan el Instituto Mallorquín de Asuntos Sociales y la Dirección Insular de Igualdad y Diversidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) El servicio de Bomberos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) El servicio de Brigadas de incidencias y emergencias de Carreteras&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Servicios de seguridad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Servicios de limpieza&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f) Servicios de informática y telecomunicaciones&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;g) Servicios de prevención&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El Ministerio de Sanidad aprobó la Orden SND / 271/2020, de 19 de marzo, por la que se establecen instrucciones sobre gestión de residuos en la situación de crisis sanitaria ocasionada por Covid-19&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;FUNDAMENTOS DE DERECHO&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Con motivo de la situación de emergencia de salud pública provocada por Covid-19, el artículo 6 del Real Decreto 463/2020, de 14 de marzo, por el que se declara el estado de alarma, establece que cada administración conservará competencias que le otorga la legislación vigente en la gestión ordinaria de sus servicios para adoptar las medidas que considere necesarias en el marco de las órdenes directas de la autoridad competente a los efectos del estado de alarma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En este contexto, para la gestión de la situación de la crisis sanitaria, la gestión tanto de los residuos domésticos como los que provienen de establecimientos sanitarios o sociosanitarios es esencial para asegurar que esta gestión se haga sin poner en peligro la salud humana y sin dañar el medio ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El artículo 7.1 de la Ley 22/2011, de 28 de julio, de residuos y suelos contaminados, establece que las autoridades competentes adoptarán las medidas necesarias para garantizar la correcta prestación de este servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo ello,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;RESUELVO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Primero&lt;/strong&gt;. Modificar los decretos de 13 de marzo, de organización de los servicios y funciones del Consejo de Mallorca y de sus organismos autónomos para hacer frente a las medidas de contención por la situación creada por el coronavirus Covid-19, y de 16 de marzo, por el que establecen medidas que amplían, intensifican y concretan las establecidas en los decretos de la presidenta, de 13 de marzo de 2020, en el marco de lo establecido en el Real decreto 463/2020, de 14 de marzo, por el que se declara la estado de alarma para la gestión de la situación de crisis sanitaria ocasionada por Covid-19, y declarar esenciales, además de los ya declarados, los siguientes servicios, que se prestan dentro del contrato de la transferencia y gestión de los residuos sólidos urbanos de la isla de Mallorca:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El tratamiento de los lodos procedentes de EDAR (Estaciones depuradoras de aguas residuales).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El tratamiento de RSU en masa (rechazo).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- El tratamiento de desechos de origen animal (DOA)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Segundo&lt;/strong&gt;. Publicar este Decreto en el Boletín Oficial de las Islas Baleares y dar cuenta al Pleno en la primera sesión que se celebre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
