&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Que en el procedimiento &lt;strong&gt;DESPIDO/CESES EN GENERAL 472/2018&lt;/strong&gt; de este Juzgado de lo Social, seguido &lt;strong&gt;a instancia de D. ALBERTO CARLOS BELLO RODRIGUEZ contra MASTER PALMA S.L., MASTER BALEAR DE FRANQUICIAS S.L., sobre DESPIDO y RECLAMACIÓN DE CANTIDAD&lt;/strong&gt;, se ha dictado por S.Sª. &lt;strong&gt;Sentencia nº 32/20 de fecha 05/02/20&lt;/strong&gt;, cuyo &lt;strong&gt;FALLO&lt;/strong&gt; se relaciona:&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;“FALLO&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Que &lt;strong&gt;DEBO ESTIMAR Y ESTIMO&lt;/strong&gt;&amp;nbsp; la demanda promovida por D. Alberto Carlos Bello Rodríguez contra Master Balear de Franquicias S.L en concurso, siendo su administradora Rebeca Juanes Pérez y FOGASA y en su consecuencia &lt;strong&gt;DEBO DECLARAR Y DECLARO&lt;/strong&gt; la improcedencia del despido del que fue objeto la parte actora, declarando &lt;strong&gt;extinguida la relación laboral&lt;/strong&gt; desde la fecha de la presente resolución , condenando a la empresa demandada al abono actor de la cantidad de 42.624 euros en concepto de indemnización,&amp;nbsp; así como los salarios de tramitación&amp;nbsp; desde la fecha del despido( 30 de abril de 2.018) hasta la fecha de la presente resolución, a razón de 59,2 euros por día. Absolviendo al FOGASA de los pedimentos deducidos en su contra, sin perjuicio de las eventuales responsabilidades legales que pudieran serle exigidas de conformidad con lo prevenido en el artículo 33 del Estatuto de los trabajadores.&lt;/em&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Se tiene por desistida&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; a la parte actora respecto a Master Palma S.L.&lt;/em&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Notifíquese la presente resolución a las partes, frente a la que puede interponerse &lt;strong&gt;recurso de suplicación&lt;/strong&gt; ante la Sala de lo Social del Tribunal Superior de Justicia de Baleares, anunciándolo ante este Juzgado por comparecencia o por escrito en el plazo de los &lt;strong&gt;CINCO DÍAS&lt;/strong&gt; hábiles siguientes a la notificación del presente fallo, siendo indispensable que al tiempo de anunciarlo acredite la parte que no ostente el carácter de trabajador y no goce del beneficio de justicia gratuita, haber consignado el importe íntegro de la condena en el banco BANESTO, en la cuenta de este Juzgado, o presentar aval solidario de entidad financiera por el mismo importe. Asimismo, deberá constituir otro depósito por importe de 300 euros en el referido banco, presentando el resguardo correspondiente a este último depósito en la secretaría del Juzgado al tiempo de interponer el recurso y el del primer depósito al momento de anunciarlo, sin cuyos requisitos no podrá ser admitido.&lt;/em&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Así por esta sentencia, de la que se unirá certificación a las actuaciones originales para su notificación y cumplimiento, lo pronuncio, mando y firmo.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Y para que &lt;strong&gt;sirva de NOTIFICACIÓN EN LEGAL FORMA a MASTER PALMA S.L., y a MASTER BALEAR DE FRANQUICIAS S.L., en ignorado paradero&lt;/strong&gt;, expido el presente para su inserción en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se advierte al destinatario que las siguientes comunicaciones se harán fijando copia de la resolución o de la cédula en el tablón de anuncios de la Oficina judicial, salvo el supuesto de la comunicación de las resoluciones que deban revestir forma de auto o sentencia, o cuando se trate de emplazamiento.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La difusión del texto de esta resolución a partes no interesadas en el proceso en el que ha sido dictada sólo podrá llevarse a cabo previa disociación de los datos de carácter personal que los mismos contuvieran y con pleno respeto al derecho a la intimidad, a los derechos de las personas que requieran un especial deber de tutelar o a la garantía del anonimato de las víctimas o perjudicados, cuando proceda.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
