![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">La Junta General, en sesión de día 9 de marzo de 2020, ha adoptado el siguiente Acuerdo:</span></span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">“</span><strong><span style="color:black">Antecedentes</span></strong></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">- Entre les funciones que desarrolla el Consorcio TIC Mallorca, según el artículo 4 de sus estatutos vigentes (BOIB nº 94 de 31/07/2018), está la de facilitar, como ente supramunicipal, la prestación de servicios informáticos y telemáticos que los entes consorciados para ellos solos no pueden o les sería muy costoso prestar.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- Dada la necesidad de aprobar una ordenanza de precios por los servicios complementarios del Consorcio TIC Mallorca para poder financiar los gastos derivados de la prestación de los mismos.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- Dada la memoria justificativa del Gerente del Consorcio TIC Mallorca con fecha de 19 de agosto de 2019 sobre la propuesta de aprobación de una ordenanza reguladora de precios públicos por los servicios complementarios que presta el Consorcio TIC Mallorca.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- Dado el artículo 28 de los Estatutos vigentes del Consorcio TIC Mallorca (BOIB nº 94 de 31 de julio de 2018) que establece el régimen de las aportaciones económicas de los entes consorciados.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- Dado el informe económico del gerente del Consorcio TIC Mallorca con fecha de 19 de agosto de 2019 para el establecimiento de precios públicos a los servicios complementarios del Consorcio TIC Mallorca.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:black">Fundamentos</span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">1. El artículo 15 y siguientes del Real decreto legislativo 2/2004, de 5 de marzo, por el cual se aprueba el texto refundido de la Ley reguladora de las haciendas locales, y el artículo 102.2 de la Ley 20/2006, de 15 de diciembre, municipal y de regimos local de las Islas Baleares, regulan el procedimiento de acuerdo con el cual los entes locales pueden imponer y ordenar sus tributos.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">2. Fundamentos y naturaleza</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con el que prevé el artículo 148, en relación en los artículos 41 a 47 del RDL 2/2004, de 5 de marzo, por el cual se aprueba el texto refundido de la Ley reguladora de las haciendas locales, el Consorcio TIC Mallorca establece el precio público por los servicios complementarios que presta a sus entes consorciados, especificando las tarifas contenidas en el artículo 3 y que se rige por esta Ordenanza.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 2. Obligados al pago</span></strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Están obligados al pago del precio público regulado en esta Ordenanza, los entes consorciados a que se refiere el artículo 35 de la Ley general tributaría que reciban la prestación de los servicios complementarios que presta el Consorcio.</span></p> <p><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Artículo 3. La obligación de pago del precio público regulado en esta Ordenanza nace en el momento en que el ente consorciado hace la solicitud del servicio complementario y esta se registra de entrada al Consorcio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El precio público se tiene que pagar cuando el departamento de Administración del consorcio haya presentado la facturación correspondiente a cada uno de los trimestres anuales del año, por el importe y de acuerdo con la información que las secciones que prestan los servicios complementarios emitan en relación con los servicios prestados durante el trimestre.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los servicios de tip<span style="color:black"><span style="line-height:13.9pt">o anual se pagarán en 4 fracciones, una por cada trimestre. Los servicios de nueva creación se pagarán a la facturación del trimestre en el que se presten.</span></span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><strong><span style="color:black">Artículo 5. Normas de gestión</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En los quince primeros días de cada trimestre, la responsable de la sección de Administración del Consorcio a través del programa de Gestión Tributaria y recaudación emitirá las correspondientes liquidaciones de conformidad a las indicaciones señaladas en el artículo 4 de esta ordenanza. Dichas liquidaciones serán notificadas a los beneficiarios de los servicios prestados para que efectúen su ingreso en los plazos señalados en el artículo 62.2 de la Ley general tributaria.</span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.9pt"><strong><span style="color:black">Artículo 6. Legislación aplicable</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En los aspectos no previstos expresamente en esta ordenanza por administrar y cobrar los precios públicos, se tiene que aplicar lo que prevé la Ley reguladora de las haciendas locales, la Ley general tributaria y <span style="line-height:13.9pt"><span style="color:black">el resto de normas aplicables.</span></span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:13.9pt"><strong><span style="color:black">Artículo 7.
