    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Pleno del Consell de Mallorca, con fecha 13 de febrero de 2020, ha adoptado el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;“Vista la aprobación inicial de la modificación de la vigente plantilla del Consell Insular de Mallorca para el año 2020, acordada por el Pleno día 9 de enero de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vista la publicación de la mencionada aprobación en el BOIB nº. 7, de 16 de enero de 2020, y su exposición al público, la cual finalizó el pasado día 7 de febrero de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Dado que, en fecha 4 de febrero de 2020, dentro del periodo de exposición al público, se han presentado alegaciones a la aprobación inicial por parte de la entidad sindical FeSP-UGT, con el número de registro general de entrada 3247.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Visto el informe emitido por el Jefe del Servicio Técnico de Recursos Humanos de la Dirección insular de Función Pública en relación con las alegaciones presentadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;&lt;span style="color:#000000"&gt;El consejero ejecutivo de Hacienda y Función Pública eleva al Pleno del Consell Insular de Mallorca para su aprobación la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;PROPUESTA DE ACUERDO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.- &lt;/strong&gt;Desestimar las alegaciones formuladas día 4 de febrero de 2020 por la entidad sindical FeSP-UGT, registro general de entrada número 3247, de 4 de febrero de 2020, en base al informe emitido por el Jefe del Servicio Técnico de Recursos Humanos de la Dirección Insular de Función Pública del Departamento de Hacienda y Función Pública de fecha 12 de febrero de 2020, el cual se incorpora al expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt;- Aprobar definitivamente la modificación siguiente de la vigente plantilla de personal del Consell Insular de Mallorca para el año 2020, con efectos de día 1 de enero de 2020, en los términos que se recogen a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vista la necesidad de modificar la vigente plantilla del Consell de Mallorca, aprobada por el Pleno, en sesión realizada día 23 de diciembre de 2019, publicada en el BOIB nº. 172, de 24-12-2019, con el fin de adaptar las plazas correspondientes a los dos puestos de trabajo que se modifican como consecuencia de la tramitación de la modificación de la vigente Relación de Puestos de Trabajo, las cuales no pueden ser aplazadas en el ejercicio presupuestario siguiente, debido a la necesidad de proceder a su cobertura urgente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Visto aquello que en relación a la plantilla de personal prevé el artículo 90 de la Ley 7/1985 de 2 de abril, Reguladora de las Bases de Régimen Local, y el artículo 8.1.p) de la Ley 8/2000 de 27 de octubre, de Consejos Insulares, en relación con el artículo 36.b) del Reglamento Orgánico del Consell de Mallorca, aprobado por el Pleno en sesión de 19 de julio de 2018 (BOIB nº. 89, de 19 de julio de 2018), redactado de conformidad con el acuerdo del Pleno de 12 de diciembre de 2016 (BOIB nº. 157, de 15 de diciembre de 2016). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Dado que el incremento del gasto que implica la modificación de plantilla se puede compensar con gastos de otras unidades, de acuerdo con aquello que prevé el apartado 2,a) del artículo 126 del Texto Refundido de las disposiciones legales vigentes en materia de Régimen Local, aprobado por el Real Decreto legislativo 781/1986 de 18 de abril. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:107%"&gt;Visto aquello que en relación al procedimiento para la aprobación de la modificación de la plantilla prevé el artículo 112 de la Ley 7/1985 de 2 de abril, Reguladora de las Bases de Régimen Local, y el artículo 169 del Real Decreto legislativo 2/2004 de 5 marzo, por el cual se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, en aplicación del artículo 126.3 del Real Decreto legislativo 781/1986 de 18 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; Contra este acuerdo de aprobación definitiva, que agota la vía administrativa, los interesados legitimados a que se refiere el artículo 170.1 del Real Decreto Legislativo 2/2004, de 5 de marzo, pueden interponer el recurso contencioso administrativo delante de la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Islas Baleares, en el plazo de dos meses, contadores a partir del día siguiente de la publicación de este acuerdo. Todo eso de conformidad con la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción Contenciosa Administrativa. No obstante el anterior, podéis ejercitar, si procede, cualquier otro recurso que consideráis pertinente.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
