    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0,0000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;El punto 3 del apartado Octavo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;30&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;de enero de 201&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;9&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;, &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;por la cual se convocan ayudas destinadas al pago compensatorio p&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;a&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;ra zonas con limitaciones específicas pera el año 201&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;9&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;, especifican que la resolución expresa se notificará a las personas interesadas mediante su publicación en&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;el Boletín Oficial de las Islas Baleares, y se hará de acuerdo a los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;El vicepresidente, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;co&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;n fecha &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;29&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&amp;nbsp;de &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;enero&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&amp;nbsp;de 20&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;20&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;, firmó la siguiente resolución: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span&gt;1.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Con &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span&gt;fecha 2 de febrero de 2019 se publicó en el BOIB núm. 15, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2019 de las ayudas destinadas al pago compensatorio&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;&amp;nbsp;pera zonas con limitaciones específicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:SimSun"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span&gt;citada Resolución, el plazo de presentación de solicitudes de la convocatoria terminó el día 10/05/2019, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 1323 solicitudes de ayuda.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:1,4000pt; margin-top:8,3000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:SimSun"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span&gt;4. Con fecha 16 de setiembre de 2019 se notifica, mediante publicación en la página web http://www.caib.es, el informe desfavorable y la propuesta provisional de denegación de la ayuda, emitida por el Servicio de Ayudas al Desarrollo Rural a los interesados,por no cumplir la condición de agricultor no pluriactivo establecido en la convocatoria en el apartado Tercero 1b. Concediéndoles un plazo de 10 días para presentar las alegaciones oportunas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span&gt;5. Con fecha 1 de octubre de 2019 y una vez finalizado el plazo establecido, no constaba en este servicio que hubiera tenido entrada en el Registro del FOGAIBA ninguna alegación de la interesada IVÁN COLOMAR TORRES, con DNI ***5356**, ni de otros solicitantes.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;em&gt;&lt;span&gt;6.Con fecha 14 de octubre de 2019, el vicepresidente del FOGAIBA dicta Resolución de denegación que se notifica a los interesados mediante la publicación en el BOIB núm. 144 de 22 de octubre de 2019.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;7.Posteriormente, los órganos gestores del Servicio de Ayudas al Desarrollo Rural comprueban que con fecha antgerior a la publicación de la mencionada Resolución de Denegación, el Sr. IVÁN COLOMAR TORRES cumplía con la condición de agricultor no pluriactivo establecida en la convocatoria para poder ser beneficiario de la ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
