2020-02-08 631628 CAIB 1228 es 180 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Por Resolución de la Alcaldesa&nbsp;a fecha 5 de febrero de 2020&nbsp;&nbsp; se aprueban las bases específicas que regirán la convocatoria para constituir una bolsa de trabajo para proveer, con personal funcionario interino, necesidades urgentes existentes en la policía local del Ayuntamiento de Campos</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">BASES ESPECÍFICAS QUE REGIRÁN LA CONVOCATORIA MEDIANTE CONCURSO PARA CONSTITUIR UNA BOLSA DE TRABAJO PARA PROVEER, CON PERSONAL FUNCIONARIO INTERINO, NECESIDADES URGENTES EXISTENTES EN LA POLICIA LOCAL DEL AYUNTAMIENTO DE CAMPOS.</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">PRIMERA.- Objeto, procedimiento de selección y normativa</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.&nbsp;El objeto de la convocatoria es la constitución&nbsp;de una&nbsp;bolsa de trabajo de personal funcionario interino correspondiente a&nbsp;la escala&nbsp;la&nbsp;de Administración Especial, subescala de Servicios Especiales, clase policía local, Grupo de clasificación C1, del Ayuntamiento de&nbsp;&nbsp;Campos,&nbsp;para cubrir necesidades urgentes.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.&nbsp;La selección de los aspirantes&nbsp;se efectuará&nbsp;mediante concurso.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3.&nbsp;Se aplicarán&nbsp;a este procedimiento&nbsp;la Ley 4/2013, de 17 de julio, de coordinación de las policías locales de las Islas Baleares, con la modificación efectuada por la Ley 11/2017, de 20 de diciembre;&nbsp;el Decreto 40/2019, de 24 de mayo, por el que se aprueba el Reglamento marco de coordinación de las policías locales de las Islas Baleares y se modifica el Decreto 55/2017, de 15 de diciembre, del Fondo de Seguridad Pública de las Islas Baleares;&nbsp;Real Decreto Legislativo 5/2015, de 30 de octubre, por el que&nbsp;se aprueba&nbsp;el texto refundido de la Ley del Estatuto Básico del Empleado público;&nbsp;la Ley 3/2007, de 27 de marzo, de la Función Pública de la Comunidad Autónoma de las Islas Baleares como el resto de disposiciones legales aplicables a la policía local.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4.&nbsp;Los nombramientos como personal funcionario interino que&nbsp;se efectúen&nbsp;a los aspirantes&nbsp;de esta&nbsp;bolsa serán conformes con&nbsp;el artículo&nbsp;41.2 de la Ley 4/2013, de 17 de julio, de coordinación de las policías locales de las Islas Baleares ;&nbsp;modificada por la Ley 11/2017, de 20 de diciembre, así como también con&nbsp;el artículo&nbsp;10.1 b (sustitución transitoria de los titulares) del Real Decreto Legislativo 5/2015, de 30 de octubre, por el que&nbsp;se aprueba&nbsp;el texto refundido de la Ley del Estatuto Básico del Empleado público.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Del mismo modo, se podrán llevar a cabo nombramientos para la cobertura temporal de plazas vacantes, regulados en&nbsp;el artículo&nbsp;10.1 apartado a) de la misma ley, siempre que no sea posible su provisión con personal funcionario de carrera, condición que establece la Ley 4/2013, modificada por la Ley 11/2017 en el artículo 41.1.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. La convocatoria se publicarán en el&nbsp;<em>Boletín Oficial de las Islas Baleares&nbsp;</em>y en la&nbsp;página web del Ayuntamiento de Campos.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">SEGUNDA.&nbsp;-&nbsp;&nbsp;Requisitos y condiciones de las personas aspirantes</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.&nbsp;Para participar en esta convocatoria, los interesados deben cumplir, en la fecha&nbsp;de expiración&nbsp;del plazo señalado para la presentación de solicitudes, los siguientes requisitos:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a)&nbsp;Tener la nacionalidad española.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b)&nbsp;Tener&nbsp;18 años cumplidos.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c)&nbsp;Estar en posesión del título de Bachiller, Técnico o equivalente, o estar en condiciones de obtenerlo en la fecha en que finalice el plazo de presentación de solicitudes&nbsp;en las condiciones exigidas en el artículo 76 del Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto Básico del Empleado Público.&nbsp;En el caso de titulaciones expedidas en el extranjero, deberá aportar la correspondiente homologación del Ministerio de Educación y Formación Profesional.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d)&nbsp;Tener el diploma de aptitud del curso de formación básica de la categoría de policía local expedido por la EBAP o el órgano competente del ámbito de las Islas Baleares y en plena validez.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) No padecer enfermedad o defecto físico o psicofísico que impida o disminuya el desarrollo correcto de las funciones, en relación con el cuadro de las exclusiones que se determinan en el anexo 5 del Decreto 40/2019 de 24 de mayo.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f) No haber sido separado del servicio de la Administración local, autonómica o estatal, ni estar inhabilitado para el ejercicio de la función pública.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">g) No tener antecedentes penales por delitos dolosos.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">h) Poseer los permisos de conducción de las clases A2 y B en vigor.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">i) Comprometerse a llevar armas y, en su caso, a utilizarlas, mediante una declaración jurada.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">j) Estar en posesión del nivel B2 (nivel avanzado) del conocimiento de la lengua catalana.&nbsp;Los certificados serán los expedidos por la Escuela Balear de Administración Pública, o los expedidos u homologados por la consejería competente en materia de política lingüística, o los reconocidos según la Orden del consejero de Educación, Cultura y Universidades de 21 de febrero de 2013.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">k)&nbsp;No ocupar ningún puesto de trabajo ni ejercer actividad en el sector público delimitado por el artículo I de la&nbsp;<em>Ley 53/1984, de 26 de diciembre,&nbsp;de incompatibilidades del personal al servicio de las administraciones públicas.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">&nbsp;<strong><span style="line-height:115%">TERCERA.- Solicitudes y plazo de presentación</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Las solicitudes para tomar parte en el proceso selectivo&nbsp;se ajustarán&nbsp;al modelo normalizado de solicitud del Anexo 2.&nbsp;Las solicitudes de participación en la convocatoria, junto con la documentación que corresponda, se han presentar en el registro&nbsp;general&nbsp;de entrada del Ayuntamiento de&nbsp;Campos,&nbsp;o en cualquiera de las formas previstas en&nbsp;el artículo 16 de&nbsp;la&nbsp;Ley 39/2015 de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&nbsp;El modelo de solicitud a utilizar estará a disposición de los aspirantes en&nbsp;la página web del Ayuntamiento de Campos.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El plazo de presentación de solicitudes será de&nbsp;10&nbsp;días&nbsp;hábiles&nbsp;a contar desde&nbsp;el día siguiente&nbsp;de la publicación&nbsp;de esta&nbsp;convocatoria en el&nbsp;<em>Boletín Oficial de las Islas Baleares.</em></span>&nbsp;</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Junto con la solicitud rellenada adecuadamente, los aspirantes deberán&nbsp;adjuntar:</span>&nbsp;</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a)&nbsp;Una declaración responsable de que el aspirante cumple los requisitos exigidos en las bases, con referencia siempre a la fecha de expiración del plazo señalado para presentar las solicitudes&nbsp;(Anexo 4).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b)&nbsp;La&nbsp;relación de los méritos aportados&nbsp;adjunta al&nbsp;<em>anexo 3.</em></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c)&nbsp;La documentación&nbsp;acreditada la relación de méritos.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4.&nbsp;Los méritos de los candidatos&nbsp;han&nbsp;de acreditar&nbsp;mínimo&nbsp;mediante la presentación de&nbsp;la original&nbsp;o copia de la siguiente documentación:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a)&nbsp;Documento nacional de identidad.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b)&nbsp;Curso de capacitación: certificado en vigor de la EBAP de haber superado el curso de capacitación de la categoría policía local.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c)&nbsp;En caso de haber prestado servicios&nbsp;como policía local: certificado de servicios prestados expedido por los ayuntamientos o administraciones públicas correspondientes.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d)&nbsp;Permisos de conducción A2 y B.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e)&nbsp;Certificado B2 de catalán expedido por la Escuela Balear de Administración Pública.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f)&nbsp;Título de Bachillerato o equivalente.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">CUARTA.- Órgano de selección</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.&nbsp;El órgano&nbsp;encargado de la selección es el Tribunal Calificador.&nbsp;Este se determinará por resolución de Alcaldía y su composición&nbsp;deberá&nbsp;publicar, con la lista definitiva de admitidos y excluidos, en el tablón&nbsp;de anuncios&nbsp;y en la página web del Ayuntamiento de&nbsp;Campos.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.&nbsp;El órgano&nbsp;de selección será colegiado y su composición&nbsp;se ajustará&nbsp;a los principios&nbsp;de imparcialidad&nbsp;y profesionalidad de sus miembros, procurando asimismo la paridad entre mujer y hombre.&nbsp;Su composición será predominantemente técnica y los miembros deberán&nbsp;estar&nbsp;en posesión de la titulación o especialización igual o superior a la exigida para&nbsp;el acceso&nbsp;en las plazas convocadas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. El personal&nbsp;de elección&nbsp;o de libre designación política, el personal funcionario interino&nbsp;y el personal eventual no podrán formar parte de los órganos de selección.&nbsp;Tampoco pueden formar parte los representantes de los empleados públicos, sin perjuicio de las funciones de vigilancia del buen desarrollo del procedimiento selectivo.&nbsp;Los representantes sindicales que participen en el procedimiento selectivo con estas funciones de vigilancia, han&nbsp;de estar&nbsp;acreditados y, como máximo, puede haber uno por cada sindicato, con un máximo de cuatro en cada procedimiento.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. La pertenencia a los órganos de selección será siempre a título individual, no pudiendo ostentarse ésta en representación o por cuenta de nadie.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. El tribunal calificador estará constituido por cinco miembros, y por el mismo número de suplentes:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a)&nbsp;Presidente/a: designado/a por&nbsp;el ayuntamiento&nbsp;convocante entre el personal funcionario de carrera&nbsp;de experiencia&nbsp;reconocida.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b)&nbsp;Vocales: un miembro vocal propuesto por la Dirección General, competente en materia de coordinación de policías locales, otro propuesto por la Escuela Balear de Administración Pública y uno designado por&nbsp;el ayuntamiento&nbsp;convocante.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c)&nbsp;Secretario/a: designado/a por&nbsp;el ayuntamiento&nbsp;convocante con voz y voto.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. El tribunal podrá acordar la incorporación en las tareas de personal asesor o especialista en todas o alguna de las pruebas, que pueden actuar con voz pero sin voto.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">7. El tribunal no podrá constituirse ni actuar sin&nbsp;la asistencia&nbsp;de más de la mitad de sus miembros, titulares o suplentes indistintamente, ni sin presidente/a ni secretario/a, y sus decisiones&nbsp;se adoptarán&nbsp;por mayoría.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">8.&nbsp;La abstención y la recusación de los miembros del tribunal se regulará por los artículos 23 y 24 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, y los artículos 22 y 23 de la Ley 3 / 2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">9. Las decisiones adoptadas por el tribunal se pueden recorrer en las condiciones que establece&nbsp;el artículo&nbsp;121 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Son funciones del tribunal calificador:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a)&nbsp;Valorar los méritos alegados y acreditados por los aspirantes, en la forma establecida en estas bases.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b)&nbsp;Requerir, en su caso, a las personas aspirantes que hayan acreditado méritos con defectos formales, a&nbsp;efectos&nbsp;de su enmienda, o cuando sea necesario una aclaración&nbsp;de algún&nbsp;de los méritos acreditados en tiempo y en forma.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c)&nbsp;Confeccionar una lista, por orden de prelación, de las personas que forman parte de la bolsa.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d)&nbsp;Resolver las reclamaciones presentadas, en el plazo establecido y en la forma, por los aspirantes.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e)&nbsp;Elevar a la Alcaldía la composición definitiva de la bolsa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Los méritos acreditados por los candidatos se valorarán&nbsp;de acuerdo&nbsp;con el baremo que&nbsp;se adjunta&nbsp;como Anexo 1.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">QUINTA.- Concurso.</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. La valoración de la fase de concurso se llevará a cabo teniendo en cuenta el baremo de méritos estipulados en el Anexo 1.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Una vez concluida la valoración de los méritos, el tribunal calificador publicará, en el tablón&nbsp;de anuncios&nbsp;del Ayuntamiento y en la página web del Ayuntamiento, una lista de las puntuaciones obtenidas por los aspirantes (por bloques y total), con indicación del número de documento nacional&nbsp;de identidad&nbsp;en la forma prevista en la disposición adicional séptima de la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de&nbsp;Datos Personales.&nbsp;Esta lista se publicará por orden de mayor a menor puntuación total.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Las personas aspirantes disponen&nbsp;de un&nbsp;plazo de&nbsp;3&nbsp;días&nbsp;hábiles, a contar a partir de&nbsp;la siguiente&nbsp;de la publicación de la lista, para alegar las rectificaciones pertinentes sobre la valoración provisional de los méritos del concurso.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">SEXTA.&nbsp;-&nbsp;Publicación de la bolsa definitiva</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.&nbsp;Resueltas, en su caso, las reclamaciones, el Tribunal calificador elaborará una lista definitiva de todas las personas aspirantes que formen parte de la bolsa, por orden de la puntuación obtenida, que elevará al la alcaldesa para que dicte la resolución que corresponda.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La bolsa se publicará en el tablón&nbsp;de anuncios&nbsp;y en la página web del Ayuntamiento con indicación de todas las personas integrantes,&nbsp;el orden&nbsp;de prelación y la puntuación obtenida por cada una, con indicación del número de documento nacional&nbsp;de identidad.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. La duración máxima de vigencia de la bolsa es de&nbsp;2 años.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">SÉPTIMA.&nbsp;-&nbsp;Funcionamiento de la bolsa</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.&nbsp;Al haber una vacante, si hace falta proveerla, de acuerdo con el artículo 41 de la Ley 4/2013, modificada por la Ley 11/2017, se puede nombrar una persona funcionaria interina.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Cuando se dé alguno de los supuestos previstos en la normativa para el nombramiento de un funcionario interino, se ofrecerá el lugar, de acuerdo con el orden de prelación,&nbsp;a las&nbsp;personas&nbsp;que se hallen en situación de disponible en la bolsa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En caso de empate de puntuación para el orden de prelación se resolverá teniendo en cuenta la mayor puntuación por el concepto de nota del curso.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Una vez aceptado el nombramiento,&nbsp;la persona&nbsp;deberá aportar la documentación acreditativa del cumplimiento de los requisitos para participar en la convocatoria objeto de declaración responsable en el plazo de 3 días antes de la toma de posesión.&nbsp;</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.&nbsp;Se debe comunicar a la persona aspirante a quien corresponda, el lugar y el plazo en los que se presentará.&nbsp;Quedará constancia en el expediente&nbsp;mediante diligencia, que ha recibido la comunicación o de los intentos realizados.&nbsp;La persona integrante de la bolsa debe manifestar su interés en el nombramiento&nbsp;en el plazo máximo de un día hábil a contar desde la comunicación, o dos días&nbsp;hábiles si la llamada se&nbsp;hace en viernes.&nbsp;Si no manifiesta la conformidad dentro plazo, renuncia expresamente al nombramiento, no responde al teléfono de contacto que ha facilitado, o se da otra circunstancia&nbsp;similar, quedará excluida de la bolsa y se avisará a la siguiente de la lista.</span>&nbsp;</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3.&nbsp;El aspirante no quedará excluida de la bolsa si en el momento de la llamada no aceptan la oferta por:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a)&nbsp;Estar en periodo de embarazo, de maternidad o de paternidad, de adopción o acogimiento permanente o preadoptivo, incluyendo el periodo en que sea procedente la concesión de excedencia para cuidado de hijos e hijas por cualquiera de los supuestos anteriores.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b)&nbsp;Estar prestando servicios, como personal funcionario de carrera o interino de la policía local en un municipio de las Islas Baleares.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c)&nbsp;Padecer enfermedad o incapacidad temporal.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4.&nbsp;Estarán en situación de no disponibles las personas integrantes de la bolsa que en el momento de la llamada no aceptan la oferta por los motivos del punto 3.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En caso de indisponibilidad se mantendrá el orden en la bolsa pero en situación de indisponible y se llamará al aspirante siguiente.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mientras el aspirante esté en situación de no disponible en la bolsa, no se le ofrecerá ningún puesto de trabajo correspondiente a esta convocatoria.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Las personas interesadas están obligadas a comunicar por escrito al ayuntamiento la finalización de las situaciones de indisponibilidad en un plazo máximo de tres días hábiles a contar desde que finalice la circunstancia alegada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5.&nbsp;Están en situación de disponibles el resto de aspirantes de la bolsa y, por tanto, se les podrá ofrecer puestos de trabajo de acuerdo con su posición en la bolsa.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6.&nbsp;A las personas aspirantes que renuncien de forma expresa o tácita - de acuerdo con el punto&nbsp;2&nbsp;de esta base- se las debe excluir de la bolsa, salvo que&nbsp;en el plazo de un día hábil&nbsp;-&nbsp;o en el segundo día hábil siguiente si la llamada se hace en viernes- ,&nbsp;aleguen la concurrencia de alguna de las circunstancias&nbsp;de indisponibilidad&nbsp;que deben justificarse documentalmente dentro&nbsp;de los tres&nbsp;días hábiles siguientes.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">7.&nbsp;Cuando la persona seleccionada mediante esta bolsa cese en el puesto de trabajo, excepto si es por renuncia voluntaria, se reincorporará nuevamente a la bolsa de trabajo con el mismo orden de prelación que tenía.&nbsp;La renuncia voluntaria&nbsp;de una&nbsp;persona funcionaria interina en el puesto de trabajo que ocupa, así como el incumplimiento del deber de tomar posesión del puesto de trabajo previamente aceptado, supone su exclusión de la bolsa de trabajo salvo los casos de fuerza mayor.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">OCTAVA.-&nbsp;&nbsp;Recursos e impugnaciones.</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Todos los actos&nbsp;de esta&nbsp;convocatoria que estén sometidos a información pública&nbsp;se han&nbsp;de publicar en el tablón&nbsp;de anuncios&nbsp;y en la página web municipal www.ajcampos.org.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En lo no previsto en estas bases y en la normativa específica de las policías locales&nbsp;&nbsp;se ha&nbsp;de aplicar&nbsp;supletoriamente la normativa reguladora de función pública definida en&nbsp;el artículo&nbsp;190 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Contra esta convocatoria y estas bases, que agotan la vía administrativa, los interesados pueden interponer un recurso potestativo de reposición en el plazo&nbsp;de un&nbsp;mes ante el mismo órgano que las haya aprobado,&nbsp;de acuerdo&nbsp;con los artículos 123 y 124 de la&nbsp;Ley 39/2015, de 1 de octubre de procedimiento administrativo Común de las Administraciones Públicas.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En cuanto a la formación en línea ya distancia no reglada, sólo se valora la que imparta y homologuen la EBAP o las universidades del ámbito de la Unión Europea y la efectuada dentro de los planes de formación continua.&nbsp;Los cursos en materia policial hechos antes de entrar en vigor la&nbsp;<em>Ley&nbsp;4/2013, de 17 de julio, de coordinación de las policías locales de las Islas Baleares,</em> también se valoran.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
