<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con la disposición transitoria tercera, apartado a, de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, referida al régimen transitorio de los procedimientos:</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>A los procedimientos ya iniciados antes de la entrada en vigor de la Ley no les será de aplicación la misma, rigiéndose por la normativa anterior.</em></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por lo que es de aplicación la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, cuyo artículo 59 de Práctica de la notificación, en su apartado 5, dispone lo siguiente:</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Cuando los interesados en un procedimiento sean desconocidos, se ignore el lugar de la notificación o el medio a que se refiere el punto 1 de este artículo, o bien intentada la notificación, no se hubiese podido practicar, la notificación se hará por medio de un anuncio publicado en el "Boletín Oficial del Estado".</em></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, mediante este anuncio se notifica lo siguiente:</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. En fecha 19 de junio de 2019, y mediante resolución de rectificación de errores de la Resolución de 15 de mayo de 2015 de la Consejera de Innovación, Investigación y Turismo del Gobierno de las Illes Balears, se acordó:</span></p>

<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Asumir la instrucción realizada por parte de la administración concursal del grupo turístico ORIZONIA, la mercantil Insolnet Administraciones Concursales SLP.</span></p>
</li>
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Determinar el derecho a la indemnización de los afectados, para lo cual a la resolución se adjunta un anexo que contiene un listado basado en la instrucción realizada, con los datos de los reclamantes y su derecho a la mencionada indemnización.</span></p>

<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ejecutar, de acuerdo con esta resolución, las cantidades de los avales depositados para satisfacer las cantidades endeudadas a los consumidores, de acuerdo, todo ello, con el artículo 163 de la Ley General para la defensa de los Consumidores y Usuarios.</span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. A los efectos de hacer posible el pago, puede descargar o imprimir el modelo de declaración responsable de veracidad de los datos bancarios aportados en la página web https://www.caib.es › seucaib › arxiuServlet el cual deberá remitir correctamente cumplimentado, junto con una fotocopia de su DNI, NIE o pasaporte a:</span></p>

Las personas interesadas disponen de un plazo de 10 días, contados a partir de la publicación de la presente notificación, para cumplimentar y remitir la documentación requerida en el punto anterior, según lo dispuesto por el artículo 76.1 de la Ley 30/1992, referido al cumplimiento de trámites.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todo ello con la advertencia previa que, como dispone el mismo artículo 76 en el apartado 3, en caso de no remitir la documentación en plazo, se les podrá declarar decaídos en su derecho al trámite correspondiente y, en consecuencia, perder el derecho a la indemnización otorgada por la Resolución de la Consejera de Innovación, Investigación y Turismo del Gobierno de las Illes Balears de 15 de mayo de 2015.</span></p>
