&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En relación con el asunto de referencia, y de acuerdo con lo establecido en el artículo 24 del Real Decreto Legislativo 1/2016, de 16 de diciembre, por el que se aprueba el texto refundido de la Ley de prevención y control integrados de la contaminación, se publica el Acuerdo del Pleno de la CMAIB, en sesión de 28 de noviembre de 2019,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;CONSIDERANDO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Que GAS Y ELECTRICIDAD GENERACIÓN SAU ha solicitado una modificación de la AAI, consistente en la segregación de la fianza del vertedero de Biniatria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Que la documentación aportada justifica que se trata de una modificación no sustancial, en cumplimiento del art. 10.4 y 10.5 del Real Decreto Legislativo 1/2016, de 16 de diciembre y del art. 14 del RD 815/2013.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Que el informe emitido por el organismo consultado es favorable y presenta en el informe una tabla de la nueva distribución de la fianza que es igual a la presentada en la solicitud por GAS Y ELECTRICIDAD GENERACIÓN SAU.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ACUERDA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Otorgar la modificación no sustancial de la Autorización Ambiental Integrada de la CT de Alcúdia, consistente en la segregación de la fianza del vertedero de Biniatria, con la condición de segregarse teniendo en cuenta la distribución de la superficie de cada zona o celda que conforman el vertedero indicados en la memoria descriptiva que acompaña la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Así, se modifica de la AAI el apartado 6.7. Constitución de la fianza, que:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Donde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.7. Constitución de la fianza.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En cumplimiento de la ley 26/2007, de 23 de octubre, de Responsabilidad Medioambiental y el RD 1481/2001, se deberá constituir una fianza, para responder del cumplimiento de todas las obligaciones frente a la administración que se deriven de la su actividad, de una parte por el sellado del vertedero y de otro por el mantenimiento postclausura. Se podrá liberar una parte cuando se produzca la clausura y restauración ambiental, mientras que la de mantenimiento postclausura será liberada una vez transcurrido 30 años desde la clausura.&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
