&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El 17 de octubre de 2019, el presidente del Instituto Mallorquín de Asuntos Sociales (IMAS) aprobó el expediente de la convocatoria pública de ayudas económicas del Instituto Mallorquín de Asuntos Sociales a entidades que llevan a cabo actividades de apoyo a los servicios sociales de atención primaria y actividades de apoyo para personas en situación de exclusión social con problemas añadidos de salud, para el año 2019, publicada en el BOIB nº 146 de 26 de octubre de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. Esta resolución fue objeto de una rectificación de error material, aprobada por resolución del presidente del Instituto Mallorquín de Asuntos Sociales (IMAS) de 28 de octubre de 2019, y que fue publicada en el BOIB nº 150 de 5 de noviembre de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. A esta resolución se autorizó el gasto derivado de este expediente por el importe total de cuatrocientos mil euros (400.000,00 €), con cargo a la partida 30.23152.48000 del vigente presupuesto de gastos del IMAS (nº referencia contable 22019014984).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. Una vez revisadas las solicitudes admitidas y subsanadas, si era posible, las deficiencias que presentaban, la Comisión Evaluadora se reunió el 10 de diciembre de 2019. Aplicados los criterios de valoración establecidos en las bases y la convocatoria, formuló la correspondiente propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. El 12 de diciembre de 2019, entró en el Servicio Juridicoadministrativo del IMAS el informe propuesta de la técnica de Inserción Social por ausencia del jefe de Sección de Inserción Social del IMAS, por lo que solicitaba de acuerdo con el informe técnico de valoración y adjuntando el acta de la comisión evaluadora, que se proceda al otorgamiento y denegación de las ayudas correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6. Los Servicios Juridicoadministrativo y la Intervención delegada del IMAS han emitido los informes favorables correspondientes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Consideraciones jurídicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El Pleno del Consejo de Mallorca, por acuerdo de 11 de abril de 2019, aprobó los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB nº 67 de 18 de mayo de 2019). El artículo 2.1 de los Estatutos dispone que el IMAS, tiene por objeto fundamental el ejercicio, en forma directa y descentralizada, de las competencias atribuidas por cualquier título al Consejo de Mallorca en materia de servicios sociales y protección de menores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. De acuerdo con el artículo 70.4 del Estatuto de Autonomía, son competencias propias de los consejos los servicios sociales y la asistencia social y la política de protección y atención a personas dependientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. De acuerdo con el artículo 3 de los Estatutos del IMAS, este organismo tiene personalidad jurídica propia y la capacidad de obrar necesaria para cumplir sus fines.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. De acuerdo con el art. 8 de la Ley 38/2003, general de subvenciones, con carácter previo al otorgamiento de las subvenciones, deberán aprobarse las normas que establezcan las bases reguladoras de concesión en los términos previstos en la Ley.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. Vista la Ordenanza General de Subvenciones del Consejo de Mallorca (OGS) aprobada en sesión de 23 de diciembre de 2016 (BOIB nº 21, de 18 de febrero de 2017), y modificada por Acuerdo del Pleno del Consejo de Mallorca de fecha 14 de junio de 2018 (BOIB nº 96, de 4 de agosto de 2018), en especial referencia a lo establecido en su artículo 1 que determina que tiene por objeto regular el régimen jurídico general de las subvenciones otorgadas por el Consejo Insular de Mallorca, los organismos autónomos dependientes y las entidades de derecho público con personalidad jurídica propia vinculadas o dependientes que otorguen subvenciones dentro del ejercicio de potestades administrativas. Así como, visto que esta OGS da cumplimiento a lo previsto en el Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones adecuando, de acuerdo con la Disposición adicional segunda de este Decreto legislativo, la actividad de concesión de subvenciones del Consejo a lo establecido en la misma Ley.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;6. De acuerdo con la Ordenanza General de Subvenciones y con la convocatoria, el procedimiento de selección de las entidades beneficiarias se hará mediante concurrencia competitiva, en los términos previstos en el artículo 21 de la Ordenanza mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;7. La Comisión Evaluadora constituida para esta convocatoria ha estudiado y comprobado todas las solicitudes presentadas, y ha emitido el informe que sirve de base al órgano instructor para elaborar la propuesta de resolución correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;8. En virtud del punto 11.4 de esta convocatoria de ayudas económicas, las resoluciones de concesión o denegación de las ayudas se notificará a las entidades interesadas y se publicará en el Boletín Oficial de las Islas Baleares, de acuerdo con el artículo 45.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (LPAC).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;9. El órgano competente para aprobar las bases específicas y resolver los procedimientos de ayudas, prestaciones y subvenciones relativas a las competencias atribuidas al IMAS, es la Presidencia del IMAS, en virtud del artículo 7.2.7 de los Estatutos del IMAS y dado el Decreto de la Presidencia del Consejo Insular de Mallorca por el que se nombra al consejero ejecutivo de Derechos Sociales (BOIB nº 92 de 9 de julio de 2019), el cual, de acuerdo con el artículo 7.1 de los Estatutos del IMAS, ejercerá también el cargo de presidente del IMAS. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Por todo ello,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;RESUELVO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; &lt;strong&gt;OTORGAR&lt;/strong&gt; las ayudas económicas a las siguientes entidades que llevan a cabo actividades de apoyo a los servicios sociales de atención primaria y actividades de apoyo para personas en situación de exclusión social con problemas añadidos de salud, para el año 2019, por los conceptos y por los importes que seguidamente se reseñan, así como DISPONER en su favor un gasto por un importe total de CUATROCIENTOS MIL EUROS (400.000,00 €), con cargo a la partida 30.23152.48000 del vigente presupuesto de gastos del IMAS (nº relación contable Q/2019/2020), de acuerdo con el siguiente detalle:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Segundo: Denegar&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; las ayudas económicas a entidades que llevan a cabo actividades de apoyo a los servicios sociales de atención primaria y actividades de apoyo para personas en situación de exclusión social con problemas añadidos de salud, para el año 2019, solicitadas por las siguientes entidades y por los siguientes motivos:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;ASOCIACIÓN PAN Y MIEL: no cumple los requisitos básicos de la convocatoria; el proyecto no debe tratar sobre cuestiones concretas de las intervenciones técnicas posibles desde el trabajo de la atención primaria, sino sobre el conjunto de tareas y funciones que realizan desde los servicios comunitarios básicos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;ASOCIACIÓN ESPAÑOLA CONTRA EL CÁNCER: no cumple los requisitos básicos de la convocatoria. No queda claro que las personas atendidas sean personas en situación de exclusión social, elemento básico y esencial para poder optar a las ayudas de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;FUNDACIÓN PROYECTO HOMBRE BALEARES. No cumple los requisitos básicos de la convocatoria. No queda reflejado que las personas atendidas sean claramente personas en situación de exclusión social, ni que tengan enfermedades invalidantes. No acredita la situación de exclusión social de las personas atendidas ni que tengan enfermedades invalidantes, elemento esencial para tener claras dificultades de reinserción. Dos requisitos esenciales para poder optar a las subvenciones enmarcadas en dicha convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; &lt;strong&gt;ORDENAR&lt;/strong&gt; la publicación de esta resolución en el Boletín Oficial de las Islas Baleares y en la Base Nacional de Datos de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto.&lt;/strong&gt; &lt;strong&gt;NOTIFICAR&lt;/strong&gt; esta resolución a las entidades relacionadas, al frente de la Sección de Inserción Social, el Servicio de Gestión Económica y la Intervención Delegada del IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por acuerdo del Pleno del Consejo de Mallorca de día 11 de abril de 2019 (BOIB nº 67 de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consejo Insular de Mallorca, en el plazo de un mes, contado a partir del día siguiente al de la notificación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación del mencionado recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No obstante lo anterior, se puede ejercitar, en su caso, cualquier otro recurso que se estime pertinente. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso Administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
