font-size:12px"><span style="background-color:null">La duración de la comisión de servicios será de doce meses, de conformidad con lo establecido en el art.178.4 del Decreto 28/2015, de 30 de abril, por el que se aprueba el Reglamento marco de coordinación de los policías locales de las Islas Baleares, periodo que se podrá prorrogar después de justificación previa del órgano competente.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2.- Normativa aplicable</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">A esta prueba selectiva se aplicará la siguiente legislación:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">• Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el texto refundido de la ley del Estatuto Básico del Empleado público.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">• La Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">• Decreto 40/2019, de 24 de mayo, por el que se aprueba el Reglamento marco de coordinación de las policías locales de las Islas Baleares.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">• Decreto 11/2017, de 24 de marzo, de exigencia del conocimiento de la lengua catalana en los procedimientos selectivos de acceso a la función pública y para ocupar puestos de trabajo de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">• También demás disposiciones legales aplicables a la policía local.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3.- Requisitos de los aspirantes </span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Para ser admitido a esta convocatoria, los interesados ​​deben cumplir en la fecha de finalización del plazo para presentar las solicitudes y durante todo el proceso selectivo, los requisitos siguientes: </span></span></p> <p style="margin-bottom:0px; Estar en situación de servicio activo ostentando la condición de funcionario de carrera de la Administración Local perteneciente a la Escala de Administración Especial, Subescala Servicios Especiales, Clase Policía Local. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b. Contar con la conformidad del órgano competente del Ayuntamiento de procedencia. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c. No padecer enfermedad o defecto físico alguno que le impida el normal ejercicio de las funciones propias como Policía Local. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d. No hallarse suspendido ni inhabilitado para el ejercicio de funciones públicas. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e. Carecer de anotaciones por faltas graves o muy graves en su expediente personal, en virtud de resolución firme. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">f. No encontrarse afectado en procedimiento administrativo o judicial que sea o pueda ser incompatible con el ejercicio de sus funciones </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">g. No tener antecedentes penales por delitos dolosos. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">h. Tener los permisos de conducción de clase A2 y B en vigor. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">i. No estar incurso en causa de incapacidad específica de acuerdo con la normativa vigente.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">j. Declaración jurada de compromiso de portar armas y, si es necesario, utilizarlas, por medio de una declaración jurada. Todos los requisitos deberán cumplirse en el último día del plazo de presentación de solicitudes y mantenerse durante todo el proceso selectivo y hasta el momento, en su caso, de la toma de posesión. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:150%"><strong><span style="line-height:150%"><span style="color:#222222"><span style="background-color:null">4.- Forma y plazo de presentación de instancias</span></span></span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las solicitudes&nbsp; irán dirigidas al Alcalde del Ayuntamiento de Banyalbufar y se ajustarán al modelo publicado en el anexo II y III de estas bases, en el plazo de quince días hábiles, a contar a partir del día siguiente de la publicación de la convocatoria en el BOIB, en el tablón de anuncios del Ayuntamiento y en la página web municipal. El modelo normalizado de solicitud incluido en el anexo II y III de las bases también se encontrará a disposición de los interesados ​​en la página web https://www.ajbanyalbufar.net/ </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Su presentación podrá hacerse en el Registro General del Ayuntamiento o por cualquier medio previsto en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. En caso de presentarse de conformidad con el art 16.4 de la Ley 39/2015 se deberá remitir copia de la solicitud donde conste la fecha de remisión, en el departamento de Recursos Humanos por correo electrónico a la dirección ayuntamiento@ajbanyalbufar.net. Sin el cumplimiento de este requisito, las solicitudes que se registren en el Ayuntamiento fuera del plazo de presentación no serán admitidas. Junto con la solicitud deberá adjuntar la siguiente documentación compulsada: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) Fotocopia compulsada del documento nacional de identidad o el resguardo de la solicitud de renovación. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Certificación expedida por la Secretaría del Ayuntamiento de procedencia en la que se haga constar que el aspirante ostenta la condición de funcionario de carrera, integrado en la escala de administración especial, subescala de servicios especiales, clase policía local </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) Certificación expedida por la Secretaría del Ayuntamiento de procedencia del acuerdo o resolución del órgano competente declarando la conformidad que el interesado pueda ser nombrada en comisión de servicios en el supuesto de ser seleccionada. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Declaración responsable de las circunstancias a las que se refiere las letras c), d), e), f) ei) de la Base tercera. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e) Fotocopia compulsada de los permisos de conducción A y B en vigor, o del resguardo de la sol • licitud de renovación. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">f) Relación de los méritos aportados, donde se recojan ordenadamente los méritos • alegados, estructurados según los bloques en los que se divide el baremo de méritos recogidos en el anexo I de estas bases. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">g) Los documentos acreditativos de los méritos a valorar de titulación, formación y experiencia profesional y laboral. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:150%"><strong><span style="line-height:150%"><span style="color:#222222"><span style="background-color:null">5.- Protección de datos personales</span></span></span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">De acuerdo con la Ley Orgánica 3/2018 de 5 de diciembre (LOPD-GDD), de protección de datos personales, se informa a los aspirantes que los datos contenidos en la solicitud de admisión y documentación que se acompañe a la misma o la generada a resultas de la presente convocatoria, se incorporarán a un fichero de datos personales del que es responsable el Ayuntamiento de Banyalbufar, cuya finalidad es llevar a cabo los procesos de selección de personal de la Corporación. Los datos personales necesarios podrán ser utilizados para llevar a cabo las publicaciones propias del proceso de selección. Los aspirantes pueden ejercer en todo momento los derechos de acceso, rectificación, instalación u oposición de sus datos, dirigiéndose a la Secretaría de la Corporación en la plaza de la Villa núm. 2, 07191 de Banyalbufar</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:150%"><strong><span style="line-height:150%"><span style="color:#222222"><span style="background-color:null">6.- Lista de admitidos y excluidos </span></span></span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Finalizado el plazo de presentación de &nbsp;solicitudes, el Alcalde de la corporación dictará resolución en el plazo máximo de cinco días hábiles, declarando aprobada la lista provisional de admitidos y excluidos, que será publicada en el tablón de anuncios del Ayuntamiento en la página web https://www.ajbanyalbufar.net/ con indicación, en su caso, de la causa de no admisión, y se fijará un plazo de 3 días hábiles, a partir del día siguiente de la publicación en la web municipal, para poder presentar reclamaciones. En caso de que no hubiera, la lista será definitiva a partir del día siguiente de terminar el plazo de reclamaciones. Las reclamaciones presentadas serán resueltas en el plazo máximo de cinco días hábiles por la Alcaldía, desde la finalización del plazo de reclamaciones. La lista definitiva, una vez resueltas las reclamaciones, se publicará en la página web del Ayuntamiento de Banyalbufar y en el tablón de anuncios del Ayuntamiento. Asimismo, se fijará la fecha y hora de constitución de la Comisión de Valoración y la fase de concurso de méritos. </span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">7.- Comisión de Valoración</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La determinación de la Comisión de Valoración se realizará una vez sea publicada la lista definitiva de los aspirantes admitidos y excluidos y su actuación se ajustará estrictamente a las Bases de la convocatoria. Sin embargo, resolverá las dudas que puedan surgir de su aplicación y podrá tomar los acuerdos que correspondan para aquellos supuestos no previstos en las Bases.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Los miembros de la Comisión de Valoración, deberán abstenerse de intervenir cuando concurra alguna de las circunstancias previstas en el artículo 23 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Terminada la baremación de los aspirantes, se publicará en la web y en el tablón de anuncios del Ayuntamiento el listado de puntuaciones. Los aspirantes dispondrán de un plazo de 3 días hábiles para posibles reclamaciones. Si no hay reclamaciones, este listado será definitivo. Una vez resueltas las reclamaciones, la Comisión de Valoración elevará a Alcaldía el listado definitivo de puntuaciones y la propuesta de nombramiento como funcionario/a en comisión de servicios.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Comisión de Valoración está facultada para resolver las dudas, discrepancias, peticiones y sugerencias que se originen durante el desarrollo del proceso de selección, y adoptar los acuerdos necesarios para el buen orden del proceso selectivo en todo lo no previsto en estas bases.</span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8. Desarrollo del proceso selectivo</span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El proceso de selección consistirá en dos fases: la valoración de los méritos relacionados con el puesto de trabajo objeto de convocatoria, con arreglo al baremo que se detalla en Anexo I, y en su caso, la celebración de una entrevista personal.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Comisión de Valoración valorará las dos fases siendo el resultado final la suma de estas.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:150%"><strong><span style="line-height:150%"><span style="color:#222222"><span style="background-color:null">9.- Relación de aprobados </span></span></span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:150%"><span style="line-height:150%"><span style="color:#222222"><span style="background-color:null">F</span></span></span></span><span style="background-color:null">inalizada la valoración del proceso selectivo, la Comisión de Valoración hará pública en el tablón de anuncios y en la página web del Ayuntamiento, la lista provisional de las puntuaciones obtenidas por los aspirantes, con indicación de las calificaciones obtenidas en cada uno de los apartados . Todas las personas aspirantes dispondrán de un plazo de tres días hábiles, desde la publicación, para efectuar las reclamaciones oportunas o sol • licitar la revisión de su puntuación provisional ante la Comisión de Valoración. A esta revisión, podrán asistir acompañadas de un asesor. La Comisión de Valoración tendrá un plazo de cinco días para resolver las reclamaciones y, a continuación, publicará, en el tablón digital de anuncios y en la página web, la lista definitiva de aprobados, por orden de puntuación, que no podrá contener un número de aprobados superior al de puestos vacantes objeto de oferta. De acuerdo con la citada lista, la Comisión de Valoración elevará a la Alcaldía Presidencia de la Corporación, el acta de la última sesión, donde se incluirá la relación de aprobados y la propuesta del correspondiente nombramiento temporal. Asimismo, la Comisión de Valoración propondrá una relación por orden de puntuación de todos aquellos aspirantes que no obtuvieran los puestos ofertados en Comisión de Servicios para casos en los que se haga necesaria la cobertura de nuevas comisiones de servicio. En estos casos la propuesta de la Comisión de Valoración se entenderá automáticamente referida a los siguientes aspirantes por orden de puntuación a efectos de su posterior nombramiento. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:150%"><strong><span style="line-height:150%"><span style="color:#222222"><span style="background-color:null">10.- Presentación de documentos.</span></span></span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Una vez publicada la lista de aprobados en el tablón de anuncios y en la página web del Ayuntamiento, los aspirantes propuestos disponen de un plazo de diez días naturales, a contar desde el día siguiente al de la fecha de publicación, para presentar los siguientes documentos: - Certificación expedida por el Registro Central de Penados y Rebeldes de carecer de antecedentes penales, dentro de los tres meses anteriores al día en que finalice el plazo de presentación de documentos. En caso de presentación de títulos de estudios realizados en el extranjero, se debe acreditar la homologación concedida por el Ministerio de Educación, Cultura y Deporte. Por la posesión de titulaciones académicas oficiales superiores a la exigida para la categoría a la que se accede a partir de una segunda titulación académica oficial igual a la que se exige para la categoría a la que se accede. Se valorará sólo un certificado, excepto en el caso del certificado de conocimientos de lenguaje administrativo, en que la puntuación se acumulará a la del otro certificado que se aporte. En todo caso, sólo se valorarán los certificados de nivel superior al exigido como requisito de ocupación de la plaza a la que se acceda. En caso de que se presenten dudas sobre la puntuación que se haya de otorgar a algún certificado o sobre su validez, se podrá solicitar un informe a la Dirección General de Política Lingüística de la Consejería de Cultura, Participación y Deportes. font-size:12px"><span style="background-color:null">Sólo se valorarán los diplomas o certificados de cursos y actividades formativas impartidos por las escuelas de formación de las policías locales, los cursos impartidos por la Escuela Balear de Administración Pública o que tengan la condición de concertados o homologados por la EBAP, los cursos de interés policial manifiesto superados en universidades en el ámbito de la Unión Europea o en otras administraciones públicas del Estado español con centros de formación acreditados y los planes de formación continua.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En cuanto a la formación en línea y a distancia no reglada, sólo se valora las que impartan y homologuen la EBAP o las universidades del ámbito de la Unión Europea y la efectuada dentro de los planes de formación continua.
