CAIB ![CDATA[Acuerdo del Consejo de Dirección de la Escuela Balear de Administración Pública (EBAP) de 22 de enero de 2020 por el que se aprueba la oferta de cursos y las instrucciones que rigen el Plan de Formación FIOP para el año 2020]] 2189 2196 631038 ![CDATA[<div class="WordSection1"> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. El 14 de enero de 2020, la coordinadora del FIOP, una vez elaborado el Plan de Formación FIOP, que incluye la oferta de cursos dirigidos al colectivo de personas con discapacidad para el año 2020 y las instrucciones aplicables, emitió un informe propuesta sobre esta oferta con la finalidad de aprobar la correspondiente convocatoria.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. En la sesión de 22 de enero de 2020, el Consejo de Dirección, en el ejercicio de la función que establece el artículo 11.2 </span><em style="font-family:&quot;Times New Roman&quot;,Times,serif">e)</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> de los Estatutos de la EBAP, aprobó el Plan de Formación FIOP, que incluye la oferta de cursos dirigidos al colectivo de personas con discapacidad (anexo 2) para el año 2020 y las instrucciones por las que se rigen estos cursos (anexo 1).</span></p> <p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Fundamentos de derecho</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. De acuerdo con lo que establece el artículo 12 de la Ley 3/2007, de 27 de marzo, de la Función Pública de la Comunidad Autónoma de las Islas Baleares, corresponde a la Escuela Balear de Administración pública (EBAP) la formación, la capacitación y el perfeccionamiento del personal al servicio de la Administración autonómica y de las entidades que dependen de esta. Asimismo, esta norma añade que, en los términos que se establezcan, corresponde a la EBAP la realización de actividades formativas y de selección del personal al servicio de las otras administraciones del ámbito territorial de las Islas Baleares.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. El artículo 1 del Decreto 191/1996, de 25 de octubre, por el que se regulan las condiciones generales de las actividades formativas que organiza la Consejería de Interior (actualmente, Consejería de Administraciones Públicas y Modernización), indica que el Instituto Balear de Administración Pública (actualmente, Escuela Balear de Administración Pública) es el principal instrumento de la política formativa de la Administración pública de las Islas Baleares, y elabora periódicamente diferentes planes de formación que responden a los principios de eficacia y de calidad de las actividades formativas, con la finalidad de favorecer la participación del personal al servicio de la Administración.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. El artículo 5.14 del Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la Escuela Balear de Administración Pública, incluye, entre sus funciones, la promoción, la organización y la gestión de la formación específica de las personas con discapacidad, con el fin de facilitar su incorporación a puestos de trabajo de las administraciones públicas del ámbito territorial de la comunidad autónoma de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, de acuerdo con las atribuciones que me otorga el artículo 11.2e) de los Estatutos de la EBAP, el Consejo de Dirección adopta los siguientes acuerdos</span></p> <p style="text-align:center"><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">ACUERDOS</strong></p> <p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Primero.</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Aprobar la oferta de cursos para personas con discapacidad del Plan de Formación FIOP aprobada por el Consejo de Dirección de la EBAP para el año 2020, de acuerdo con lo que establece el anexo 2 de este Acuerdo.</span></p> <p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Segundo.</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Aprobar las instrucciones que rigen el desarrollo de este plan de formación, también aprobadas por el Consejo de Dirección, de acuerdo con lo que establece el anexo 1 de este Acuerdo.</span></p> <p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Tercero.</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Delegar en la Dirección de la Gerencia de la Escuela Balear de Administración Pública la modificación o la supresión de los cursos en función de la demanda y la disponibilidad presupuestaria.</span></p> <p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Cuarto.</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Publicar este Acuerdo en el </span><em style="font-family:&quot;Times New Roman&quot;,Times,serif">Boletín Oficial de las Islas Baleares</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif">.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Interposición de recursos</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Contra este Acuerdo, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el Consejo de Dirección de la EBAP en el plazo de un mes, a contar a partir del día siguiente al de su publicación en el </span><em style="font-family:&quot;Times New Roman&quot;,Times,serif">Boletín Oficial de las Islas Baleares</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif">, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">También se puede interponer directamente un recurso contencioso-administrativo ante el Juzgado de lo Contencioso-Administrativo de Palma en el plazo de dos meses, a contar desde el día siguiente al de la publicación de este Acuerdo, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa.</span></p> <p> </p> <p style="text-align:center"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Palma, 22 de enero de 2020</span></p> <p style="text-align:center"><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La Presidenta del Consejo de Dirección<span style="display:block; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong><span style="color:#231f20">Punto 1. Personas destinatarias</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">1.1. Las personas destinatarias de las actividades formativas del FIOP de la Escuela Balear de la Administración Pública (EBAP) son<strong> </strong><span style="background-color:white">las que ac</span>rediten una discapacidad igual o superior a un 33&nbsp;% y que tengan interés en trabajar en la Administración pública de la Comunidad Autónoma de les Illes Balears o bien se encuentren en situación de servicio activo en dicha administración, en función de la acción formativa.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">1.2. Las personas</span> mencionadas en el punto anterior tienen derecho a participar en las actividades formativas del FIOP<span style="color:#231f20"> en los términos y en las condiciones que se determinan en esta convocatoria.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>Punto 2. Modalidades de inscripción a los cursos y presentación de documentación</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">2.1. Las personas interesadas pueden tramitar sus solicitudes mediante dos procedimientos:</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">a) Mediante<em> </em>la matriculación por Internet. Para matricularse, se debe acceder a la página web de la EBAP (&lt;</span>http://ebap.caib.es&gt;); se debe acceder a &lt;Planes de formación del EBAP 2020&gt;; a continuación, se ha de acceder a &lt;Formación FIOP 2020&gt;; a continuación, se ha de acceder a &lt;Oferta Cursos 2020&gt;; a continuación, se ha de acceder al &lt;curso de la isla correspondiente&gt;, a continuación, se ha de acceder a &lt;detalle del curso (icono a la derecha)&gt; y finalmente, se debe acceder a &lt;solicitar curso&gt;.&nbsp;<span style="color:#231f20">Una vez realizada la solicitud en línea, se podrá aportar la documentación necesaria según la acción formativa </span>(véase el anexo), a la siguiente dirección de correo electrónico (fiop@ebap.caib.es). Si surge alguna dificultad, se puede contactar a través de los teléfonos de las diferentes sedes del EBAP en las Islas (Palma 971177626/Maó <span style="background-color:white">971177197/Eivissa 971177689)</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b) Mediante el impreso habilitado a este efecto, en el que deben hacerse constar todos los datos que se piden, incluyendo la dirección de correo electrónico, que es la herramienta para comunicar la admisión a los cursos. La falta de datos puede ser motivo de exclusión. Las solicitudes se ha de presentar en el Registre General de la EBAP, en el de la Consejería de Administraciones Públicas o en cualquiera de las formes que determina la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones públicas. ( si se realiza la solicitud en qualquier forma legalmente prevista, que no sea el registro del ebap, deberan comunicarlo a la dirección de correo electrónico fiop@ebap.caib.es </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Las personas que realicen la matrícula presencialmente, deben adjuntar a sus solicitudes la documentación requerida para cada una de las acciones formativas (véase el anexo) y que se publicaran en la página web del EBAP (&lt;http://ebap.caib.es&gt;).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">2.2. La presentaci</span>ón de la solicitud para participar en este procedimiento supone el conocimiento y la aceptación inequívocos del aspirante del tratamiento de los datos de carácter personal a cargo del órgano competente y únicamente para las finalidades establecidas. El tratamiento de la información facilitada en las solicitudes tendrá en cuenta las previsiones del Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en cuanto al tratamiento de datos personales y a la libre circulación de estos datos, y de la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y Garantía de los Derechos Digitales.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>Punto 3. Plazo de presentación de solicitudes </strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3.1. El plazo se estructura en dos periodos, cada uno de los cuales tiene un plazo de inscripción propio:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">a) Primer semestre: d<span style="background-color:white">e día</span> 27 a día 31 de enero<span style="background-color:white">, ambos incluidos. </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">b) Segundo semestre:<span style="background-color:white"> pendiente de </span>determinar.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3.2 En el anexo 2 de este Acuerdo se publican las fechas concretas de impartición de las actividades formativas del primer periodo. Las fechas concretas correspondientes al segundo periodo se publicaran en la página web del EBAP http://ebap.caib.es antes que empiece el plazo de inscripción respectivo.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3.3 Las solicitudes presentadas fuera de plazo no se tendrán en cuenta.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>Punto 4. Material didáctico de los cursos</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="background-color:white"><span style="color:#231f20">Es de aplicación a este Plan de Formación la Instrucción de la gerente de la Escuela Balear de la Administración Pública (EBAP) del 2 de noviembre de 2011 por la que la EBAP deja de reproducir material didáctico en formato de papel y en formato de CD para los cursos que organiza. Salvo excepciones debidamente justificadas, el material didáctico de los cursos se publicará en el repositorio de material que hay en la página web (&lt;</span>http://ebap.caib.es&gt;).</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong><span style="color:#231f20">Punto 5. Requisitos de las personas interesadas</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">Los requisitos de las personas interesadas son los siguientes:</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>Para los cursos de reciclaje:</strong></span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">- Ser ex alumno de los proyectos FIOP.</span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">En estos cursos se prevé la posibilidad que en caso de quedar plazas vacantes, la EBAP podrá hacer extensiva la actividad formativa a aspirantes que no han <span style="background-color:white">realizado ninguna edición del FIOP y que cumplan los siguientes requisitos:</span></span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="background-color:white">- Tener una discapacitat igual o superior al 33&nbsp;% (si el tipo de formación lo requiere, se deberá aportar un certificado específico de discapacidad media, que suponga dificultades de aprendizaje)</span></span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="background-color:white">- Lectoescritura adquirida.</span></span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="background-color:white">- Autonomía personal. </span></span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="background-color:white">- Situación laboral en paro (valorable según el </span><span style="background-color:white">requisito de la acción formativa)</span></span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="background-color:white">- Haber participado o participar en algún proceso selectivo de oposición de </span>administraciones públicas <span style="background-color:white">(valorable).</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong><span style="color:#231f20">Punto 6. Selección de las personas interesadas</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">6.1. Solo se admitirán las solicitudes que cumplan los requisitos establecidos en la convocatoria correspondiente.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">6.2. La selección se hará atendiendo a los requisitos, a la evolución formativa que han demostrado durante el trayecto por las diferentes ediciones del FIOP y<span style="background-color:white">, en el caso de personas que no hayan participado en otras ediciones anteriores, se valoraran mediante una entrevista personal, la motivación, interés, la disponibilidad, las habilidades socio laborales, la formación complementaria y la situación laboral. </span></span><span style="background-color:white">Se tendrá en cuenta el cumplimiento de los requisitos específicos establecidos por cada isla.</span> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong><span style="color:#231f20">Punto 7. Listas de personas admitidas</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">El EBAP publicará la lista de personas admitidas en su página web (&lt;</span>http://ebap.caib.es&gt;) <span style="color:#231f20">y también comunicará individualmente la admisión a cada alumno.</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>​​​​​​​</strong></span></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>Punto 8. Anulación y modificación de los cursos y resolución de casos especiales</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">8.1. El EBAP, para desarrollar mejor las funciones que tiene encomendadas, puede suprimir cursos; organizar otros no programados con anterioridad por necesidades puntuales que han surgido; efectuar diversas ediciones siempre que las circunstancias lo aconsejen así, y modificar, si es pertinente, los contenidos, la duración, las fechas y los programas enunciados, para adaptarlos a los requerimientos de la formación.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">8.2. Corresponde a la Jefa del Departamento de Formación y Selección del EBAP, a propuesta de la coordinadora del FIOP, y una vez consultado el Servicio Jurídico del EBAP, resolver las dudas, las confusiones o las incidencias que puedan surgir sobre la aplicación de estas instrucciones, o sobre los casos concretos que no se prevean o que surjan de manera excepcional.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">8.3. Los comportamientos y las actitudes de los participantes en los cursos que impidan su desarrollo normal podrán dar lugar a la exclusión de los cursos, o a su modificación o cancelación, con el informe justificativo de la jefa del Departamento de Formación y Selección del EBAP, a propuesta de los jefes de estudios correspondientes.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong><span style="color:#231f20">Punto 9. Lista de espera</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">9.1. En todas las actividades formativas se pueden establecer plazas de reserva para cubrir las bajas o las renuncias que haya. La lista de espera se publicará en la página web del EBAP (&lt;</span>http://ebap.caib.es&gt;) <span style="color:#231f20">en el momento de la selección. </span>No se publicará ninguna actualización de la lista de espera, sino que el EBAP, permanentemente, la actualizará de manera interna.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">9.2. En cualquier caso, corresponde al EBAP la confirmación y la comunicación de la admisión a un curso.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong><span style="color:#231f20">Punto 10. Obligación de asistencia y comunicación de baja</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">10.1. Con la solicitud se contrae la obligación de asistir o acceder a la actividad formativa. Si no se puede asistir al curso se debe comunicar por escrito al EBAP y se debe justificar. El hecho de no comunicar una baja puede ser causa de exclusión de la acción formativa.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">10.2. <span style="color:#231f20">Las ausencias superiores al 20%</span> de la actividad formativa,, aunque estén justificadas, suponen la pérdida del derecho a obtener el certificado de asistencia obligatoria y el certificado de aprovechamiento que se regulan en el punto 12 de estas instrucciones.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="background-color:white">10.3 En general, las personas en situación de incapacidad laboral temporal no pueden asistir a los cursos del FIOP mientras dure esta situación. La incapacidad temporal se tiene que comunicar por escrito a la dirección electrónica <em>fiop@caib.es</em>, para cubrir, si procede, la plaza vacante.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:black"><span style="background-color:white">10.4 Respecto del punto anterior, se exceptúan los casos en los que se presente un informe médico a la EBAP que justifique que el seguimiento de las actividades es compatible con la incapacidad temporal y que la enfermedad no supone ningún riesgo para la salud de los participantes en los cursos presenciales.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>Punto 11. Número de personas asistentes </strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">11.1. En general, los cursos deben tener </span>entre diez y veinte alumnos<span style="color:#231f20"> en Mallorca y entre tres y 15 alumnos en Menorca e Ibiza. Esta cantidad puede aumentar o disminuir solo en el caso que la materia del curso y/o la estructura de la actividad formativa lo permitan.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong><span style="color:#231f20">Punto 12. Las actividades objeto de esta convocatoria dan lugar a obtener el certificado de asistencia o de aprovechamiento, según corresponda.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">12.2. Los alumnos que hayan asistido, como mínimo, al 80&nbsp;% de las horas lectivas </span>de los cursos, y que hayan superado las evaluaciones correspondientes, obtendrán el certificado de aprovechamiento; en caso de no superar la evaluación, obtendrán el certificado<span style="color:#231f20"> de asistencia obligatoria mínima, que no eximirá que pueda ser emitido un certificado de asistencia de las horas realizadas, siempre a criterio de la valoración de los técnicos del FIOP. Los conocimientos se evaluaran mediante la superación de pruebas escritas y/o trabajos, o mediante </span>otras modalidades de evaluación<span style="color:#231f20"> relacionadas con el contenido de la actividad formativa.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">12.3. La única forma de demostrar la asistencia a un curso es mediante la firma; por eso, los alumnos deben asegurarse que han firmado la hoja de control de entrada y de salida de cada una de las sesiones del curso al que asistan.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><span style="color:#231f20">12.4. Por otra parte, la falsificación de la firma supone la pérdida del derecho a certificado y la exclusión de los cursos del EBAP durante un año. </span>En cualquier caso, la firma debe coincidir con la del DNI o con la de la solicitud de inscripción. La penalización se hará extensible a la persona autora de la falsificación, independientemente de todas las otras acciones conforme a derecho que se puedan llevar a cabo.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black"><strong>Punto 13.
