La Resolución mencionada se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016, (BOIB núm. 81) y 26 de junio de 2018 (BOIB núm. 80).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de Miguel Seguí Cresp'í, entre otros, que figuran en el anexo de la Resolución de concesión, R14 de fecha 13 de diciembre de 2018, (BOIB núm. 26, de 28 de febrero de 2019) con los datos y los importes correspondientes (con una inversión aprobada de 5.184,44 €).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.En fecha 21 de octubre de 2019, se publicó en la web del FOGAIBA el requerimiento para que el beneficiario presentara la solicitud de pago, ya que el plazo para presentarla finalizó el 28 de agosto de 2019 .</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.El 22 de octubre de 2019, para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago así como la documentación exigida, pero, revisada esta, se comprueba que la inversión justificada y auxiliable es de 2.350,04 €, por tanto incumple la obligación que establece el punto 4 del apartado quinto de la convocatoria antes mencionada, que establece que la inversión auxiliable debe tener un importe mínimo de 3.500,00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.Por otra parte, dada la Resolución concesión de la ayuda mencionada, y de acuerdo con lo establecido en el punto 8 del apartado duodécimo de la convocatoria antes mencionada, en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada se ajustará la ayuda total concedida al importe de la inversión realizada, siempre que la finalidad de la subvención, dada su naturaleza, sea susceptible de satisfacción parcial, y siempre que se acerquen de manera significativa el cumplimiento total de los objetivos previstos y supongan al menos un 50% de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.Por todo ello, se propone hacer la revocación total a causa del incumplimiento de la obligación que la inversión auxiliable debe tener un importe mínimo de 3.500,00 €. Y además, el incumplimiento de la obligación que la inversión supongan al menos un 50% de ejecución de la cantidad total de inversión aprobada en la resolución de concesión inicial.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.En fecha 4 de noviembre de 2019 se notifica al interesado, mediante la publicación en la web, el Informe / Propuesta provisional de resolución de revocación total de 31 de octubre de 2019 por el incumplimiento de la obligación que la inversión auxiliable debe tener un importe mínimo de 3.500,00 €, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Una vez transcurridos los 10 días hábiles, el interesado no ha presentando ninguna alegación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.Se ha considerado el Informe / Propuesta provisional de resolución de 31 de octubre de 2019, de revocación total de la ayuda concedida a Miguel Seguí Crespí, con NIF 78208828L.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.Orden del Consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020 .</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resolución </span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Revocar totalmente la ayuda concedida a Miguel Seguí Crespí, con NIF 78208828L (exp. INEA2016_2 / 053), por un importe de 2.592,22 €, y que corresponde a la cofinanciación siguiente: un 53% al FEADER (1.373,88 € ), un 14,10% en la AGE (365,50 €) y un 32,90% en la CAIB (852,84 €), incluida en la Resolución de concesión (R10) de fecha 9 de abril de 2018 , ya que la inversión auxiliable no tiene un importe mínimo de 3.500,00 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Finalizar el procedimiento y archivar el expediente INEA2016_2 / 053).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Interposición de recursos</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif;
