La Resolución mencionada se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185) y en fecha 22 de junio de 2016, (BOIB núm. 81).</span></p> <p style="margin-bottom:0,0000pt; margin-top:5,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de Guillem Morro Pallicer, entre otros, que figuran en el anexo de la Resolución de concesión, R1 de 3 de junio de 2019 (BOIB núm. 82, de 20 de junio de 2019) am los datos y los importes correspondientes.</span></p> <p style="margin-bottom:0,0000pt; margin-top:5,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Considerando la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo establecido en el punto 8 del apartado duodécimo de la convocatoria antes mencionada, en los casos en los que se produzcan desviaciones entre la inversión realizada y la aprobada ajustará la ayuda total concedida al importe de la inversión realizada, siempre que la finalidad de la subvención, dada su naturaleza, sea susceptible de satisfacción parcial, y siempre que se acerquen de manera significativa al cumplimiento total los objetivos previstos.</span></p> <p style="margin-bottom:0,0000pt; margin-top:5,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, así como la documentación exigida, pero, una vez revisada la misma, se comprueba que el tractor adquirido es DEUTZ-FAHR modelo AGROKID 230 por un importe de 21.267,20 euros; un modelo diferente al modelo del tractor concedido Lamborghini RF 80 TRENT por un importe de 21.487,60 euros, dado este cambio se emitió el informe de moderación de costes con fecha 11 de octubre de 2019, que determina que el importe del tractor DEUTZ-FAHR AGROKID 230 es de 19.713,98 euros, el valor de mercado del producto es inferior al importe que se ha justificado.</span></p> <p style="margin-bottom:0,0000pt; margin-top:5,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que "Corresponde la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y corresponde el reintegro de las cantidades percibidas indebidamente ".</span></p> <p style="margin-bottom:0,0000pt; margin-top:5,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Con fecha 28 de octubre de 2019 se notifica al interesado, mediante la publicación en la web, el Informe/Propuesta provisional de resolución de revocación parcial de 25 de octubre de 2019, ya que la actuación subvencionable no se ajusta a lo establecido en el punto 2.b del apartado cuarto de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Transcurrido los 10 días hábiles, el interesado no ha presentado ninguna alegación.</span></p> <p style="margin-bottom:0,0000pt; margin-top:5,0000pt; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Se ha considerado el Informe /Propuesta provisional de resolución de 25 de octubre de 2019, de revocación parcial de la ayuda concedida a Guillem Morro Pallicer, con NIF 18224930Y.</span></p> <p style="margin-bottom:0,0000pt; margin-top:5,0000pt; text-align:justify"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></strong></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de julio de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.</span></p> <p style="text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.
