    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La alcaldía presidencia a fecha 20 de diciembre de 2019, inscripción 3875/2019, ha dictado la resolución que seguidamente se transcribe:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;«DECRETO DE LA ALCALDÍA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Modificación y unificación de los Decretos de la Alcaldía núm. 2029/2019, de 21 de junio, de delegaciones de competencias genéricas, especiales y territoriales, y núm. 2030/2019, de 24&lt;strong&gt; de junio, de delegación especial del área de Educación, Cultura y Deportes.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Mediante los decretos que se mencionan en el asunto se confirió, por parte de esta Alcaldía, las delegaciones de competencias que se estimaron oportunas con el fin de dotar de una mayor celeridad y eficacia las actuaciones y servicios municipales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Revisada su aplicación efectiva se han observado determinadas circunstancias que precisarían ser modificadas, a la vez que resulta aconsejable unificar las resoluciones de delegación adoptadas para una mejor y más ágil interpretación y tratamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estas modificaciones afectan básicamente a las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Se eliminan las delegaciones especiales a favor de tenientes de alcalde responsables de área que cuentan con delegaciones de tipo genérico. Las materias que eran objeto de estas delegaciones especiales añaden adicionalmente a las que ya ejercían como delegados de área.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Se excluye la facultad del concejales con delegación especial de poder dictar, por delegación de competencias, resoluciones de los expedientes mediante decreto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Se delegan en los Tenientes de Alcalde responsables de las respectivas áreas del ejercicio de las competencias y facultades que en materia de contratación administrativa pública, privada y de carácter patrimonial la legislación de contratos de las Administraciones Públicas otorga a la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por este motivo, y en uso de las atribuciones que me confieren los artículos 43 y 44 del Reglamento de organización, funcionamiento y régimen jurídico de las entidades locales,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESUELVO:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1º. Aprobar las modificaciones y el texto refundido de los Decretos de la Alcaldía núm. 2029 y 2030/2019, relativo a las delegaciones de atribuciones conferidas, de acuerdo con la redacción que figura en el anexo de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2º. Quedan derogados los Decretos de la Alcaldía núm. 2029 y 2030/2019, y cualesquiera otras que se opongan o contradigan lo dispuesto en este Decreto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3º. Notificarlo a las personas delegadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4º. Publicarlo en el boletín oficial de las Islas Baleares y en la sede electrónica municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5º. Dando cuenta al pleno en la próxima sesión que realice.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;”DELEGACIONES DE COMPETENCIAS GENERALES, ESPECIALES Y TERRITORIALES DEL MANDATO CORPORATIVO 2019-2023&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituida la Corporación Municipal por el periodo 2019-2023 en el Pleno del Ayuntamiento de fecha 15 de junio de 2019 después del proceso electoral de las elecciones municipales de 26 de mayo de 2019, y aprobada por Decreto de la Alcaldía de 21 de junio de 2019 la configuración de las Áreas o servicios en que se estructura la organización administrativa del Ayuntamiento de Manacor, esta Alcaldía considera conveniente proceder al establecimiento de un régimen de competencias de carácter general a favor de los miembros de la Junta de Gobierno Local y, de carácter especial, a favor de diferentes concejales / as, aunque no formen parte, con el fin de dotar de una mayor celeridad y eficacia a la actuación municipal, en uso de las facultades que me confieren los artículos 21.3 y 23.4 de la Ley 7/85, de 2 de abril, reguladora de las bases de régimen local (LRBRL).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con dicha legislación, esta Alcaldía puede delegar el ejercicio de sus atribuciones en los miembros de la Junta de Gobierno Local ya favor de diferentes concejales / as, aunque no formen parte, siempre y cuando se trate de materias que no se encuentren en los supuestos previstos por el artículo 21.3 LRBRL y por el artículo 40/2015, de 1 de octubre, de régimen jurídico del sector público, donde se regulan las competencias de la alcaldía que no son susceptibles de delegación y su régimen jurídico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1- Artículo 43 y 44 del ROF que establece que el Alcalde puede delegar sus atribuciones, excepto las de los artículos 21.3 y 71 de la Ley 7/1985 (LBRL) a favor de la Junta de Gobierno Local, como órgano colegiado ; en los miembros de la Junta de Gobierno local y delegaciones especiales para cometidos específicos a favor de concejales / as que no formen parte de la Junta de Gobierno Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estas delegaciones surtirán efecto desde el día siguiente a la fecha del decreto, excepto que en la resolución se dispone otra cosa, sin perjuicio de la preceptiva publicación en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2- Artículo 9 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, que establece que los órganos de las diferentes administraciones públicas podrán delegar el ejercicio de las competencias que tienen atribuidas en otras órgano de la misma administración, aunque no sean jerárquicamente dependientes, excepto las que el propio artículo establece que no pueden ser delegables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3- Artículo 3 a 7 del Reglamento orgánico municipal (ROM)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4- Artículos 45, 114 a 118 del RD 2568/86&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5- Artículo 12 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, que establece que los titulares de los órganos administrativos podrán, en materias de su competencia, delegar la firma de las resoluciones y actos administrativos en los titulares de los órganos o unidades administrativas que de ellos dependen, dentro de los límites señalados en el artículo 9.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En uso de las atribuciones que me confiere la legislación vigente,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;RESUELVO:&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I. DELEGACIONES genéricas.- Delegar a favor de los miembros de la Junta de Gobierno Local, y Tenencias de Alcaldía que se relacionan, una delegación general de atribuciones de gestión y resolución de los asuntos de las respectivas Áreas de actuación que se indican, de acuerdo con la atribución funcional de competencias de cada Área, y con los campos de actuación que a título meramente enunciativo y no limitativo, se recogen en el Decreto de la alcaldía de 21 de junio de 2019 respecto de cada Área, siendo las materias del Área de Alcaldía y Interior competencia de esta Alcaldía:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;I. Área de Urbanismo y Vivienda: Núria Hinojosa Abenza&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;II. Área de Medio Ambiente y Movilidad: Sebastián Llodrà Oliver&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;III. Área de Actividades y Servicios Generales: Carlos J. Grimalt García&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;IV. Área de Economía, Hacienda y Promoción: María Antonia Truyols&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;V. Área de Políticas Transversales: Carmen Gomila Domínguez&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;VI. Área de Educación, Cultura y Deportes: Mateu Marcé Riera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Área de Urbanismo y Vivienda: 1a. Teniente de Alcaldía, Sra. Nuria Hinojosa Abenza, el ejercicio de las atribuciones correspondientes a la responsabilidad de la dirección del área de URBANISMO y VIVIENDA. Las facultades delegadas comprenden el ejercicio de las competencias atribuidas genéricamente a dicha área, relativas al sector de la actividad administrativa propia de esta área de gestión municipal que la legislación vigente asigna a los municipios. Además de estas atribuciones generales, le corresponde a título indicativo y no limitativo, el ejercicio de las competencias específicas sobre las materias siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Planificación urbanística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Gestión urbanística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Disciplina urbanística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Licencias urbanísticas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Acceso a los núcleos de población&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Protección y gestión del patrimonio histórico&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Conservación y rehabilitación de la edificación&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Promoción y gestión de la vivienda de protección pública con criterios de sostenibilidad financiera&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Además, la delegación conferida abarca también las materias propias del Área de ECONOMIA, HACIENDA Y PROMOCIÓN siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fomento, diseño y promoción de la empresa y de la industria.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fomento del empleo.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Área de Medio Ambiente y Movilidad: 2r. Teniente de alcalde, Sr. Sebastián Llodrà Oliver, el ejercicio de las atribuciones correspondientes a la responsabilidad del área de MEDIO AMBIENTE y MOVILIDAD. Las facultadas delegadas comprenden el ejercicio de las competencias atribuidas genéricamente a dicha área, relativas al sector de la actividad administrativa propia de esta área de gestión municipal que la legislación vigente asigna a los municipios. Además de estas atribuciones generales, le corresponde a título indicativo y no limitativo, el ejercicio de las competencias específicas sobre las materias siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Control y seguimiento de la gestión y tratamiento de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Limpieza viaria&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Limpieza de edificios&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Promoción y seguimiento de la gestión del medio ambiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;LAS DELEGACIONES GENÉRICAS COMPORTARAN: tanto la facultad de dirigir los servicios correspondientes incluidos en las respectivas áreas, como las de gestionarlos en general, con inclusión de la facultad de resolver mediante actos administrativos que afecten a terceros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cualquier caso, el contenido de la delegación genérica conferida comprende el ejercicio de las competencias generales:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Programar las políticas municipales en las materias de su competencia, así como la representación e inspección del área de la que es titular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Ejercer la autoridad respecto del personal de su área.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Garantizar el cumplimiento de las ordenanzas, reglamentos, bandos y demás disposiciones legales que afecten al municipio, en el ámbito de las competencias del área.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ejercer las competencias y facultades en materia de contratación administrativa pública, privada y de carácter patrimonial que la legislación de contratos de las Administraciones Públicas asigna al Alcalde como órgano de contratación, incluyendo la adjudicación y formalización de los contratos correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.- Solicitudes de subvenciones en materias relacionadas con cada una de las áreas y aceptación de las subvenciones otorgadas, justificación de las mismas y en su caso la interposición de cualquier recurso derivados de los procedimientos de reintegros incoados por la Administración otorgante de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Ejercer la potestad sancionadora de las infracciones a las ordenanzas en los asuntos que conllevan su área, a menos que se traten de materias indelegables por ley o esté atribuida a otros órganos. Esta facultad no abarca la resolución de los recursos interpuestos contra las resoluciones adoptadas por el órgano delegado, que corresponden a la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Delegar en el concejal Sebastián Nadal Santandreu, la gestión, atención y seguimiento para la mejora de los servicios públicos en los núcleos de Porto Cristo, Cala Anguila, Cala Magrana, Cala Mendia, s'Estany den Mas, S'Illot, Cala Morlanda, Calas de Mallorca y Cala Murada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las delegaciones especiales territoriales conferidas se circunscriben al estudio y propuesta de las materias relacionadas con el ámbito de actuación territorial definido, incluida la firma de documentos de trámite, así como de ejecución, control y seguimiento de los actos y acuerdos municipales que tengan incidencia en el concreto ámbito territorial, pero sin incluir en ningún caso la facultad de resolver mediante actos administrativos que afecten a terceros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;PARA TODAS LAS DELEGACIONES GENÉRICAS, ESPECIALES Y TERRITORIALES&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Las competencias delegadas se ejercerán de acuerdo con lo previsto en los artículos 43 a 45 del ROF y en los términos y dentro de los límites de esta delegación, no siendo susceptibles de ser delegadas por sus titulares en ningún otro órgano o miembro de la corporación. Los delegados y delegadas deberán mantener informada a la alcaldía de la gestión de la competencia delegada y de los actos o disposiciones que ha llevado a cabo en virtud de la delegación. Igualmente deberán informar a la alcaldía con carácter previo a la adopción de decisiones de trascendencia, en los términos del artículo 115 ROF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las resoluciones que se adopten por delegación, que serán inmediatamente ejecutivas y presuntamente legítimas, y entenderán dictadas por esta Alcaldía como titular de la competencia originaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. De conformidad con el artículo 44.2 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, aprobado por Real Decreto 2568/1986, de 28 de noviembre, estas delegaciones tendrán efectos desde el día siguiente a la fecha de esta resolución y serán de carácter indefinido, sin perjuicio de la potestad de avocación de esta alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de ausencia, vacante, enfermedad o cualquier otro impedimento de los concejales delegados, asumirá directamente y automáticamente sus competencias esta alcaldía, como titular de la competencia originaria, entendiéndose a estos efectos ejercitada la potestad de avocación, en base a la presente resolución, sin necesidad de una nueva resolución expresa en este sentido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;IV. Dar cuenta de la presente resolución al Pleno en la sesión extraordinaria que se convoque de conformidad con el artículo 38 ROF; notificarla personalmente a los designados y publicarla en el Boletín Oficial de las Islas Baleares y en el tablón de anuncios del ayuntamiento, en cumplimiento de lo dispuesto en el artículo 44.2 del Real Decreto 2568/1986, de 28 de noviembre , por el que se aprueba el Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, y difundirla, de acuerdo con el principio de transparencia, mediante su publicación actualizada y permanente en la sede electrónica municipal, en cumplimiento de lo dispuesto en los artículos 5 y siguientes de la Ley 19/2013, de 9 de diciembre, de Transparencia, Acceso a la Información y Buen Gobierno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;V. Comunicar esta resolución a todos los concejales afectados ya los responsables de los diferentes servicios municipales, para su conocimiento y efectos, entendiéndose aceptada la delegación de competencias de forma tácita, si dentro del plazo de tres días hábiles contados desde la notificación de la resolución, el destinatario no hace manifestación expresa ante el órgano delegante de que no acepta la delegación, según lo establecido en el artículo 114 del ROF »&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
