    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 21 de diciembre de 2018, por la cual se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;El vicepresidente, con fecha 26 de noviembre&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#000000"&gt;&lt;span&gt;&amp;nbsp;de 2019&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El 29 de diciembre de 2018 se publicó en el BOIB núm. 63, la Resolución del Presidente del FOGAIBA de fecha 21 de diciembre de 2018, por la que se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños a los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes terminó el día 02.28.2019.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;3. En fecha 18 de octubre de 2019, se dictó la Resolución de concesión de la Remesa 5 que incluye el expediente PIFO 2018_1/004 a nombre de Sebastián Abrines Capó, con NIF 41358694W, que se publicó en el BOIB núm. 148 el 31 de octubre de 2019.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;4. El interesado solicitó, con fecha 6 de noviembre de 2019, la subrogación de la ayuda a él concedida a favor de Javier Benitez Capitán, titular del expediente PIFO 2018_1/005 y que aceptó esta subrogación.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;5. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas establece la obligación de la Administración a dictar resolución expresa y a notificarla. En su párrafo segundo especifica que "En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con la indicación de los hechos producidos y las normas aplicables".&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;6. Por todo ello, se informa favorablemente y se propone hacer la revocación total de la ayuda a petición del interesado.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;2. Revocar totalmente la ayuda a Sebastián Abrines Capó, con NIF 41358694W y PIFO 2018_1/004 por el importe antes citado que iba con financiación del ITS y con cargo al presupuesto de la anualidad 2018.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;3. Finalizar el procedimiento y archivar el expediente PIFO 2018_1/004.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;4. &lt;p&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el consejero de Medio Ambiente, Agricultura y Pesca, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
