    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Se hace público que la Comisión de Gobierno del Consell Insular d'Eivissa ha adoptado por unanimidad, en sesión de fecha 20 de diciembre de 2019, el acuerdo que seguidamente se relaciona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Este acuerdo se ha adoptado por delegación del Pleno de la Corporación y, de conformidad con lo previsto en el artículo 9.4 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, se considera dictado por el órgano delegante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;En consecuencia, y de acuerdo con el artículo 22.1 &lt;em&gt;a&lt;/em&gt; de la Ley 8/2000, de 27 de octubre, de &lt;em&gt;consells insulars&lt;/em&gt;, y con el artículo 114.1 &lt;em&gt;c&lt;/em&gt; de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, este acuerdo pone fin a la vía administrativa y, según lo previsto en los artículos 123 y 124 de esta última ley, se puede interponer potestativamente recurso de reposición en el plazo de un mes contador des del día siguiente al de la su publicación, o ser impugnado directamente ante el orden jurisdiccional contencioso administrativo (ante los juzgados contenciosos administrativos de Palma) en el plazo de dos meses contadores a partir del día siguiente de su publicación, de acuerdo con el artículo 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;“(…)&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;2. Propuesta del &lt;/strong&gt;&lt;em&gt;&lt;strong&gt;conseller executiu&lt;/strong&gt;&lt;/em&gt;&lt;strong&gt; del &lt;/strong&gt;&lt;em&gt;&lt;strong&gt;Departament d'Esports i Joventut&lt;/strong&gt;&lt;/em&gt;&lt;strong&gt;, en relación con la fijación del precio público para la prestación del espectáculo y actuación musical del Grupo “Pica Pica”, el día 12 de enero de 2020, que se realizará en el Recinto Ferial, organizado por el &lt;/strong&gt;&lt;em&gt;&lt;strong&gt;Departament d'Esports i Joventut&lt;/strong&gt;&lt;/em&gt;&lt;strong&gt;, exp. MyTAO núm. 2019/00018675L.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Habiéndose presentado una propuesta, del tenor siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;"De conformidad con la Providencia de inicio de 25 de octubre de 2019 del &lt;em&gt;conseller executiu del Departament d'Esports i Joventut&lt;/em&gt; sobre la fijación del precio público para la prestación del servicio del espectáculo y actuación musical del grupo “Pica Pica”, dirigido a los niños de Eivissa, que se realizará en el Recinto Ferial, organizado por el &lt;em&gt;Departament d'Esports i Joventut&lt;/em&gt;, fué emitido informe técnico-económico e informe jurídico por los servicios correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Asimismo, la tesorera de este Consell Insular en virtud de las atribuciones de tesoreria y recaudación establecidas en el artículo 196 del texto refundido de la Ley reguladora de las Haciendas Locales, aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo, y en atención a las facultades recogidas en el artículo 5.2.b) del Real Decreto 128/2018, de 5 de marzo, por el que se regula el régimen jurídico de los funcionarios de la Administración Local con habilitación de carácter nacional ha emitido informe y propuesta de Acuerdo regulador del precio público para la actuación del grupo “Pica Pica” del tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;«PRIMERO.- &lt;/strong&gt;De conformidad con lo previsto en el texto refundido de la Ley reguladora de las haciendas locales, aprobado por real decreto legislativo 2/2004, de 5 de marzo, las entidades locales dispondrán de recursos suficientes para el cumplimiento de sus finalidades, recursos entre los que se encuentran los percibidos en concepto de precios públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Visto lo anterior y la potestad reglamentaria otorgada a las entidades locales por el artículo 4.1.a) de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, será posible establecer y exigir precios públicos a través de sus propios acuerdos reguladores, atribución que viene conferida al pleno, conforme dispone el artículo 33.2. y 47.1 de la citada ley, pudiendo ser delegada en la Comisión de Gobierno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;En este sentido, el Pleno del Consell Insular, en sesión de fecha 31 de julio de 2015, acordó delegar en la Comisión de Gobierno la competencia para establecer o modificar los precios públicos para la prestación de servicios o para la realización de actividades emanadas de las competencias conferidas al &lt;em&gt;Departament d'Esports i Joventut&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;La validez del acuerdo requerirá el voto favorable de la mayoría simple de los miembros presentes, com se establece en el artículo 47.1 de la misma norma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Tendrán la consideración de precios públicos las contraprestaciones pecuniarias que se satisfagan para la prestación de servicios o la realización de actividades efectuadas en régimen de derecho público cuando, prestándose también tales servicios o actividades por el sector privado, sean de solicitud voluntaria por parte de los administrados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;SEGUNDO.- &lt;/strong&gt;La legislación aplicable es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Artículos 41 a 47 y 148 del texto refundido de la Ley reguladora de las haciendas locales, aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Los artículos 33.2, 47.1, 70.2,148 y 157 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Los artículos 24 a 27 de la Ley 8/1989, de 13 de abril, de Tasas y Precios Públicos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;El informe técnico-económico de fecha 18 de noviembre de 2019 emitido por el técnico del &lt;em&gt;Departament d'Esports i Joventut&lt;/em&gt;, relativo a la fijación del precio público para la prestación del servicio de espectáculo i actuación musical del grupo Pica Pica, dirigido a los niños y niñas de Eivissa que se realizará en el Recinto Ferial el 12 de enero de 2020, organizado por el &lt;em&gt;Departament d'Esports i Joventut&lt;/em&gt;, ha incluido las siguientes determinaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;- El coste aproximado de la actuación prevista es de 78.100 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;- Considera que un precio adecuado que permitiría el acceso al concierto a un máximo de ciudadanos sería el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Precio venta para menores de edad: 8 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Precio venta para mayores de edad: 12 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;- La previsión de venta es de 500 entradas para menores de edad y 500 para mayores, lo que hace una recaudación estimada de 10.000 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;- Considera que concurren razones sociales, culturales i de interés público que aconsejen fijar un precio público que resulte inferior a los costes económicos originados por la prestación del servicio, los cuales quedan acreditados en el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;CUARTO.- &lt;/strong&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;A la vista de las cifras anteriores se desprende:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;A. &lt;/strong&gt;Que el importe de la recaudación prevista por el mismo, no cubre los costes económicos originados por la prestación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;B.- &lt;/strong&gt;Que la cuantía a exigir y liquidar por el referido precio público no cumple el principio de equivalencia. Al tratarse de un servicio que se presta por razones sociales, y tal como ha informado en el informe técnico-económico el funcionario del &lt;em&gt;Departament d'Esports i Joventut&lt;/em&gt;, el presupuesto del &lt;em&gt;Consell Insular&lt;/em&gt; prevé la dotación suficiente para atender la diferencia resultante y garantizar la financiación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;QUINTO.- &lt;/strong&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Vistas las anteriores disposiciones legales y los informes que obran en el expediente, propone a la &lt;/span&gt;&lt;em style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;consellera executiva del Departament d'Economia i Hisenda i Desenvolupament Empresarial&lt;/em&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;, por tal que, proponga a la Comisión de Gobierno, de conformidad con lo establecido en el apartado Tercero, 5 d) del Decreto de Presidencia núm. 2019000471, de fecha 10 de julio de 2019 (BOIB núm. 95 de 11 de julio de 2019) de estructura del Gobierno del &lt;/span&gt;&lt;em style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Consell Insular d'Eivissa&lt;/em&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; y creación de Departamentos, la siguiente PROPUESTA:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;PRIMERO.- &lt;/strong&gt;Aprobar el establecimiento del precio público i el acuerdo regulador del mismo que sigue:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;ACUERDO REGULADOR DEL PRECIO PÚBLICO PARA LA ACTUACIÓN DEL GRUPO PICA PICA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 1.- Fundamento i objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Esta entidad local, en uso de las facultades otorgadas en los artículos 41 a 47, 148 y 157 del texto refundido de la Ley reguladora de las Haciendas Locales, aprobado por el Real Decreto Legislativo 2/2004, de 5 de marzo, establece el presente precio público a satisfacer para la entrada a la actuación del grupo Pica Pica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 2.- Hecho imponible&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Constituye el hecho imponible de este precio público la asitstencia a la actuación del grupo Pica Pica organizado por el &lt;em&gt;Consell Insular d'Eivissa&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 3.- Obligados al pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Están obligados al pago del precio público regulado en este Acuerdo, las personas físicas que asistan a la actuación del grupo Pica Pica organizada por el &lt;em&gt;Consell Insular d'Eivissa&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 4.- Cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;La cuantía del precio público regulado en este Acuerdo será la cuantía establecida en la siguiente tarifa por entrada:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;ENTRADA IMPORTE&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Infantil, menor de edad 8 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Adulto, mayor de edad 12 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 5.- Nacimiento y extinción de la obligación de pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;1. La obligación de pagar el precio público nace desde el momento en que se inicie la prestación del servicio, o la realización de la actividad. Se entiende que se inicia su prestación desde el momento en que se acceda o se tenga la posibilidad de acceder al recinto donde se realiza la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;2. No obstante, se exigirá el depósito previo del precio público que se efectuará a través de la adquisición de la entrada correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;3. Cuando por causas no imputables al obligado el pago de la tarifa de entrada no fuese posible la prestación de la actividad, se procederá a la devolución del importe correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 6.- Normas de gestión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;1. El pago del precio público se exigirá en régimen de auto-liquidación y se hará efectivo en el momento de solicitar la entrada. Su gestión se efectuará a través de venta directa en taquilla en efectivo o a través de venta telemática con tarjeta de crédito, i con carácter previo al acceso al recinto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;2. La entrada que justifica el pago del servicio constará de recibo numerado con la indicación de la fecha, importe, denominación del espectáculo y hora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;3. Corresponde a la &lt;em&gt;Conselleria d'Esports i Joventut&lt;/em&gt; en coordinación con la Tesorería, e ordenamiento, funcionamiento y gestión de la venta de entradas señaladas en el párrafo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 7.- Normas complementarias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;En todo aquello no previsto en el presente texto regulador y que haga referencia a la aplicación, gestión, liquidación, inspección i recaudación de este precio público, se estará a aquello previsto en la Ley General Presupuestaria y demás legislación de carácter local y general que le sea de aplicación, en especial el texto refundido de la Ley reguladora de las Haciendas Locales, la Ley 8/1989, de Tasas y Precios Públicos y el Reglamento General de Recaudación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 8.- Entrada en vigor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;El presente precio público y su acuerdo regulador, entrará en vigor el día siguiente al de la publicación de su texto íntegro en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, y continuará en vigor hasta su modificación o derogación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;SEGUNDO.- &lt;/strong&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Publicar el texto íntegro del acuerdo regulador en el &lt;/span&gt;&lt;em style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Sobre la base de todo lo anterior, se eleva a la Comisión de Gobierno, de conformidad con lo establecido en el apartado Tercero, 5 d) del Decreto de Presidencia núm. 2019000471, de fecha 10 de julio de 2019 (BOIB núm. 95 de 11 de julio de 2019) de estructura del Gobierno del &lt;em&gt;Consell Insular d'Eivissa&lt;/em&gt; y creación de Departamentos, la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;PROPUESTA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;PRIMERO.- &lt;/strong&gt;Aprobar el establecimiento del precio público i el acuerdo regulador del mismo que sigue:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;ACUERDO REGULADOR DEL PRECIO PÚBLICO PARA LA ACTUACIÓN DEL GRUPO PICA PICA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 1.- Fundamento y objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Esta entidad local, en uso de las facultades otorgadas en los artículos 41 a 47, 148 y 157 del texto refundido de la Ley reguladora de las Haciendas Locales, aprobado por el Real Decreto Legislativo 2/2004, de 5 de marzo, establece el presente precio público a satisfacer para la entrada a la actuación del grupo Pica Pica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 2.- Hecho imponible&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Constituye el hecho imponible de este precio público la asistencia a la actuación del grupo Pica Pica organizado por el &lt;em&gt;Consell insular d'Eivissa&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 3.- Obligados al pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Están obligados al pago del precio público regulado en este Acuerdo, las personas físicas que asistan a la actuación del grupo Pica Pica organizada por el &lt;em&gt;Consell Insular d'Eivissa&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 4.- Cuantía&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;La cuantía del precio público regulado en este Acuerdo será la cuantía establecida en la siguiente tarifa por entrada:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;ENTRADA IMPORTE&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Infantil, menor de edad 8 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;Adulto, mayor de edad 12 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;Artículo 5.- Nacimiento y extinción de la obligación de pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;1. La obligación de pagar el precio público nace desde el momento en que se inicie la prestación del servicio, o la realización de la actividad. Se entiende que se inicia su prestación desde el momento en que se acceda o se tenga la posibilidad de acceder al recinto donde se realiza la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;2. No obstante, se exigirá el depósito previo del precio público que se efectuará a través de la adquisición de la entrada correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;El presente precio público y su acuerdo regulador, entrará en vigor el día siguiente al de la publicación de su texto íntegro en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, y continuará en vigor hasta su modificación o derogación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;SEGUNDO.- &lt;/strong&gt;Publicar el texto íntegro del acuerdo regulador en &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
