    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 21 de diciembre de 2018, por la cual se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El 29 de diciembre de 2018 se publicó en el BOIB núm. 63, la Resolución del Presidente del FOGAIBA de fecha 21 de diciembre de 2018, por la que se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños a los bosques por incendios forestales, desastres naturales y catástrofes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#000000"&gt;&lt;span&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes terminó el día 02.28.2019.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#000000"&gt;&lt;span&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El interesado Agropecuaria Sa Senalla sl, con NIF B16529042 y núm. de expediente Pifo 2018_1 / 016, ha presentado dentro del plazo establecido y en la forma, la documentación prevista en la convocatoria y se ha comprobado que cumple con los requisitos exigidos para poder ser beneficiarios de esta ayuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,9500pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#000000"&gt;&lt;span&gt;&lt;em&gt;5. Una parte de la inversión solicitada no es elegible dado que el precio presupuestado supera al de referencia.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,9500pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#000000"&gt;&lt;span&gt;&lt;em&gt;6. La resolución provisional de concesión parcial se comunicó a los interesados, mediante la publicación en la web del Fogaiba el pasado 28 de octubre. Se envió un sms al móvil de cada solicitante informando de esta publicación.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,9500pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#000000"&gt;&lt;span&gt;&lt;em&gt;7. &lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;1. Conceder la ayuda solicitada al beneficiario Agropecuaria Sa Senalla sl, con NIF B16529042 y núm. de expediente Pifo 2018_1 / 016, por un importe total de 9.828,80 euros, relativa a la línea de ayuda "Prevención de los daños en bosques producidos por incendios, desastres naturales y catástrofes". La parte de inversión no elegible es 2.559,30 €, dado que el precio presupuestado supera al de referencia.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;2. Autorizar y disponer el gasto señalada en cada uno de los beneficiarios con cargo al presupuesto de la anualidad del 2019 y con financiación del Impuesto de Turismo Sostenible de la CAIB.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Determinar que, de acuerdo con lo establecido en la convocatoria de referencia, las obligaciones del beneficiario son las indicadas en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
