    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento Pleno en sesión celebrada el día 17 de octubre de 201 9 aprobó inicialmente la modificación de la ordenanza fiscal reguladora de la tasa sobre el servicio del cementerio y otros servicios fúnebres de carácter municipal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sometido el acuerdo al trámite de información pública y no habiéndose presentado alegaciones dentro del plazo, se ha procedido a elevar automáticamente a definitivo el acuerdo hasta entonces inicial.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con lo establecido en los apartados 3 y 4 del artículo 17 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, se publica el texto íntegro de la Ordenanza que entrará en vigor el día 1 de enero de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;" ORDENANZA FISCAL REGULADORA DE LA TASA SOBRE EL SERVICIO DE CEMENTERIOS Y OTROS SERVICIOS FÚNEBRES DE CARÁCTER MUNICIPAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 1. Fundamentos y naturaleza.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución española y por el artículo 106 de la Ley 7/1985, y de conformidad con lo dispuesto en los artículos del 15 al 19 del RD Legislativo 2 / 2004, de 05 de marzo, que aprueba el Texto refundido de la Ley reguladora de las haciendas locales, el Ayuntamiento de Inca continúa exigiendo la tasa sobre el servicio de cementerios y otros servicios fúnebres de carácter municipal, que se regirá por la presente ordenanza fiscal , las normas atienden a lo dispuesto en el artículo 57 del RD legislativo mencionado anteriormente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta Ordenanza también se dicta para desarrollar el artículo 144 de la vigente Ordenanza municipal del cementerio y policía sanitaria mortuoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 2. Hecho imponible.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituye el hecho imponible de la tasa la prestación de servicios públicos en el cementerio municipal, la cremación y otros servicios funerarios especificados en las tarifas contenidas en la presente ordenanza.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 3. Sujetos pasivos.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son sujetos pasivos de la tasa en concepto de contribuyentes, las personas físicas y jurídicas, así como las entidades a que se refiere el artículo 33 de la Ley General Tributaria, que soliciten o resulten beneficiadas o afectadas por los servicios funerarios que constituyen el hecho imponible de la tasa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 4. Responsables&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas o jurídicas a que se refiere el artículo 42 de la Ley General Tributaria (Ley 58/2003, de 17 de diciembre).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) Son responsables subsidiarios los administradores / as de las sociedades y los síndicos / sindicas, interventores / as o liquidadores / as de quiebras, concursos, sociedades y entidades en general en los supuestos y con el alcance que señala el artículo 43 de la Ley general tributaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 5. Devengo.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El devengo nace a partir de la autorización de la prestación de los servicios o actividades, o de la concesión de los derechos regulados en la tarifa de esta ordenanza.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La tasa del Servicio Conservación y Atención del Cementerio, en cuyo caso la obligación debe ser anual; nace por primera vez con la concesión de la unidad de enterramiento (según la descripción que realiza el artículo 17 de la vigente Ordenanza del cementerio y policía sanitaria mortuoria, a partir de ahora OMCPSM, y el primer día de cada anualidad para los ejercicios posteriores).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 6. Exenciones.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Están exentos del pago de estas tasas:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Estarán exentos del pago del servicio de inhumación, exhumación y los gastos de administración, conservación, vigilancia, limpieza y decencia del cementerio, aquellas personas con total falta o grave insuficiencia de medios económicos.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La valoración de estos medios y concesión en su caso de exención corresponderá al Ayuntamiento previo informe de los servicios sociales municipales. Se requisito indispensable que el domicilio mortuorio del muerto radique en este municipio.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Las exhumaciones ordenadas por la autoridad judicial.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 7. Cuota tributaria.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;La cuota tributaria se determinará por la aplicación de las siguientes tarifas:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1. Concesión de los derechos funerarios de terrenos para construir unidades de enterramiento: &lt;/strong&gt;en la concesión a personas naturales o jurídicas de terrenos para la construcción de capillas, criptas, sepulturas, etc., en cada caso particular, la tarifa a percibir debe fue determinada por medio de la valoración técnica. La cesión de estos terrenos obliga a los titulares de la concesión a construir las capillas, criptas, sepulturas, etc., proyectadas en el plazo que marca el artículo 33 del OMCPSM de conformidad con la licencia urbanística solicitada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. Concesiones de los derechos funerarios de unidades terminadas según proyecto&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;municipal regulador: &lt;/strong&gt;en la cesión de derechos funerarios a perpetuidad de capillas, criptas, sepulturas, nichos, etc., los tipos de percepción deben ser determinados por el Ayuntamiento en pleno y deben estar en relación con el coste de la obra realizada y la superficie del solar que ocupe. Como coste de la obra hay que imputar, además del coste previsto de ejecución del proyecto, los intereses de los posibles créditos que la financian, el valor de los terrenos que se hayan ocupado y, en definitiva, el valor de todos aquellos elementos que, directa o indirectamente, determinen este coste, como explicita el artículo 24, apartado segundo del RD legislativo 2/2004, de 5 de marzo, que aprueba el Texto refundido de la Ley reguladora de las haciendas locales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. Para atender los gastos de administración, conservación, vigilancia, limpieza y decencia del cementerio &lt;/strong&gt;se satisfarán por unidad y año las siguientes cuotas:&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se establecen tres tarifas;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1era Tarifa.- Inhumaciones o enterramientos realizados de lunes a viernes de las 7 a las 14 horas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2ª Tarifa.- Inhumaciones o enterramientos que se realicen a partir de las 14 horas de lunes a viernes o las que se realicen en sábado.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3era Tarifa.- Inhumaciones o enterramientos que se realizan a las personas físicas que sean titulares o co-titulares de un derecho funerario a perpetuidad de una unidad de enterramiento del cementerio municipal de Inca o sean parientes del titular hasta el cuarto grado de consanguinidad o segundo grado por afinidad o cónyuge del titular, tarifa que no se podrá aplicar a las inhumaciones o enterramientos que se realicen a partir de las 14 del lunes a viernes y las que se realicen en sábado.&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 8. Administración ó y cobro&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Las personas naturales o jurídicas interesadas en la obtención de los servicios objeto de esta ordenanza deben solicitarlos mediante una instancia dirigida al Alcalde-Presidente con la documentación reglamentariamente exigible.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En la Secretaría General se lleva un registro de solicitudes de concesiones de derechos de unidades funerarias, a los efectos de control y seguimiento de las futuras concesiones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Para la autorización de cualesquiera de los servicios que se prestan en el Cementerio Municipal, además de lo dispuesto en el artículo 83 del OMCPSM es obligatoria la acreditación previa del pago del último recibo puesto al cobro por el concepto de conservación del cementerio Municipal, y no es de aplicación el artículo 84 de la referida Ordenanza de cementerio y policía sanitaria. Asimismo, la persona / ondas encargada / as de prestar los referidos servicios recordará / recordarán a las personas solicitantes la obligación de proceder a los cambios de titularidad que en su caso se provoquen, como se describe en el artículo 108 de la referida Ordenanza municipal del cementerio y policía sanitaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La Alcaldía podrá autorizar convenios de colaboración en la gestión de los servicios descritos en las tarifas de la presente Ordenanza.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 9.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Se practicará la liquidación de acuerdo con la legislación tributaria con arreglo a los informes que se encuentran en este ayuntamiento los servicios, actividades y derechos autorizados, en cada caso, que permita esta.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. A los efectos de aplicación y efectividad de la tasa por servicios de conservación de cementerios y servicios análogos, contenidos en las tarifas de esta ordenanza, se renovará anualmente el padrón correspondiente de contribuyentes de estos servicios, y se formarán los recibidos por el cobro de la tasa correspondiente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 10.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Las cuotas liquidadas y no satisfechas a su tiempo se harán efectivas por la vía de apremio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. De conformidad con el artículo 108 del OMCPSM, la falta de pago de cinco años seguidos de los derechos de devengo anual de conservación del Cementerio provoca la declaración de caducidad del derecho funerario oportuno.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 11. Partidas por cobrar quiebras&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se consideran partidas fallidas aquellas cuotas que no hayan podido hacerse efectivas por la vía de apremio, y para su declaración se formalizará el oportuno expediente de acuerdo con lo previsto en el Reglamento vigente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 12. Defraudación y penalidad&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las infracciones y fraudes de los derechos de esta exacción municipal, sin perjuicio del pago de las cantidades defraudadas por las personas interesadas, se ajustarán a lo dispuesto en los artículos contenidos en el título IV, de la Ley Tributaria (Ley 58/2003, de 17 de diciembre).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición transitoria. &lt;/strong&gt;El servicio de velador se mantendrá vigente en la ordenanza fiscal existente mientras no se apruebe definitivamente la nueva ordenanza reguladora del precio público por la prestación del servicio del velatorio municipal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Disposición final única. Vigencia.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta Ordenanza, una vez aprobada, entrará en vigor el día 1 de enero de 2020 y continuará en vigor hasta que se apruebe su derogación o su modificación. "&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el presente acuerdo se podrá interponer por los interesados recurso contencioso-administrativo, ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de Baleares, dentro del plazo de dos meses desde el día siguiente a la publicación del presente acuerdo en el Boletín Oficial de la Comunidad Autónoma de las Islas Baleares, de conformidad con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/p&gt;
