    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En fecha 12 de diciembre de 2019, el director general de Movilidad y Transporte Terrestre ha formulado la siguiente propuesta de resolución:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El 10 de octubre de 2019, el Ayuntamiento de Pollença va presentar a la Direcció General de Mobilitat i Transportes una solicitud de informe técnico para la Comisión de Precios en relación a la implantación de las tarifas del servicio de transporte urbano de viajeros de taxi de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El 11 de octubre de 2019 se solicita al Ajuntamiento de Pollença la correción del estudio aportado y en fecha 31 de octubre de 2019 el consistorio aporta las modificaciones solicitado, así como el cómputo de los ingresos que generarian los nuevos suplementos de “caminos rurales” y el “trayecto Formentor”.No obstante, no se ha aportado la justificación técnica ni&amp;nbsp; económica de los citados suplementos, por lo que , no procede su valoración ni inclusión en el cuadro de tarifas urbanas&amp;nbsp; de servicio de taxi de Pollença&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El 14 de noviembre de 2019, los técnicos &amp;nbsp;de gestión econòmica del Consorci de Transports de Mallorca realizaron&amp;nbsp; un informe técnico favorable a la propuesta para la implantación &amp;nbsp;de las tarifas aprobadas por el Ajuntamiento de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. La Comisión de Precios de las Illes Balears, en la sesión de 11 de diciembre de 2019, examinó el expediente y adoptó el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Dictaminar favorablemente la implantación de las tarifas solicitada por el Ayuntamiento de Pollença con relación a los servicios de transporte urbano de viajeros en taxi para el año 2019, que será la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. El Real Decreto-ley 7/1996, de 7 de junio, sobre medidas urgentes de carácter fiscal y de fomento y liberalización de la actividad económica (BOE nº139, de 8 de junio).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. El Decreto 30/2013, de 14 de junio, por el que se crea la Comisión de Precios del Agua y los Transportes Urbanos y se regula la composición y el funcionamiento (BOIB nº85, de 15 de junio de 2013).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. El Decreto21/2019, de 2 de agosto, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB nº106, de 2 de agosto de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. El Decreto22/2019, de 19de agosto, de la presidenta de las Illes Balears, por el que se rectifica el Decreto21/2019, de 2 de agosto, de la presidenta de las Illes Balears , por el que se modifica el Decreto 12/2019 de 2 de julio, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB nº116, de 24 de agosto de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Propuesta de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Propongo al consejero de Movilidad y Vivienda que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Publicar la resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Informar de que la resolución entrará en vigor el día siguiente al de su publicación en el &lt;em&gt;Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra esta Resolución, que agota la vía administrativa, se podrá interponer un recurso potestativo de reposición ante el consejero de Movilidad y Vivienda en el plazo de un mes desde el día siguiente al de la notificación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;También se podrá interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses desde el día siguiente al de la notificación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
