    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento en Pleno en sesión celebrada el día 17 de octubre de 2019 aprobó inicialmente la modificación de la ordenanza fiscal reguladora de la tasa por entrada de vehículos a trabas de las aceras y las reservas de la vía pública por aparcamiento exclusivo y carga y descarga de mercancías de cualquier clase.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;Sometido el acuerdo al trámite de información pública y no habiéndose presentado alegaciones dentro del&amp;nbsp; plazo, se ha procedido a elevar automáticamente a definitivo el acuerdo hasta entonces inicial.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En conformidad con aquello establecido en los apartados 3 y 4 del artículo 17 del Real decreto legislativo 2/2004, de 5 de marzo, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, se publica&amp;nbsp; el texto íntegro de la Ordenanza que entrará en vigor el día 1 de enero de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;"ORDENANZA FISCAL REGULADORA DE LAS TASAS MUNICIPALES POR ENTRADA DE VEHÍCULOS A TRAVÉS DE LAS ACERAS Y LAS RESERVAS DE VÍA PÚBLICA POR APARCAMIENTOS EXCLUSIVOS Y CARGA O DESCARGA DE MERCANCÍAS DE CUALQUIER CLASE&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 1. Cimiento y naturaleza.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En conformidad con el que prevén los artículos 133.2 y 142 de la Constitución Española, el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y en conformidad con los artículos del 15 al 19 del RD legislativo 2/2004, de 5 de marzo, que aprueba el Texto refundido de la Ley reguladora de las haciendas locales, este ayuntamiento continúa exigiendo en conformidad con la presente ordenanza fiscal la tasa por entrada de vehículos a través de las aceras y las reservas de vía pública por aparcamientos exclusivos y carga o descarga de mercancías de cualquier clase.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 2. Hecho imponible.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituye el hecho imponible de esta tasa la utilización privativa o el aprovechamiento especial de los terrenos del dominio público local, con autorización municipal, por entrada de vehículos a través de las aceras y las reservas de vía pública por aparcamientos exclusivos y carga o descarga de mercancías de cualquier clase.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 3. Sujetos pasivos.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Su sujetos pasivos de esta tasa las personas físicas y jurídicas y entidades e el artículo 35.4 de la Ley General Tributaria a favor de las cuales se otorguen la autorización o las que se beneficien del aprovechamiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Su sujetos pasivos en concepto de sustituto del contribuyente los propietarios de los inmuebles donde se dé el hecho imponible de esta ordenanza para la entrada de vehículos y vados permanentes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.&amp;nbsp; Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas o jurídicas a que hace referencia en el artículo 42 de Ley General Tributaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Serán responsables subsidiarios los administradores de las sociedades y los síndicos, interventores o liquidadores de quiebras, concursos, sociedades y entidades en general, en los supuestos y ámbito que dispone el artículo 43 de la Ley general tributaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 4. Base imponible.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La base imponible de esta ordenanza vendrá determinada por los metros cuadrados o lineales, necesarios o empleados por el beneficiario de la tasa regulada en esta ordenanza. Como mínimo se tomará por base imponible cuatro metros lineales, en el supuesto de vados permanentes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. A los efectos previstos para aplicar las tarifas contempladas en esta ordenanza, las vías públicas de este municipio se clasifican en las categorías relacionadas en su disposición adicional. Cuando el espacio afectado por el aprovechamiento esté situado en la confluencia de dos o más vías públicas clasificadas en categoría diferente, se aplicará la tarifa que corresponda a la vía de categoría superior.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 5. Base liquidable.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No se admite ningún tipo de reducción de la base imponible declarada o comprobada por la Administración.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 6. Cuota tributaria.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La cuota tributaria se determinará de acuerdo con las siguientes tarifas:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.1.a) Por metro lineal de reserva permanente de espacio en la vía pública&amp;nbsp; por aparcamientos exclusivos y carga y descarga de mercancías de cualquier clase&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.ª categoría&amp;nbsp;&amp;nbsp; &amp;nbsp;19,10 €&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2ona categoría&amp;nbsp;&amp;nbsp; &amp;nbsp;15,14 €&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.ª categoría&amp;nbsp;&amp;nbsp; &amp;nbsp;11,48 €&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.b) Lo pintado de los primeros cuatro metros se considera incluido en las tarifas anteriores.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.1.c) Por la instalación de uno pilón al límite de la línea de reserva permanente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Setenta y nueve euros con veinticinco céntimos, año de lo instalación; por pilón. Incluye el precio del pilón y las tareas de instalación.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.1.d) Diez euros con dieciséis céntimos, año posterior y siguientes; por pilón. Incluye el mantenimiento y la sustitución si se el caso.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.1.e) Por la adquisición de la placa indicadora del decreto de autorización de vado permanente&amp;nbsp;&amp;nbsp; &amp;nbsp;21,34 €&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 7. Normas de gestión.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Esta sometida a previa licencia municipal la tasa por el aprovechamiento detallado en el artículo 6 apartado 1, por la cual se exige la presentación de la siguiente documentación; declaración en que consten los elementos necesarios para la fijación de la tasa, el recibo del Impuesto sobre Bienes inmuebles, recibido de agua y basuras, licencia de apertura cuando corresponda y una fotografía de la fachada del inmueble donde se solicita el vado y/o lo instalación del pilón.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta solicitud de autorizaciones se someten a informe de los servicios técnicos municipales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Una vez concedida la autorización se procede a la liquidación de la tasa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No se consentirá la ocupación de la vía pública hasta que no se haya liquidado la tasa y las personas interesadas hayan obtenido la correspondiente licencia. El incumplimiento de esta obligación podrá dar lugar a la no concesión de la licencia, sin perjuicio del pago de la tasa y de las sanciones y recargos que correspondan.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las autorizaciones tendrán carácter personal y no podrán ser cedidas o subarrendadas a terceros. El incumplimiento de este mandato dará lugar a lo anulación de la licencia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La tasa por el aprovechamiento detallado en el artículo 6 apartado 1.a) y 6 apartado 1.d) se exigirá mediante padrón anual, en el cual figurarán las personas afectadas y las cuotas respectivas derivadas de la aplicación de la presente ordenanza, excepto las altas que se produzcan dentro del ejercicio que se exigirán mediante autoliquidación en el momento de presentar la solicitud de la preceptiva autorización, y tendrán efecto desde el trimestre&amp;nbsp; natural en que se conceda el aprovechamiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La tasa por el aprovechamiento detallado en el artículo 6 apartado 1.c) se exigirá mediante liquidación, en el momento de presentar la solicitud de la preceptiva autorización, y tendrán efecto desde el trimestre&amp;nbsp; natural en que se conceda el aprovechamiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La tasa por el aprovechamiento detallado en el artículo 6 apartado 1.e) se exigirá mediante liquidación, en el momento de presentar la solicitud de la preceptiva autorización, y tendrán efecto desde el trimestre natural en que se conceda el aprovechamiento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La presentación de la baja tendrá efectos a partir del primer día del trimestre natural siguiente a la presentación de la referida solicitud. En este caso, la persona interesada podrá solicitar la devolución proporcional de los trimestres no meritados a consecuencia de la presentación de la baja. La no presentación de la baja determinará la obligación de continuar abonando las cuotas resultantes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 9.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Obligación de contribuir en las tasas reguladas en esta ordenanza nace:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Cuando se trate de concesiones de nuevos aprovechamientos de la vía pública, en el momento de solicitar la correspondiente licencia. Las cuotas resultantes de las tasas reguladas en esta ordenanza se meritan por trimestres naturales.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Cuando se trate de concesiones de aprovechamiento que estén autorizadas y prorrogadas, el día primero de enero.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El pago de las tasas se realizará:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Cuando se trate de concesiones de nuevos aprovechamientos, se realizará el pago a través de las entidades colaboradores mediante el documento emitido por el Ayuntamiento, pero siempre antes de retirar la correspondiente licencia.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Cuando se trate de concesiones de aprovechamiento que estén autorizadas y prorrogadas, una vez incluidas en los padrones o matrículas de esta tasa, por años naturales a través de las entidades colaboradores mediante el documento emitido por el Ayuntamiento, en los plazos reglamentarios fijados.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 10.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las cuotas no satisfechas en el periodo voluntario se tendrán que hacer efectivas por el procedimiento de constreñimiento, de acuerdo con el Reglamento general de recaudación y normas supletorias y complementarias.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 11.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se consideran partidas quiebras o créditos incobrables aquellas cuotas que no hayan podido hacerse efectivas por el procedimiento de constreñimiento, declaración para la cual se formalizará el oportuno expediente de acuerdo con el que prevé el vigente Reglamento general de recaudación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 12.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Infracciones y sanciones.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En todo el relativo a infracciones tributarias y su calificación, así como a las sanciones que a las mismas corresponda en cada caso, se aplicarán las normas contenidas a la Ley General Tributaria y al Reglamento General de Recaudación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DISPOSICIÓN ADICIONAL&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Clasificación y categoría de calles, a efectos de aplicación de las tarifas contempladas en la presente ordenanza.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;PRIMERA CATEGORÍA:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Alcúdia, avenida de&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente ordenanza fiscal, la redacción definitiva de la cual ha sido aprobada por el Ayuntamiento en Pleno el 17 de octubre de 2019, entrará en vigor el día de su publicación en el Boletín Oficial de las Islas Baleares, empezará a aplicarse a partir del día 1 de enero de 2020 y continuará en vigor hasta que no se&amp;nbsp; acuerde la modificación o derogación."&lt;/span&gt;&lt;/p&gt;
