    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No habiéndose presentado ningún tipo de alegación, durante el periodo de exposición al público con respecto al siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ordenanza Reguladora del precio público para la prestación de servicios a las Instalaciones Deportivas Municipales, a otros inmuebles municipales y para el alquiler de mobiliario público de Petra.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(Edicto núm. 10251 del BOIB Núm. 142 de 19 de octubre de 2019, sección V, página 41651).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 17.3 de la Ley Reguladora de las Haciendas Locales, se da por aprobado definitivamente el referido acuerdo, publicándose íntegramente a continuación el texto completo correspondiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="background-color:null"&gt;ORDENANZA REGULADORA DEL PRECIO PÚBLICO PARA LA PRESTACIÓN DE SERVICIOS EN LAS INSTALACIONES&amp;nbsp; DEPORTIVAS MUNICIPALES, A OTROS INMUEBLES MUNICIPALES Y POR ALQUILER DE MOBILIARIO PÚBLICO DE PETRA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="background-color:null"&gt;NATURALEZA, OBJETO Y FUNDAMENTO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Artículo 1&lt;/strong&gt;.- De conformidad con lo previsto en los artículos 41 a 47 del Real Decreto Legislativo 2/2004 de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, este Ayuntamiento establece unos precios públicos para la prestación de servicios a las instalaciones deportivas municipales, y otros inmuebles públicos municipales de Petra y también para alquiler de muebles (sillas, mesas, carpas, etc.) de los que sea titular el Ayuntamiento de Petra. Dichos precios públicos se regirán por la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;OBLIGACIÓN DE PAGAR&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Artículo 2&lt;/strong&gt;.- La obligación de contribuir nace como consecuencia de la entrada de los usuarios a las instalaciones deportivas y otras de propiedad municipal, así como por la utilización de los diferentes servicios y / o muebles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;HECHO IMPONIBLE&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Artículo 3&lt;/strong&gt;.- El hecho imponible está determinado por la utilización de las distintas instalaciones, muebles o servicios existentes en los recintos deportivos y otros de propiedad municipal, los cuales se detallan en el cuadro de tarifas que figura al final del artículo 5 de la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;Queda excluida de la aplicación de esta Ordenanza la utilización de las instalaciones y muebles para la realización de actividades como concursos, clases, campus y otros, que impliquen recaudación de cuotas y / o matrículas y que no sean organizadas y dirigidas por el Ayuntamiento. Estas actividades estarán sometidas al título que sea exigible de acuerdo con la Ley Balear de Actividades y los tributos que, en su caso, resulten de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;SUJETO PASIVO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Artículo 4&lt;/strong&gt;.- Están obligados al pago de estos precios públicos las personas físicas o jurídicas usuarias de los distintos servicios, instalaciones o muebles; o que soliciten la entrada al recinto deportivo municipal y / o en otros que sean de titularidad municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;CUOTA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Artículo 5&lt;/strong&gt;.- Los precios públicos a los que se refiere esta Ordenanza se harán efectivos en el momento de formalizarse la solicitud de prestación de los respectivos servicios, por el importe indicado en la lista de tarifas que figura al final del artículo. Las instalaciones y / o muebles se deben dejar en buen estado, que será, como mínimo, similar al anterior al de su utilización por parte del interesado. De lo contrario, la persona responsable asumirá los gastos correspondientes las que se descontarán de la cantidad que se habrá dejado en depósito, equivalente al importe total del precio público correspondiente. Esto sin perjuicio de que el Ayuntamiento pueda reclamar indemnización al interesado, si el coste de los daños ocasionados fuera superior al precio público depositado en garantía o abonado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;3- En el momento de hacer las solicitudes se entregará el régimen de funcionamiento del uso correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;a) Los alumnos del C.P. Junípero Serra, equipos federados y asociaciones legalmente constituidas o reconocidas municipalmente de esta localidad. Cuando se trate de entrenamientos para competiciones oficiales o actividades que formen parte de su programación podrán utilizar gratuitamente las instalaciones&amp;nbsp; y muebles a que se refiere esta Ordenanza en el horario y fechas que se propongan por parte de los servicios municipales. Este horarios y fechas tendrán prioridad sobre otros&amp;nbsp; solicitudes. A tal efecto deberán presentar, con un mes de antelación, la programación de actividades para realizar en cada trimestre o anual. Propuesta que deberá obtener la aprobación de la Junta de Gobierno de este Ayuntamiento, quien resolverá igualmente las coincidencias que pudieran plantearse entre las actividades de dos o más entidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;b) Quedan exentos los disminuidos físicos y / o psíquicos, así como de otras personas que puedan proponer los Servicios Sociales, mediante propuesta justificada con informe previo al respecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;VIGENCIA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Artículo 7&lt;/strong&gt;.- La presente Ordenanza, una vez aprobada por el Pleno del Ayuntamiento, regirá a partir de este ejercicio y estará en vigor desde el día siguiente al de su publicación en el BOIB, hasta que se acuerde expresamente su modificación o derogación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
